CITY OF MCKEESPORT REGULAR MEETING WEDNESDAY 7:00 PM FEBRUARY 1, 2023 The regular meeting of Council was called to order on the above-stated date at the above-stated time after the Pledge of Allegiance by President Dellapenna and a Moment of Silence. Prayer was led by Boniface Igba, Spiritual Coordinator, Auberle. The following members of Council were present: RC-1 Present: President Dellapenna Mr. Barry Ms. Nesbit Mr. Soles Mr. Brown Mr. Evans Absent: Ms. Lape APPROVAL OF MINUTES: President Dellapenna asked for a Motion to Approve the Minutes of the regular meeting of January 4, 2023. MOTION: Mr. Barry moved, seconded by Mr. Soles, “to approve the Minutes of the Regular Meeting of January 4, 2023.” RC-2 YEAS: Six (6) NAYS: NONE (0) COMMUNICATIONS: Jennifer Vertullo reported that we received both the Police and Fire reports for the month of January 2023. President Dellapenna said thank you. MAYORS REPORT: Mayor Cherepko reported that he gave a report during the Work Session, and that will be his official report for the evening. CITIZENS IN THE AUDIENCE President Dellapenna called for Citizens in the Audience and said that when you hear your name called please come up to the podium, state your name and address, then proceed on with your concerns. Regis Mellinger, 310 25th Street, spoke on a proposed bicycle lane on Fifth Avenue. Keenon Mikell, 2508 Riverview Street, spoke on proposed partnerships between the McKeesport Police Department and social work professionals and/or community members. TABLED BUSINESS: President Dellapenna asked for a Motion to Remove Bill #4 from the Table. MOTION: Mr. Barry moved, seconded by Mr. Evans, “to remove Bill #4 from the Table.” RC-3 YEAS: Six (6) NAYS: NONE (0) RESOLUTION #2023-003 - Bill #4 – Introduced by Mr. Evans – A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Approving the transfer of restaurant liquor license R-15673 into the City of McKeesport from the Township of Moon. MOTION: Mr. Brown moved, seconded by Mr. Soles “to approve Bill #4.” President Dellapenna asked for questions or comments. Mr. Soles asked Community Development Director Tedesco to speak on the City’s communication with the applicant regarding zoning, planning, etc. Mr. Tedesco said they applied for occupancy and are going through the zoning process. Mr. Soles asked what they next step is. Mr. Tedesco said the next step is zoning approval, which has not occurred yet. Mr. Soles said he visited the company’s establishment in Homestead and said it appears to be a first-class operation but he does not know how Council can vote on this at this time. Mr. Elash said there are time constraints to consider this application. Mayor Cherepko advised Council to vote in the manner that they are comfortable with the information that they have. I understand your concerns, and I share some of your concerns. I agree with Keith. If you didn’t have to vote right now, it would be the best thing,, but you have to vote on it. If you don’t feel comfortable, don’t support it. RC #4 - YEAS: One (1, Mr. Brown) NAYS: Five (5) NEW BUSINESS: RESOLUTION #2023-004 – Bill #5 - Introduced by Mr. Evans - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Authorizing the proper City officers to enter into a contract with Sable Kennel for animal control in the City of McKeesport for the period beginning February 25, 2023 and ending February 25, 2025. MOTION: Mr. Soles moved, seconded by Ms. Nesbit “to approve Bill #5.” President Dellapenna asked for questions or comments and there were none. RC #5 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-005 – Bill #6 – Introduced by Mr. Brown - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Approving and authorizing the proper City Officers to execute any and all documents necessary to engage the services of Building Inspection Underwriters to perform building inspection and enforcement services in the City of McKeesport for a period not to exceed one year. MOTION: Mr. Barry moved, seconded by Mr. Evans “to approve Bill #6.” President Dellapenna asked for questions or comments and there were none. RC #6 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-005 – Bill #7 – Introduced by Mr. Soles - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Authorizing the proper City Officials to enter into an agreement with Enviro 21, LLC. MOTION: Mr. Evans moved, seconded by Mr. Soles “to approve Bill #7.” President Dellapenna asked for questions or comments and there were none. RC #7 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-006 – Bill #8 - Introduced by Ms. Nesbit - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Approving a Reverse Subdivision request from Patty Weber to combine Lot & Blocks 307-R-280 & 307-R- 283. The combined parcel will become 645 Petty Street. The property exists in a R-5 zoning district. MOTION: Mr. Brown moved, seconded by Mr. Barry “to approve Bill #8.” President Dellapenna asked for questions or comments and there were none. RC #8 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-007 – Bill #9 - Introduced by Mr. Soles - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Approving a conditional use request from Mohamed Mustafa to operate an auto repair shop at 2309 Walnut Street, McKeesport, PA 15132, (Lot & Blocks 465-D-89, 465-D90 & 465-D-94). The property exists in a C-3 zoning district. MOTION: Mr. Evans moved, seconded by Ms. Nesbit “to approve Bill #9.” President Dellapenna asked for questions or comments and there were none. RC #9 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-008 – Bill #10 - Introduced by Mr. Evans - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Authorizing the proper City Officials to enter into a contract with The DT Firm. MOTION: Mr. Soles moved, seconded by Mr. Brown “to approve Bill #10.” President Dellapenna asked for questions or comments and there were none. RC #10 - YEAS: Six (6) NAYS: None (0) RESOLUTION #2023-009 – Bill #11 - Introduced by Mr. Barry - A Resolution of the City of McKeesport, Allegheny County, Pennsylvania, Authorizing the proper City Officers to enter into a Memorandum of Understanding with the McKeesport Area School District for the enforcement of 75 Pa. C.S.A. §3345.1 (g), relating to school bus stop caution lights. MOTION: Ms. Nesbit moved, seconded by Mr. Brown “to approve Bill #11.” President Dellapenna asked for questions or comments and there were none. RC #11 - YEAS: Six (6) NAYS: None (0) ORDINANCE #23-002 – Bill #12 - Introduced by Ms. Nesbit - An Ordinance of the City of McKeesport, Allegheny County, Pennsylvania, amending Ordinance #2363, Series 1966, enacted July 1, 1966, as amended, by amending Section VI, “Establishment of Parking Rate” MOTION: Mr. Barry moved, seconded by Mr. Evans “to approve Bill #12.” President Dellapenna asked for questions or comments and there were none.
