Adjournment  STAFF REPORT MEETINGS: June 14, 2024 TITLE: Special Use Permit Request – 1048 Independence Drive STAFF RESPONSIBLE Keith Holland, Community Development Director BACKGROUND/HISTORY Tony Williams, applicant and owner of property at 1048 Independence Drive has requested a Special Use Permit to allow for a live/work residence on this land. Mr. Williams, a native of Martinsville, is a professional woodworking artist who would like to retire in Martinsville, while still having the ability to woodwork in his spare time. In order to achieve this, Mr. Williams plans to construct a 40’ x 51’ metal building to work and reside in for the foreseeable future. Eventually, Mr. Williams will construct a permanent retirement home on the same property, and will then utilize the metal building as an accessory structure to the home. The property at 1048 Independence Drive (Tax Map ID: 47 (01)00/01A) is approximately 19.18 acres and zoned R-C, City Residential District. Live-work residences are a permitted use by issuance of a Special Use Permit in R-C districts (Section XI.-R-C, City Residential District, D. Uses Permitted by Special Use Permits). The Martinsville Planning Commission held a legally advertised public hearing on Wednesday, April 17, 2024, to hear comments or concerns. There was one (1) public comment received during the public hearing asking for clarification of the request. The Planning Commission unanimously recommended that City Council grant this Special Use Permit. City Council held a properly advertised public hearing on May 28, 2024, but took no action on the SUP request. POLICY EXPLANATION The Martinsville Planning Commission voted to recommend APPROVAL of the requested Special Use Permit by a vote of 4-0 (Watkins, Hairston absent), to allow for the issuance of a Special Use Permit for a live-work residence consisting of an art and woodworking shop at property located at 1048 Independence Drive. New Business: Public Hearing for Zoning Ordinance Amendments Hannah Powell presented proposed amendments to the Zoning Ordinance pertaining to building height requirements and handicap space requirements as discussed and verbally approved at the previous meeting. She explained that the draft had remained the same except for the previously determined change to the C-UB district. Chairman Martin opened the public hearing and asked if there was anyone present that would like to speak on the matter. There was none; he then closed the public hearing and discussion amongst the members ensued. Riggs Roberson made a motion to recommend approval, finding that the proposed amendments as presented on March 20, 2024 will promote the  health, safety, and general welfare of the public and assist in the orderly development of city. NEXT STEPS: Planning Commission will hold a public hearing to consider the Special Use Permit request and make a recommendation to City Council. The Planning Commission will either recommend approval, denial, or to delay action. Once the Planning Commission makes a recommendation of approval or denial, a public hearing will be held before City Council the following month for their final decision of approval or denial of the request. SUGGESTED MOTIONS: (APPROVE) I make a motion to recommend APPROVAL of the special use permit request, finding that the request as presented on April 17, 2024 will promote the health, safety, and general welfare of the public and assist in the implementation of the City’s adopted Comprehensive Plan for the orderly future development of the City. Since that time, some of the organizations included in the membership criteria have dispersed while new organizations have been created. Recruiting qualified members for the Arts & Cultural Committee has proven difficult with the current membership requirements. In an effort to expand the impact that arts and culture can play in community revitalization, the ACC thought it would be advisable to change the make up of the organizations sought as partners to serve on the ACC. At the City Council meeting on May 28, the consensus of Council members was to reduce the committee number from 11 to 7 to address the difficulty of recruiting new members for approval. For several reasons, the ACC and city staff respectfully asks City Council to reconsidered their decision to reduce ACC membership and approve the new criteria for membership as presented during the May 28 meeting. POLICY EXPLANATION Staff and the Arts & Cultural Committee feels that updating the membership requirements will result in a larger pool of qualified committee members, allowing the committee to reach full membership and be a more effective positive force in the community. I especially want to recognize Martinsville Policeman George F. Carter, who lost his life in the performance of his duty on June 14, 1919 while he was attempting to apprehend gamblers. I would also like to recognize Martinsville Police Officer Jonathan Bowling who lost his life on January 26, 2005 while fighting in Iraq during Operation Iraqi Freedom. NOW, THEREFORE, I, LC Jones, Mayor of the City of Martinsville, Virginia on this 14th day of June, 2024, do hereby recognize, embrace and commend the Patrick & Henry Community College Women’s Softball team for their extraordinary achievement in winning the National Junior College Athletic Association, Division III, Softball World Series Championship of 2024 and for being a source of pride for our entire community. ________________________ LC Jones, Mayor  MEN’S HEALTH WEEK JUNE 10-16, 2024 WHEREAS, Men’s Health Month is part of an ongoing international effort to educate men, boys and their families about receiving regular disease prevention screening and living healthier lifestyles; and WHEREAS, Nationwide, life expectancy for men averages five years less than that of women, with men experiencing higher rates of health rates of health problems such as diabetes, obesity, cancer, heart disease and premature mortality; and WHEREAS, The COVID-19 pandemic has had a devastating impact on men’s health in the United States, dropping men’s life expectancy by two years; and WHEREAS, Men’s Health Month is a time for the public to recognize the mental and physical health needs of men and boys while encouraging fathers to be role models for their children through preventative health screenings, healthy living and seeking needed help; and WHEREAS, The growing epidemic of suicide and substance abuse requires special effort to raise awareness of unrecognized and undiagnosed depression and mental stress in boys and men; and WHEREAS, the centerpiece of Men’s Health Month is National Men's Week, a special awareness period passed by Congress and signed by President Bill Clinton on May 31, 1994.
