PLANNING COMMISSION MEETING WEDNESDAY, APRIL 27, 2022 | 6 PM The Planning Commission will meet at 6:00 p.m. at the Mauldin City Hall at 5 East Butler Road in the Council Chambers. Please note that members of the public may attend this meeting in-person but are encouraged to participate remotely through Zoom. Please visit the City’s website at https://cityofmauldin.org/your- government/meeting-minutes-agendas/ to access the meeting remotely. In order to follow healthy and safe practices, please note that occupancy in the Council Chambers will be limited. Additionally, attendees may have their temperature checked by a non-contact infrared thermometer prior to entering the Chambers. Any person registering a fever (100.4° or higher) will not be permitted to enter the Chambers. Similarly, any person exhibiting or experiencing symptoms associated with COVID-19 or generally feeling unwell will not be permitted to enter the Chambers. Mauldin Planning Commission Meeting ••• 1 MAULDIN PLANNING COMMISSION MINUTES February 22, 2022 6:00 P.M. MEMBERS PRESENT: Jonathan Paulsen (Chair), Kaitlyn Woolard, Chris Paglialunga, Brian Sofield MEMBERS ABSENT: Dean Oang CITY STAFF PRESENT: David Dyrhaug CALL TO ORDER/OPENING REMARKS Mr. Paulsen called the meeting to order at 6:00 P.M. Mr. Dyrhaug held roll call. JANUARY MEETING MINUTES Ms. Woolard moved to accept the January 25, 2022, Planning Commission minutes. Mr. Paglialunga seconded the motion. The motion to accept the January 25, 2022, Planning Commission minutes passed by unanimous vote, 4-0. OLD BUSINESS No old business was discussed. NEW BUSINESS Docket #: PC-2022-02-PP Location: 12 acres at Hollyridge Ct Request: Holly View Preliminary Plat Approval Mr. Dyrhaug introduced a request to approve the preliminary plat for the Holly View subdivision located at Hollyridge Court. The applicant is proposing to develop and subdivide this tract for 85 attached single-family homes. Mr. Lynn Solesbee, with Bluewater Civil Design, introduced himself as the project engineer and expressed that he is available to answer questions. Mr. Paulsen opened the floor for public comments. No public comments were offered. Hearing no comments, Mr. Paulsen closed the floor for public comments. Page 1 of 3 Mr. Dyrhaug provided the staff report and staff findings. Ms. Woolard asked about what, if any, buffers would be required. Mr. Dyrhaug responded that the approved PD documents for this tract do not indicate the requirement of any buffers. Mr. Solesbee also commented that the grade for the homes in Holly View will be significantly lower than the grade of the Laurel Heights Townhomes. Mr. Sofield made a motion to conditionally approve the preliminary plat for Holly View with the following conditions: 1. The applicant shall satisfy the applicable conditions provided by the Greenville County Subdivision Advisory Committee. 2. The full civil engineering and landscape plans shall meet the standards in the codes and ordinances for the City of Mauldin. Ms. Woolard seconded the motion. The motion to conditionally approve the preliminary plat passed by a vote of 4-0. Docket #: PC-2022-03-TA Request: Text Amendment to the Zoning Ordinance regarding Light Pole Banners Mr. Dyrhaug introduced a proposal to amend the zoning ordinance to allow for the installation of banners on light poles and similar poles. Mr. Paulsen opened the floor for public comments. No public comments were offered. Hearing no comments, Mr. Paulsen closed the floor for public comments. Mr. Dyrhaug provided the staff report and staff findings. The Planning Commission discussed a few questions and aspects of regulating banners on light poles including the types of poles banners could be displayed, what type of activities and events could display banners, how multiple events would coordinate the display of banners, branding on the banners, areas where these banners might be displayed, etc. Mr. Paglialunga made a motion to recommend approval of the text amendment to allow for the installation of the banners on light poles and similar poles. Mr. Sofield seconded the motion. The motion to recommend approval of the text amendment passed by a vote of 4-0. Page 2 of 3 OTHER BUSINESS No other business was discussed. ADJOURNMENT Ms. Woolard moved to adjourn the meeting. Mr. Sofield seconded the motion. The motion to adjourn this meeting passed by unanimous vote, 4-0. The