CITY OF MCKEESPORT REGULAR MEETING WEDNESDAY 7:00 P.M. MARCH 6, 2019 This Meeting of Council was called to order on the above-stated date at the above-stated time after the Pledge of Allegiance and Moment of Silence by President of Council Richard Dellapenna. Prayer was led by Major James Jones from the Salvation Army. MAYOR’S REPORT: President Dellapenna asked for the Mayor’s Report. Mayor Cherepko said thank you, Mr. President. Actually, I am going to be very brief tonight. I talked about a lot of things that are going on with the projects. At this time, I am going to ask for a Motion to Appoint three (3) Members to the Housing Authority that have expired terms, William Craig, whose term will expire 12/31/2023, these are 5-year term. Tim Solarczyk, whose term will expire 12/31/2021, and Luethel Nesbit, whose term will expire 12/31/2022. So, if I can [1] have a Motion for approval of those three that will complete our Housing Authority Board all up to date? MOTION: Mr. Barry moved, seconded by Mr. Soles, “to approve the reappointment of William Craig, Tim Solarczyk and Luethel Nesbit to the Housing Authority Board for the specified terms.” RC-3 YEAS: BREWSTER-FILOTEI, BARRY, DELLAPENNA, BROWN, EVANS, SOLES (6) ABSTAIN: NESBIT (1) Solicitor Elash said she is abstaining because she is on the Board of the Housing Authority. NAYS: NONE (0) For the McKeesport Ambulance Authority, for Brian Washowich, Chief B.J. Washowich, our former Chief who has been serving on there his will expire 12/31/2023, Wendy Riazzi whose term will expire 12/31/2022, and Walter Chuchla who will expire 12/31/2021. As I said, these are all individuals who have truly served for quite some time, many of which were on long before I was Mayor. So, we appreciate their volunteerism in taking part in the various Boards that we appoint. I’d be remiss if I didn’t say honestly that one thing as Mayor that you really have the opportunity to see is how many people, not just on Boards, but throughout the community efforts, at events and things, we have so many people that just have so much pride in the City of McKeesport and take their time, their efforts, volunteering to just make events successful. It’s something I most certainly do not take for granted. We have everything, our Rec Board, Keith Soles still chairs, and others that sit on that as well, and everything that they do throughout all of our events, it’s truly greatly appreciated. Not just as Mayor, but [2] as a resident of the City of McKeesport who has enjoyed many of these events for many years long before I ever sat in this chair. So, I do thank each and every one for their efforts. Also, with the pavilions, we are really looking forward this summer, with the new pavilions all renovated and ready, the Summer schedule is filling up very quickly. I can tell you that much. If you want to rent a pavilion, get in touch with Jim Brown down at City hall and get it penciled in because I can tell you they are filling up very quickly. We are also excited, this year as part of the RAD Grant, we received $180,000, which is our largest that we have received from them as a Capital Grant, Capital Fund Project, part of the RAD, we are going to be adding a parking lot which is much-needed and also a new pavilion as well. The new pavilion will be, 30 x 30, will be up towards the Heritage Center, somewhere at that end and that’s where the parking lot is going as well. There’s not nearly enough parking out at Renzie Park. That’s a good problem to have though. That means your park is busy and active and it’s not just utilized by McKeesport residents but other communities as well. We are also looking to see if we can update the trail a little bit, fix part of the trail. We’d like to see a total makeover, probably will be put on our Funding Application, our RAD Application for this year, but we are going to fix it up a little bit. We are also going to complete the Dog Park. It’s over across the street behind Lake Emily by what we call the new ball fields. We are excited with that. In addition to the Dog Park there will be another mile roughly of a walking trail which will connect into our other trail, our existing trail as well. So, we will continue to enhance things at Renzie Park so that not just our McKeesport residents but people throughout the valley can truly enjoy. It’s without question a tremendous asset that we have here in the City. Talk about taking things for granted, there’s not too many communities that have a park like that and we are very appreciative of RAD and the funding they give us to help us maintain it and help us enhance it and improve it. It all goes a long way for keeping the park in the condition it is in. Other than that Mr. President, I told you I’d be brief, I talked a little bit before this, so that concludes my Report. President Dellapenna said thank you Mr. Mayor. [3] CITIZENS IN THE AUDIENCE: When your name is called please come forward and keep in mind you have 3 minutes to speak. State your name, your address and what you would like to discuss. Helen Sigmund, 933 McIntosh Drive. Hello, I live up on McIntosh Drive up in the 12th Ward and I want to make all you people on Council aware of the fact that in last February of 2018 we had a collapse on the road up there and it was really bad. Alright, here we are at 2019, nothing has been done and this slide that went down, took all the dirt and went