Review and approval of the April 28, 2020 regular meeting minutes.

20200432 Open Space in Residential Zones
Discussion of issues surrounding open space and recreation area requirements in
residential zoning districts.

20200455 Contractual Agreements with DMDA & Marietta Visitors Bureau
1. Annual rent of Historic Train Depot for $18,000 to Marietta Convention and
Visitors Bureau (MCVB) for purpose of promoting tourism through this historic site;
rental period commencing 7/1/20 to 6/30/25; City responsible for upkeep and capital
maintenance: annual adjustment in rent of 3% with rent to be paid directly to City
from the Motor Vehicle Rental Excise Tax on behalf of MCVB to City and proceeds
used and encumbered by City exclusively for maintenance and capital improvements
(with Tenant’s advisement) to said Depot as authorized by City Code 8-38-040;
depot premises shall include building and 20 feet from building running parallel with
Building (north to south) into Atherton Square and separated by a decorative railing
by City.
2. City to assign, as if an easement, any of its real property interest within the overall
parcel of property known as the DMDA parking lot between Depot Street Bed and
Mill Street except for Northeasterly corner of the property to be and currently used
and managed by City; DMDA to lease entire parcel back to City for City to use
police powers to manage parking lot: DMDA retains right to use parking lot from time
to time for other downtown promotional events (i.e, Farmers Market) at will. DMDA
and City to respectively give each other the first right of refusal if Kennesaw House,
DMDA parking lot or Depot if ever deemed surplus for sale.