Planning Commission meeting adjourned at 6:42 p.m. Page 3 of 3 ORDINANCE # __________ AN ORDINANCE TO REZONE PROPERTY CONSISTING OF APPROXIMATELY 8.1 ACRES LOCATED AT 711 NORTH MAIN STREET AND 713 NORTH MAIN STREET (TAX MAP PARCELS: #M008.03-01-010.01 AND #M008.03-01-010.10) AND PROVIDING AN EFFECTIVE DATE WHEREAS, Arthur State Bank Trustee of Louise Carrere, Trust A & B, have petitioned the City of Mauldin to rezone +/- 8.1 acres from the C-2, General Commercial, and R-20, Residential District, to the R-M, Multi-family Residential District; and WHEREAS, a rezoning of the parcel is in keeping with the City of Mauldin 2014 Comprehensive Plan Update; and WHEREAS, the site is suitable for the types of uses that could be developed under the new zoning district; and WHEREAS, the potential uses permitted in the new zoning district meet a public need and are not detrimental to the public health, safety, and welfare; and WHEREAS, the Mauldin Planning Commission has given favorable recommendation to the zoning application; and NOW THEREFORE BE IT ORDAINED by the mayor and City Council of the City of Mauldin, South Carolina, in council assembled and by the authority thereof Section 1. That the property described in zoning docket PC-2022-04-RZ and Greenville County Tax Map Parcels M008.03-01-010.01 and M008.03-01-010.10 be rezoned from C-2 and R-20 to R-M, Multi-family Residential. The property is further identified on the attached exhibit that is hereby incorporated into this ordinance, including Exhibit 1, Zoning & Property Map. Section 2. This ordinance shall become effective upon and after its final passage. ORDINANCE # _________ AN ORDINANCE APPROVING A MAJOR CHANGE TO THE CENTERPOINTE PLANNED DEVELOPMENT DISTRICT WHEREAS, in 1997, the City of Mauldin rezoned certain property known as Centerpointe, identified as a 88.43 site area as shown on the Development Plan attached hereto as Exhibit “A,” as a Planned Development District pursuant to a Statement of Intent attached hereto as Exhibit “B”; and WHEREAS, according to the Statement of Intent attached hereto as Exhibit “B”, the Planned Development required Restrictive Covenants for Centerpointe, which were filed with the Greenville County Register of Deeds Office on November 14, 1997 in Deed Book 1727 at Page 246. The original Statement of Intent also called for “high quality buildings including Corporate Headquarters, General Office, Office Distribution, and Multi-Family Residential”; and WHEREAS, to allow for a senior living community, the Property Owner is requesting an amendment to the original Preliminary Development Plan and Statement of Intent that would allow for consideration of non-residential and/or multi-family residential uses for a certain tract of land within Centerpointe identified as a 13.13-acre tract (hereinafter referred to as “Property”); and WHEREAS, the Property Owner submitted an Amended Preliminary Development Plan and Statement of Intent setting forth the change in use for the Property, copies of which are attached hereto and incorporated herein as Exhibit “C”; and WHEREAS, according to Exhibit “C”, the design of the non-residential and/or multi- family residential uses will be consistent with the design guidelines set forth in the original Statement of Intent and the Restrictive Covenants; and WHEREAS, according to the City of Mauldin Zoning Ordinance, Section 5:11.17(B), a change in use to a Planned Development is considered a Major Change; and WHEREAS, pursuant to Section 5:11.17(B) of the Mauldin Zoning Ordinance, major changes to a Planned Development District may be approved by City Council; and WHEREAS, an amendment to the original Statement of Intent to allow for the expansion of non-residential and/or multi-family residential uses on the Property will not be detrimental to the adjacent parcels or the immediate surrounding area. NOW THEREFORE BE IT ORDAINED by the mayor and City Council of the City of Mauldin, South Carolina, in council assembled and by the authority thereof Section 1. That the Preliminary Development Plan and Statement of Intent for the Property be amended to allow for the expansion of non-residential and/or multi-family residential uses according to the requirements of Exhibit “C” attached hereto and the Restrictive Covenants covering the property. Section 2. This ordinance shall become effective upon second reading approval thereof.
