Discussion regarding Short Term Rentals Short Term Rental Presentation Short Term Rentals (STRs) City Council Work Session March 25, 2024 Why are we here? • November 27, 2023, staff STR presentation to City Council • Council directed staff to monitor STRs, add a STR “checkbox” to landlord occupational license, and provide quarterly report • February 26, 2024, Council directs staff to place STRs on an upcoming agenda What are we discussing? • Short-term rental – leasing of single-family dwellings, two-family dwellings, or attached dwellings for not more than twenty-eight (28) consecutive days in which the property owner does not occupy the dwelling for the duration of the lease What are the questions/concerns? • Does the city regulate STRs? • How many STRs are in Merriam? • Where are they located? • World Cup June/July 2026 • Code complaints • Too many STRs in one neighborhood • Removes residential dwelling units from the housing inventory • Have a detrimental impact on a neighborhood • Unequal competition to existing hotels • Merriam does receive guest tax from STRs Local regulations Lenexa/Mission/Mission Woods/Overland Park • No specific STR regulations • Rental licensing • OP did implement Nuisance Party ordinance Leawood and Mission Hills • No lease LESS than 30 days • No lease for only a PORTION of a dwelling unit Local regulations Fairway • STR is a lease less than 30 days • Minimum lease of three consecutive nights • On-street parking prohibited • Owner/agent live within 50 miles of property • No STR within 1,000 feet of existing STR • STR restricted to 8 persons or less • Cannot be used for receptions, meetings, parties, or similar • License/Exterior inspection/No signage Local regulations Roeland Park • STR is a lease less than 30 days • Licensed • Property owner certify that STR is their principal residence • Notification sent to property owners within 100 feet • If three or more objections received, application goes to PC Shawnee • STR is a lease less than 30 days • Licensed • Owner/agent live within 100 miles • Limits occupancy to 10 individuals Local regulations Westwood • STR is a lease less than 30 days • Licensed • Send courtesy notice to adjoining property owners • Limits occupancy to 6 individuals • Cannot be used for receptions, meetings, parties, or similar Westwood Hills • Prohibits STRs Local regulations Unified Government • STR is a lease less than 30 days • Special Use Permit • One STR per city block Kansas City, Missouri • STR is a lease less than 30 days • License • No STR within 1,000 feet of existing STR North Kansas City, Missouri • No whole home STR allowed in single family zoning districts How many STRs in Merriam • Currently there are 18 licensed STRs in Merriam; actual number may be higher • Merriam has 3,219 single family dwellings • Approximately 491 single family/duplex/triplex dwelling unit rentals • Less than 0.6% of Merriam single family dwellings are STRs STR Locations Current City STR Regulations • STRs are treated as a residential rental • STR owners are required to obtain a Landlord Occupational License • City does an interior inspection every two years • Regular exterior inspection • Dwelling unit must meet IPMC and City Code • Excessive noise prohibited • City Council can revoke Occupational Licenses (including Landlord) Suggested Additional Regulations • STRs defined as a rental of a single-family, two-family, or attached dwelling for less than 28 days in which the property owner is not present for the duration of the lease • STR license in addition to Landlord Occupational License • Proposed STR license fee - $50 • Cannot be within 1,000 feet of an STR that existed prior to July 1, 2024 STR Locations w/1,000 ft buffer Questions/Discussion