down, was due to all the rain we had. However, I think if somebody would have come in at that point and time and done something, we could have solidified the hill. Well, it’s now moving up two more houses. It’s in front of two houses and it’s already moved up two more houses. Last Friday, I got a letter from the Post Office that we will have no more mail delivery. We will have to go to the Post Office and pick up our mail up and then last Saturday night, I think it was Saturday or Sunday, a fire truck came up there and it was weird because at 2:30 in the morning it was in front my house and this red light was coming in the window and I got out of bed and looked out and he couldn’t go up the street. Well, later on I talked to Tom Maglicco. I called the Mayor, he was busy, and they had Tom Maglicco call me. So, Tom said that in lieu of the fact that the City fire truck can’t get up there they are going to borrow a smaller fire truck from Rainbow Volunteer Fire Company. I don’t know how that’s going to work. I don’t know whether our fire truck is out there and picks that fire truck up and then comes up to McIntosh or we wait for the volunteers to get there and then bring the truck up and then our paid firemen come up and fight the fire. I have no clue but the thing of this is you put my neighborhood in jeopardy. No mail, no fire, I mean what are we supposed to do, and no one has moved on the fact of, I was told last October we are getting bids, ok. Then, Mr. Cook was told I think the end of November yes, we are going to get bids tomorrow and Mr. Maglicco told me the other day, well we are going to do the bids yesterday and we will see who we are going to get to repair this. President Dellapenna said we are voting on this tonight. Mrs. Sigmund said I hope so, we’ve only been waiting 13 months. Mayor Cherepko said if I may Mr. President. That road collapsed, that we are addressing right now, is not 13 months old to my knowledge. [4] Mrs. Sigmund said yes, it definitely is. It was February of 2018. I am sorry to correct you but that is the truth. Mayor Cherepko said I am sorry to correct you but I take offense to some of the comments. I understand your frustrations. Frustrated, said Mrs. Sigmund. Mayor Cherepko said you need to understand too, first of all, you can call our office and get a direct communication of what is going on. I have been up there several times, I’ve met with neighbors. I was just there last Friday as well, went all the way to the end, and I could tell you no body ever said that we were seeking bids right then and there. First, you had to issue a study. This Council…President Dellapenna said, I think that’s the confusion, the first thing we moved on this Council was to solicit bids to do the geological stud of the land. Mayor Cherepko said yes, that’s correct. So, we had to get an Engineering Company to come in, do a geological study, find out what the issue, find out how serious the issue is, find out how far the issue is, find out you know drilling samples, everything, and then at that point they come in and they make recommendations to us. Mrs. Sigmund said, that’s another thing, that Hubbard Mine is underneath there and the first time it Brewster went and had to get a Grant to get it fixed and they found at that time, and I even told Maglicco, try to see if you can go back and pull the records on that. The one lady who lives on our street used to work for the City, her name is Pellacci, Chris, and I said to her what do you think and she said, yes, they might be able to do that. But, the first time this happened it was caused by the Mine. Mayor Cherepko said well my information is different. Maybe you know more than what I have been told. I hope you are right, because I can tell you mine subsidence to be honest there is probably much more money available to help remedy this situation. So, in that way I am hoping that there’s some truth to that, but our early indications are that it is not a mine issue up there. Mrs. Sigmund said we all have mine subsidence, most of us, but the old Hubbard Mine, it runs all the way down Old 48. [5] Mayor Cherepko said I am aware, but we were told they are 300 feet down. This is why we hire these firms because I am not an authority and I can’t tell you what it is and what it is not. Mrs. Sigmund said well you see the first time it collapsed, it must have collapsed, I don’t know where, but we had water come up and we had rats, huge things, I mean these were like cats and they had people come up and they baited and everything and people shot them up there I will admit but then they filled that all in and this was in the same spot where it is now. Mayor Cherepko said what I can tell you is I wasn’t here then and it’s a situation where I said before you came in, I think you were one of the last ones to come in, this is not just an issue that is unique to McKeesport, and I know you don’t care about anything else as well you shouldn’t and just like I just need to worry about McKeesport, but I think that the issue right now that many, many communities throughout the State of Pennsylvania are facing is with this change in the weather and the runoff and these landslides. There are towns right now that are literally redirecting roads, totally, and the money is not there. I was told that the Governor is currently talking about allocating, I don’t know the number off-hand but it was plenty of