MINUTES Public Hearing and Regular Town Council Meeting, Town of Massena Date/Time: Wednesday, August 15th, 2018 at 5:30 PM Location: Massena Town Hall ATTENDANCE: MEMBER PRESENT ABSENT Supervisor Steve O’Shaughnessy x Councilman Albert Nicola x Councilman Thomas Miller x Councilman Samuel Carbone, Jr. x Councilwoman Melanie Cunningham x ALSO PRESENT: Jeannine Brouse, Brenda Mossow, Frank Diagostino, Members of the Public, Members of the Media The Supervisor opened the meeting at 5:30 PM with the Pledge of Allegiance. The Supervisor continued the meeting with a 15-Minute Public Comment Period. Public Hearing  The Supervisor opened the Public Hearing, and read the following notice: Town of Massena Local Law No. ___ of the year 2018 WHEREAS, the Town Board of the Town of Massena (the “Town”) desires to enact a Moratorium on all solar energy system development (as defined herein) operating within the Town: WHEREAS, the Town Board intends to enact comprehensive regulations regarding solar energy system development in the Town; WHEREAS, the Town Board believes that such a moratorium will protect the public interest and welfare of the residents of the Town until such comprehensive regulations are adopted; and WHEREAS, there are currently no regulations relating to solar energy system development within the Town, but the Town Board believes that such regulations can be duly considered and adopted within six (6) months of the date hereof; NOW, THEREFORE, BE IT ENACTED AS FOLLOWS: 1. There is hereby placed a moratorium on all solar energy system development in the Town of Massena, County of St. Lawrence, and State of New York. 2. Solar energy system shall mean an electrical generating system composed of a combination of both Solar Panels and Solar Energy Equipment. A Solar Panel is a photovoltaic device capable of collecting and converting solar energy into electrical energy. Solar Energy Equipment shall mean electrical energy storage devices, material, hardware, inverters, or other electrical equipment and conduit of photovoltaic devices associated with the production and/or transmission of electrical energy. Nothing herein shall prevent solar panel and solar energy equipment located on the roof of or within any legally permitted building or structure for the purpose of producing electricity primarily for onsite consumption. Further, nothing herein shall prohibit the Massena Electric Department from conducting its regular and usual business of providing electrical distribution within its service territory as defined by its tariff with the New York State Department of Public Service. 3. This moratorium shall expire on the ___ day of February, 2019. 4. This local law shall take effect upon filing with the Town Clerk of the Town, and upon filing the same with the Secretary of the State of New York. 5. The above local law was enacted by the Town Board of the Town on the ___ day of August, 2018.  There were no comments.  The public hearing was then closed and the Regular Meeting was continued. Presentations and Discussions  WPBS Presentation. Councilman Miller explained the intent of the presentation. Kraig Everard and Marc Muglia, both of PBS, explained what WPBS does and what they produce. Councilman Carbone questioned as to whether the grant covers Massena or the whole area. The WPBS cost will be covered by a grant, with no cost to the taxpayers. Areas highlighted would include Robert Moses, Jacques Cartier, Higley Flow, Coles Creek, Promote Boutique Air.  Fishing Tournaments Discussion. Councilman Miller reported that Fishing League Worldwide (FLW) has a great interest in coming to Massena to host a fishing tournament in September 2019. $17,500.00 is required to be paid by the Town. The Town can try to access the funds through grants, politicians, and day events. Supervisor O’Shaughnessy has concerns that this has just been presented, along with concerns about the money. Councilman Miller stated that FLW would like an answer by tonight. FLW does not need to be paid right now, they would just like a commitment. Resolutions: Resolution # - 2018 To hold a Fishing League Worldwide Tournament in Massena in 2019 Motion by: Miller. Presentations and Discussions (continued)  Airport Open House Car & Vendor Show. Councilman Miller reported that the show is next weekend. Promotional signs have been placed at all intersections. They are also marketing the event in Canada and Malone. Supervisor O’Shaughnessy thanked the Fire Department. Resolution # - 2018 Authorizing a 6-month Moratorium on All Solar Energy System Development in the Town of Massena. Town Attorney Gustafson explained the legal aspects of the Law pertaining to this moratorium, adding that it gives us six months to put together a comprehensive solar law. Resolution # - 2018 Authorizing a Request for Proposals (RFP) in connection with the Town of Massena, Massena Public Library Business Resources Center Project and the replacement of the existing Library Lift System. Resolution # - 2018 Authorizing the Town Supervisor to Sign the Following: Grant Offer for Airport Improvement Program (AIP) Project No. 3-36-0054-077-2018 (Project: Fence Stabilization Design as required by 49 CFR 1542 (Existing Security Fence with the intent to eliminate conditions that could lead to inadvertent entry to the airfield)) Motion by: Nicola Vote Second by: Carbone Aye Nay Abstain Absent O’Shaughnessy X Nicola X Miller X Carbone, Jr. X Cunningham X Motion is Carried. Resolution # - 2018 Authorizing the Town Supervisor to Sign the Following: Grant Offer for Airport Improvement Program (AIP) Project No. 3-36-0054-076-2018 (Project: Rehabilitate Taxiway (100,000 SF) [T/W C Rehabilitation (Design)], Rehabilitate Taxiway Lighting [Taxiway C Lighting Replacement (Design)]) Motion by: Miller Vote Second by: Carbone Aye Nay Abstain Absent O’Shaughnessy X Nicola X Miller X Carbone, Jr. X Cunningham X Motion is Carried. Resolution # - 2018 Authorizing the Town Supervisor to (i) Execute Any and All Documents Necessary in Connection with a Grant Application Through the NYS Department of Health Environmental Facilities Corporation Under the NYS Water Infrastructure Improvement Act and the NYS Intermunicipal Water Infrastructure Grants Program Drinking Water, and (ii) Submit Said Grant Application on Behalf of the Town of Massena. Supervisor O’Shaughnessy presented these reports.  Year To Date Fund Summary. Supervisor O’Shaughnessy presented this report. Committee Reports  Airport/Highway Committee. Frank Diagostino gave an update on the Airport. Councilman Carbone expressed concern about the brush along the sides of the road, and will contact the County regarding the road shoulder conditions.  Recreation Committee. Councilman Nicola gave a report on the Arena roof project.  Rescue Squad. Councilwoman Cunningham gave a report on the Rescue Squad.  Museum. Councilman Carbone reported on the status of the Museum’s building addition that will house the hearse. Announcement of Next Town Board Meeting The Town Board’s next meeting is Wednesday, September 19, 2018 at 5:30 PM. 15-Minute Public Comment Period (Closing Comments) Doris Robinson asked about the costs associated with the dog training facility? Executive Session Motion to conduct an Executive Session made by Councilman Miller to discuss the medical, financial, credit or employment history of a particular person or matters leading to the appointment, employment, promotion, demotion, discipline, suspension dismissal or removal of a particular person.
