Leskoven, David Hunter and Bobby Van Buren Staff: Rusty Roth, Development Services Manager Matthew Williams, Urban Planner Daniel White, City Attorney Ines Embler, Secretary to the Board CALL TO ORDER: Mr. Lowman called the January 26, 2015 meeting of the Board of Zoning Appeals to order at 6:00PM. MINUTES: 20150004 November 24, 2014 Board of Zoning Appeals Meeting Minutes Review and Approval of the November 24, 2014 Board of Zoning Appeals Meeting Minutes Mr. Mills made a motion, seconded by Mr. Hunter, that the November 24, 2014 Board of Zoning Appeals meeting minutes be approved. A motion was made by Board member Mills, seconded by Board member Hunter,that this minutes be Approved and Finalized . The motion CARRIED by the following vote. Against: 0 Vote For: 7 City of Marietta Page 1 Printed on 1/27/2015 9:42:30AM BOARD OF ZONING APPEALS Meeting Minutes January 26, 2015 VARIANCES: 20141351 V2015-04 [VARIANCE] NORTHSIDE MULTI FAMILY, LLC V2015-04 [VARIANCE] NORTHSIDE MULTI FAMILY, LLC request a variance for property located in Land Lot 10710, District 16, Parcel 0390, 2nd Section, Marietta, Cobb County, Georgia and being known as 735 Cobb Parkway North. Variance to increase the maximum floor area ratio (FAR) from 0.50 to 0.55; variance to increase the maximum impervious surface from 80% to 91%; variance to reduce the side setback from 15 ft. to 14.7 ft. Ward 5B. A public meeting was held. The applicant, Mr. Kirk Buttle spoke on behalf of owner, Northside Multi Family, LLC, and gave a history of the property and explained their reasons for needing the requested variances. Mr. Lowman asked if this was an “as-is” and if no changes where planned and Mr. Buttle affirmed. There was no opposition to this variance request. The public hearing was closed. A motion was made by Mr. Clark to grant the application on the basis that it would not be detrimental or injurious to the property or the improvements in the vicinity of the development or to the public health, safety or general welfare. It was seconded by Mr. Leskoven. The Motion carried 7-0-0. A motion was made by Board member Clark, seconded by Board member Leskoven,that this Variance be Approved and Finalized . The motion CARRIED by the following vote. Against: 0 Vote For: 7 20141352 V2015-05 [VARIANCE] WAFFLE HOUSE V2015-05 [VARIANCE] WAFFLE HOUSE request variances for property located in Land Lot 12380, District 16, Parcel 0090, 2nd Section, Marietta, Cobb County, Georgia and being known as 1176 Roswell Road. Variance to reduce the rear setback from 35 ft. to 12 ft.; variance to allow for an accessory structure to be closer to the public right of way than principal structure. Ward 7A. A public meeting was held. The applicant, Mr. Sanford McAllister spoke on behalf of owner, 3 Shelly’s Inc./Wazir, and shared the reason for the variances being requested. City of Marietta Page 2 Printed on 1/27/2015 9:42:30AM BOARD OF ZONING APPEALS Meeting Minutes January 26, 2015 Mr. Lowman asked if he was familiar with what the City is recommending for visual screening and Mr. McAllister said yes and explained his intentions. Mr. Mills asked if he had put any thought into putting a detention pond under the ground and Mr. McAllister stated that it was not financially feasible at this time. Mr. Lowman stated that the Georgia DOT was going to present a challenge for him when they finalize how they are going to run that off ramp and asked if he saw any problems that would stop him from doing what he wants to do and Mr. McAllister said that they have met with DOT onsite and do not foresee a problem. Mr. Van Buren asked if the west side was the only entrance and Mr. McAllister said it flows through to the east side as well on Frey’s Gin Court. Ms. Barber asked if he reviewed all of Public Work’s comments on the report and Mr. McAllister said yes. There was no opposition to this variance request. The public hearing was closed. A motion was made by Ms. Barber to grant the application on the basis that it would not be detrimental or injurious to the property or the improvements in the vicinity of the development or to the public health, safety or general welfare with the stipulation that a ten foot buffer of greenery be included along the rear property line buffer. It was seconded by Mr. Van Buren. The Motion carried 7-0-0. A motion was made by Board member Barber, seconded by Board member Van Buren,that this Variance be Approved as Stipulated . The motion CARRIED by the following vote. Against: 0 Vote For: 7 ADJOURNMENT: Mr. Lowman made a motion to adjourn, seconded by Mr. Mills. The January 26, 2015 meeting of the Board of Zoning Appeals was adjourned at 6:15PM. _____________________________ J.K.