money, well I shouldn’t say plenty, but a lot of money, I don’t know if it was a couple hundred million, whatever it was, to put into the Budget just for this particular issue because this is an issue going on all over. What I will tell you is that the issue right now that we are fixing right by your house, ok, when they came and they said these are your different options, you could do to remedy the situation, we said ok, we can’t afford to put a band aide on the situation, fix it the right way, it’s costing us $400,000, and that’s just the. Mrs. Sigmund said no Grant for that? Who writes your Grants here anybody? Mayor Cherepko said yes, we have, the biggest misperception that people have in regard to Grants is everyone thinks there is Grant money available. It’s not like that anymore. It’s just not. From the Federal government to the State government to the County government, on down, the Grants have just been cut over the years. Twenty-five years ago, you could get a Grant for just about anything and I am just saying right now the Grants are few and far between. We have a Senator that not only represents 30 plus communities extremely well but is still here, still lives in McKeesport, and believe me if there is funding available, [6] he helps guide us to where we need to go. Unfortunately, there is just as many out there. Now, we did apply for the Hazard Mitigation Program which is a small pot of funding and we are hoping that we are successful with that but it’s not out there and available like people think. But we are going to put the permanent fix. Right now, you have I believe it’s 122-foot wall that is going to be constructed. It’s going to be all back-filled, and you should have no problem there. Mrs. Sigmund asked is there going to be a guardrail? Mayor Cherepko said yes, either a guard rail or fencing. Mrs. Sigmund said when they fixed my part of the road they put a guardrail in and they had these huge machines come up and beat these pillars down into the ground and put the guardrail up and it held but now it’s starting the dirt on the other side of the guardrail is starting to slide down due to the weather. Mayor Cherepko said no, I believe it will be a fence up on this. I’m not 100% on this right now but I believe it is going to be a fence up. Right now, we are looking further up the road as well. As far as the Fire and Protection, I have my Chief here, that does not mean that we are going to run out Rainbow Firehall and borrow a truck or anything else. All that means is that they will be dispatched immediately from their location straight up to the scene. Am I correct Chief? Correct. Our guys will then head up there as well. It’s no different than, for example, it’s no different than when we had a water volume issue up in Grandview and the Water Authority is currently trying to fix that. Mrs. Sigmund said that’s another thing. I don’t think our hydrants even work anymore. Mayor Cherepko said it’s not the hydrants. The hydrants get inspected every year. It’s not a water pressure issue and that’s another thing people believe. It’s not the pressure from the hydrants. Actually, it’s a gravity fed system our water system. So, when you have high points in the City its not a matter of not having enough pressure to come out there it’s a matter of not having enough water volume and when you have a smaller line you are not getting enough water volume and then when you take it above, up on top of the hill, it’s even worse. So, where I was getting, we got sidetracked but what I am saying is when it comes to, it’s no different then when we have an issue up there and immediately Lincoln [7] Borough is dispatched with a tanker truck, and other Departments as well because we know we may need a hand up there. Mrs. Sigmund said I don’t know how you would get back there because it’s only one way in and one way out. I don’t even know where they’d turn around, that’s the bad part. There’s a paper street down there that could be opened up. Mrs. Sigmund said how would you like to not have availability of your mail service and that? I went down to the Post Office and the man said he will not let a truck come up there and I said you know it’s not very long it’s like 9 houses could you have somebody come up in a car and walk it and put the mail in the mailboxes? Mayor Cherepko said I have to be honest with you and I apologize but I didn’t realize, I was unaware of the mail problem. Mrs. Sigmund said I would like to be able to move our mailboxes all down to the intersection of Marshall Drive and McIntosh but I don’t know who I would even have to get. Mayor Cherepko said is what I will tell you is I really don’t know what they are talking about when it comes to that because I just drove up that street and yes, we have issues and concerns but I can tell you I was never worried about driving. I drove all the way. Mrs. Sigmund said it’s because there are three mailboxes on that side of the road and he has to go up, turn around at our turnaround, put the mail in there and because the slide went, I think it’s because if those people move their mailboxes to the other side. Mayor Cherepko asked so the issue is not going up the road the issue is where the mailboxes are? Mrs. Sigmund said oh yea, this man gave me a definite. Mayor Cherepko said we are going to put a phone call into the Post Office and find out what is going on. Mrs. Sigmund said I gave