Mr. Martin made a motion, seconded by Mr. Dye, to approve the June 24, 2013 Board of Zoning Appeals Meeting Minutes as presented. Motion carried 6 – 0 – 0. This matter was Approved and Finalized Absent: 1 - Board member Lowman City of Marietta Page 1 Printed on 8/6/2013 2:11:16PM BOARD OF ZONING APPEALS Meeting Minutes July 29, 2013 VARIANCES: 20130731 V2013-31 Todd Angel 33 Garrison Road V2013-31 [VARIANCE] TODD ANGEL requests a variance for property located in Land Lot 02190, District 17, Parcel 0210, 2nd Section, Marietta, Cobb County, Georgia and being known as 33 Garrison Road. Variance to increase fence height along front yard of property from 4ft. to 6 ft. Ward 3. File #20130731 (V2013-31) was presented by Mrs. Kyethea Clark for property located in Land Lot 02190, District 17, Parcel 0210 and being known as 33 Garrison Road. A public hearing was held. Todd Angel, petitioner and applicant for owner DeAnna Brown, is requesting a variance to increase the fence height along the frontage of the property along Garrison Road from 4’ to 6’. The fence will be iron – or a similar material – and the same material will be used for the gated entrances. Mr. Angel is requesting this variance in order to provide additional security for the property owners, as well as the recording, editing and production equipment on site. Discussion between Chairman Mills and Mr. Angel determined that there are a total of 11 rock posts, with brick style to match existing structure and then painting to match the color of the existing structure. The public hearing was closed. Mr. Mills made a motion, seconded by Mrs. Barber, to approve the following variance: Variance to increase fence height along front yard of property from 4ft. to 6 ft. The rationale for approving this variance is that granting the application will not be detrimental or injurious to property or improvements in the vicinity of the development site, or to the public health, safety, or general welfare. The motion carried 6 – 0 – 0. A motion was made by Board member James A. Mills, seconded by Board member Justice Barber, that this matter be Approved and Finalized. The motion carried by the following vote: 6 – 0 – 0. Absent: 1 - Board member Lowman OTHER BUSINESS: At this time, Chairman Mills acknowledged Marshall Dye’s service to the Board of Zoning Appeals from May 22, 2006 to July 29, 2013. Mr. Dye is resigning to begin his campaign for the Marietta City Council Ward 4 position.
