City of Marco Island Florida 51 Bald Eagle Drive Marco Island, Florida cityofmarcoisland.com Meeting Minutes - Final Friday, January 22, 2021 9:00 AM Community Room Planning Board Planning Board Meeting Minutes - Final January 22, 2021 NOTE: ANY PERSON WHO DECIDES TO APPEAL A DECISION OF THIS BOARD WILL NEED A RECORD OF THE PROCEEDINGS PERTAINING THERETO, AND THEREFORE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED, NEITHER THE CITY OF MARCO ISLAND NOR THE PLANNING BOARD SHALL BE RESPONSIBLE FOR PROVIDING THE RECORD. (1) CALL TO ORDER Vice-Chair Bailey called the meeting to order at 9:00 a.m. (2) ROLL CALL Present 4- Board Member Issler, Board Member Vergo, Member Bailey, and Member Swartz (3) PLEDGE OF ALLEGIANCE (4) APPROVAL OF THE AGENDA Member Issler mentioned that he would like to add an item under Old Business to discuss the Marco Island Yacht Club vote that was taken on the December meeting. MOTION by Board Member Dahl, seconded by Board Member Isser that the Agenda be Approved. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 5- Dahl, Board Member Issler, Board Member Vergo, Member Bailey and Member Swartz (5) COMMUNITY FORUM/PUBLIC COMMENT (TIME APPROXIMATELY 9:05 A.M.) None. (6) BOARD ABSENCES Board Members who were present and reappointed indicated that they would be at the next Planning Board Meeting on February 5, 2021. (7) APPROVAL OF MINUTES None. (8) STAFF COMMUNICATIONS Daniel Smith mentioned that on the February 5 meeting they plan on bringing forward an amendment to the site plan for the Marco Island Academy. Island County Club is coming forward with some changes and possibly broth forward to the meeting. (9) OLD BUSINESS Member Issler discussed an issue regarding the votes taken on the December meeting for the Marco Island Yacht Club since the City Council decided not to vote on it since it was a yes vote. Member Vergo mentioned that it was a difficult decision, but he would maintain his vote. And questioned if the City Council could have voted and overturned it. City of Marco Island Florida Page 1 Planning Board Meeting Minutes - Final January 22, 2021 The City Attorney mentioned that the motion was to approve the requested boat dock extension the motion was clear. (10) NEW BUSINESS ID 21-1325 PRESENTATION - Comprehensive Plan Update - Future Land Use & Transportation Elements Mary Holden mentioned to the Planning Board members that Margaret Banyan and Alexis Crespo will be presenting the Draft Comprehensive Plan Future Land Use and Transportation element. She stated that this was only a draft for comments and members input. Dr. Margaret Banyan presented the Draft Comprehensive Plan Future Land Use Element to the Board members. She mentioned they kept in mind the City’s vision for the future using the Strategic Plan as a guide. And focused on the roll of the Comprehensive Plan as a long range document for the physical development of the City. Alexis Crespo mentioned that the approach they took with drafting the Future Land use element was preserving important components of the existing plan, which was updated in 2009, and updated to better addressed the Strategic Plan. She continued by stating that it is important to define community character and uniqueness. With that in mind they wanted to break down the different future land use categories for better implementation and clarity. They are recommending the removal of regulatory language that is codified in LDC. For the purposes of this Plan, small town charm is characterized by Marco Island’s convenient coastal living, a balanced mix of land uses to serve local residents and the tourist population, and a strong sense of place identified by the City’s unique history, architecture, signage, landscaping, community facilities, and natural environment. Dr. Margaret Banyan presented the draft Transportation Element to the Board members. One of the principles that went into drafting this element was the strategic plan by using transportation to reinforce community character and island uniqueness. It address safety for all users, fills gaps in multi modal facilities, support innovative funding opportunities for all modes, support connectivity and multi modal approached to achieve better traffic management, addresses concurrency and fulfills State of Florida requirements for the element and updated map series. The City of Marco Island will coordinate land use and transportation plans to support a safe, accessible, and efficient multimodal transportation system that enhances livability and small town character. Member Issler suggesting adding the word “use” on objective 7.2 on the land use element under policy 7.2.1 because there have been some court cases that have homed in on permitted use for residential neighborhoods. The City Attorney mentioned that the use of the term "use' is not an issue to the extent that they are going to discuss any regulation of vacation rentals that have been preempted by the state. He would like review that language or any legal impact prior to final consideration. (11) BOARD COMMUNICATIONS Member Issler thanked the Planning Board for their time and allowing him to serve as a Planning Board Member. He also thanked Howard Reed for appointing him to the Planning Board. He expressed a concern on the future activities at the Planning Board with regards to the last City Council meeting which appeared that first amendment rights where trampled and his nomination to the Planning Board was taken down because of an election news letter that he has been putting out for the last 20 years. He recommended City residents to watch the City Council meeting of May 7, 2018 and listen to the conversation that takes place and compare it to the upcoming meeting.