him different outcomes of this, I said you know we could get a walker mailperson or we could move our mailboxes down to the intersection and he didn’t want to hear anything. [8] Mayor Cherepko said we will figure out what is going on. I can tell you the vast majority of McKeesport they walk. Probably Haler Heights is the only area they really don’t because most of your other neighborhoods don’t have curbside mailboxes. Mrs. Sigmund asked did you get the bids yesterday? Mayor Cherepko and President Dellapenna said we are voting on this tonight. Notice to proceed will be sent out immediately and they are saying the entire project will be completed they are hoping within 60 days, weather cooperating. They are going to start before that but in the meantime, we now have our Engineer who did the first one and he is now looking at the rest of McIntosh as well to see any situations. We will continue, before you came in, we talked about our Public Works will continue to take millings up there. Mrs. Sigmund said consider, though, opening that paper road up at the far end because that would alleviate a lot of problems up there. In other words, if somebody came up there, they wouldn’t have to turn a firetruck around they could just go right down that onto 48. Mayor Cherepko said those are things we can talk about. I don’t, we said up here, worst case scenario, we are coming up with Plans A, B, C and D. I have to wait until I get the information, the factual information because like I said I don’t know, nor do I have the answers, but once we know what is going on, we talked about the possibility of another road but I don’t know if the neighbors would like that. That’s probably nice not having people drive up and down your road. I think you have a privacy end of things but those are things we can talk about. We will have a community meeting when we get to that point and I’ll come up there on the street and I will meet with the neighbors and we will talk about whatever you want to talk about. That’s not an issue but I don’t want to come up there until I have more information but for right now this project is getting done, 122 feet, I am 90% sure there’s a fence on top of the wall, matter of fact I am like 99% sure there’s a fence on top of the wall, but that’s where we are at for now. Mrs. Sigmund said well thank you very much. [9] (Audience members spoke further but were inaudible and did not identify themselves.) Mayor Cherepko said I would be shocked it we can’t get this mail situation handled. I really would. There are not many things I am very confident in and this will be the first time, this is new ground for me, but I have to think we can get your mail delivered. President Dellapenna said thank you. Mr. Benedict come forward if your questions weren’t answered. Eugene Benedict, 708 McIntosh Drive. No, it’s the same issue and I don’t want to beat the rug again, but it is a safety concern for all the citizens that live on McIntosh, particularly at the 900 end. If that road subsides which is almost reaching half way across, how are we going to get the people that live back at 708, the 700 block, out of that area safely. To me there is no paper road, that would be power line that comes up from 48. 48 will be impacted and hopefully no one is harmed in it but I believe it is going to subside and slide into 48. It’s already approaching it now on the curbside of 48 you can see the land coming over. The power lines have went down, they snapped a pole last Friday I believe. I don’t know how long it took them to get it but all the tension in those power lines are pulling the poles on my road where I live. My neighbor, George, he has a problem right in front of his house. The City is aware of it and they have done everything they can within their power and I really do appreciate what they have done so far but it’s getting to the point, and I have pictures that show, its accelerating to a point where two weeks ago it didn’t look the same as it does now. Even a month ago, it has changed drastically and I think time to act is probably maybe I hate to say, too late, but something needs to be done. If the state is impacted with Route 48 then maybe the State can be involved with the solution? Mayor Cherepko said there’s no question. We have communicated with Senator Brewster’s office and Representative Davis. We are working with the State. The unfortunate part about this, I don’t know if you get outside and this is what I was saying you could go and there are people that have roads closed down for years. [10] That’s what we are dealing with. Right now, it’s at a whole other level and as far as doing something immediately we can’t do what we don’t know what we can do. Unfortunately, we have to have them do a study, have them look at it, and which costs money and we are spending money to do it. I’m not an expert but from a common-sense standpoint the issue you have up at your end is strange. It’s not even like it’s a steep hill. You go down a little bit and then it’s kind of level and then you go down. I mean you can walk down the hill without even coming close to falling. I mean its still, just part of the road, part of the driveway, it’s an issue and it’s not an issue that’s 112 feet like we have at the other end, this issue could be 200 yards, am I correct. Mr. Benedict said yes, it could be the whole road, which will greatly impact 48. Mayor Cherepko