The Supervisor opened the meeting with the Pledge of Allegiance. Called to order at 4:30 PM 2022 Budget and Discussions The Public Hearing Notice for the 2022 Budget was read by Supervisor O’Shaughnessy. NOTICE IS HEREBY GIVEN that the Preliminary Budget of the Town of Massena for the fiscal year beginning January 1, 2022, has been compiled and filed in the office of the Town Clerk in Massena, New York, where it may be inspected by any and all interested persons during regular office hours, 8 am to 4:30pm and viewed on the massena.us web site. FURTHER NOTICE is hereby given that the Town Board of the Town of Massena will hold a Public Hearing on Nov. 3, 2021 at 5:30 pm at the Town Hall, and that at such hearing, any person may be heard in favor of or against any items therein contained. PURSUANT to section 108 of the Town Law, the proposed salaries of the following Town Officers are hereby specified as follows: Town Supervisor $15,500.00 Town Councilmen 4 @ $6,000 $24,000.00 Town Clerk $39,451.00 Town Justice 2 @ $20,400 $40,800.00 PURSUANT to Section 495, Chapter 258 of Real Property Tax Law, a report of all Exemptions and Payment in Lieu of Taxes will be posted on the Town Clerk bulletin board and will become part of the final budget There were no Public Comments. The Adoption of the final 2022 budget will be on November 10, 2021. Announcements/Notifications  The resignation of Councilman Elsner was announced effective November 1, 2021. The Board unanimously thanked him for all of his hard work and dedication.  Councilman Carbone addressed the Board to have Tom Miller fill the vacated seat of Town Councilman Elsner through until the 2022 Election. Councilwoman Bellor also objected to filling the vacant seat at this time. Page 1|3 Town Board Special Meeting November 3, 2021 Resolution 142 2021 Appointing Tom Miller to the Town Council to fill the seat vacated by Robert Elsner; said appointment to expire December 31, 2022. Resolution 143 2021 Adopting Local Law to allow the Town of Massena to Override 2022 Town Budget Tax Levy as established in General Municipal Law 3-c Section 1. Legislative Intent It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Massena, County of St. Lawrence pursuant to General Municipal Law 3-c, and to allow the Town of Massena, County of St. Lawrence to adopt a town budget for (a) town purposes, (b) fire protection districts and (c) any other special or improvement district governed by the Town Board for the fiscal year 2022 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law 3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law Section 3-c, which expressly authorizes the Town Board to override the tax levy limit by the adoption of a local law approved by a vote of sixty percent (60%) of the Town Board. Section 3. Tax Levy Limit Override The Town Board of the Town of Massena, County of St. Lawrence is hereby authorized to adopt a budget for the fiscal year 2022 that requires a real property tax levy in excess of the limit specified in General Municipal Law, 3- c. Section 4. Severability If in any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm, or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective Date. This local law shall take effect immediately upon filing with the Secretary of State.