said we are on it, bear with us. Mr. Benedict said as far as the emergency evacuation is there a plan set? In case something does happen or if and when something happens? Is there something that is going to be in place where you are going to be able to get the people out that need be. Mayor Cherepko said we are always able to get the people out. Our firemen just rescued two lovely ladies. We are going to do, with all terrain vehicles, and it’s not, we will get back there. Mr. Benedict said I would just like to also add the neighbors need to be notified in a timely fashion so that they are not on the hook waiting. I don’t live back there right now. I moved my stuff out because of the condition of the road. Not just in my area but also on the 900 end. So, I don’t feel safe. My wife doesn’t feel safe back there. My grandchildren, well my daughter doesn’t want my grandchildren to come up the house, and that’s pretty said when you can’t. Mayor Cherepko asked you thought you were smelling gas? Mr. Benedict said yes, I had them come up and they said there was nothing. Mayor Cherepko said well you told me that’s why you moved out. Mr. Benedict said well I probably felt that I smelled that aroma and that’s why the fire trucks were up on McIntosh at 2:30 in the morning. [11] Mayor Cherepko said I think when you deal with that the problem is as well you are dealing with who’s problem is it? I mean yea, we have to do what we can to preserve our assets and the street, unfortunately, if it’s someone’s private property that is sliding, they are probably nowhere to be found. We spend $400,000 to save a road and it’s on someone else’s property that we can’t find. Mr. Benedict said right, between 48 and McIntosh who owns the property is there a responsibility that they have? Mayor Cherepko said there is but you can’t find them and if you do find them you can’t get blood out of a rock or it would all be done civilly. In the meantime, we will do what we can to preserve our assets to make sure our residents are safe and so we have to know what that is to do as I told you. I mean we don’t know what it is to do. Mr. Benedict said correct and me, as an owner of my property and my house, I have to take care of maintaining my property and try to solidify my house and make sure that whatever I do is going to leave my house in the same condition as where it is right now. Mayor Cherepko said I know Steve has responded to just about anything you have ever asked for and I told him, when we talk about these things, I said listen, whatever they need. Mr. Benedict said yes and I appreciate that. Mayor Cherepko said and he will continue to do whatever he can on that end until we can see exactly where we are at, what’s the problem, and where we go from there. Mr. Benedict said thank you Council and thank you Mayor. NEW BUSINESS: President Dellapenna asked Secretary James for New Business. RESOLUTION NO. 2019-012 – BILL #13 (INTRODUCED BY MR. EVANS) – A RESOLUTION OF THE CITY OF MCKEESPORT, ALLEGHENY COUNTY, PENNSYLVANIA, AUTHORIZING THE PROPER CITY OFFICIALS TO ENTER INTO A [12] CONTRACT WITH KRAYKEN CHEMICALS FOR WEED & VEGETATION CONTROL FOR A ONE YEAR TERM. MOTION: Mr. Soles moved, seconded by Mrs. Nesbit “to approve Bill #13.” President Dellapenna asked for questions or comments and there were none. Mayor Cherepko said as I said, this Lease will be for two pickup trucks with quad cabs and a 5-ton dump and payments will start, I believe in March 2020, but regardless what month, the same time as we start the payments on our garbage trucks. In addition to keep in mind it’s about $400,000, as we have about $60-70,000 in Engineering costs for the study and Geotech studies and they are now working for us to see what else is going on up there so the clock is ticking. But $316,000 I thought, you are never pleased to spend $316,000 on a project but I think it could have been worse. I really estimated the project to be at least half a million so we are probably $100,000 ahead. Therese were really Grants that these private entities, non- profits in McKeesport our Heritage Center, and down through #19, you will see another one as well and it was just up to us to apply because it’s easier when it runs through the City and the City helps them through the Grant process. The $60,000 would be something that we would utilize and specify for much needed repairs on the 10th Ward Boat Dock for quite a few years now. Half of the dock has pretty much been shot and they’ve been utilizing just one part and backing in on angles and everything else so I thought it was an opportunity as we were applying for the other Grants for those entities I kind of just threw in an extra $60,000 to see if we could get the funding for this project. So, Senator Brewster has been a driving force behind the CITF Grant and I believe we will be successful for the other private entities as well. Solicitor Elash said the only change in this Ordinance is that we are now requiring two Summary convictions before the City can force a landlord to evict a tenant under the Landlord Tenant Ordinance. This was the only provision of our Ordinance that may have infringed upon due process based on how these Ordinances have been treated by the Courts. So, as we embark on that litigation, we wanted to clean up this one part of the Ordinance that might not have passed muster. President Dellapenna said thank you Mr. Elash.
