COUNCIL CHAMBERS MINUTES December 4, 2024 7:00 P.M. I. CALL TO ORDER The Regular Planning Commission meeting for the City of Merriam, Kansas was called to order at 7:00 p.m. by Chairperson Bill Bailey on Wednesday, December 4, 2024 with the Chairperson inviting everyone present to participate in the Pledge of Allegiance to the Flag. New Planning Commissioners Nida Dillon and Daniel Molina were given the Oath of Office and sworn in. II. III. APPROVAL OF MINUTES OF NOVEMBER 6, 2024 Chairperson Bill Bailey stated that the Planning Commission members had received a copy of the November 6, 2024 meeting minutes and asked if there were any corrections or additions. Hearing no additional comments, Chairperson Bill Bailey entertained a motion. SHAWN MCCONNELL MOVED THAT THE MINUTES OF THE PLANNING COMMISSION MEETING OF NOVEMBER 6, 2024 BE APPROVED. SARAH LIMBOCKER SECONDED THE MOTION. THE MOTION WAS UNANIMOUSLY APPROVED. IV. BUSINESS TO BE CONDUCTED 1. Review and consider amendments to Merriam Code, Chapter 74, Article VIII – Accessory Uses as it is related to accessory dwelling units and accessory structures. Chairperson Bill Bailey opened the discussion to Community Development Director Bryan Dyer. Page 1 of 5 Planning Commission Minutes December 4, 2024 Community Development Director Bryan Dyer stated that at the September 23, 2024 City Council meeting the Council requested the Planning Commission to consider allowing accessory dwelling units in single family zoning districts. Mr. Dyer stated that currently Merriam does not allow two residential units to be located on the same single-family zoned lot. Mr. Dyer reviewed the purpose, goals, neighboring cities, definitions, research for Accessory Dwelling Units (ADUs), and draft ordinance. Chairperson Bill Bailey inquired if utility companies would be required to have more than one tap for water and stated that historically tap connections were installed on each single lot and there was a requirement to pay for a separate connection. Mr. Dyer stated that utilities are charging for the taps and are the same cost regardless of the size of the square footing. Commissioner Shawn McConnell inquired if there was a minimum square footage requirement. Mr. Dyer stated the city has adopted the International Property Maintenance Code which establishes minimum square footages for living areas. Utilizing that code, staff estimates the smallest dwelling could be approximately 500 square feet. Mr. Dyer stated that the draft ordinance stated there must be a separate entrance and street address to meet emergency services requirements. Commissioner Shawn McConnell inquired if there was an existing smaller home on a large piece of property if the property owner could build a larger home and have the existing smaller home become the ADU. Mr. Dyer stated that is a viable possibility if the plans meet the setback and building code requirements. Chairperson Bill Bailey inquired if a property owner with a larger lot could lot split and build and ADU. Mr. Dyer stated that the property owner wouldn’t be able to do a lot split because the principal structure and ADU have to be on the same parcel. Chairperson Bill Bailey inquired what staff was going to recommend for the location of ADU entrances. Mr. Dyer stated that what makes the most sense when staff reviews the project and looks at the Johnson County AIMS Mapping system. Chairperson Bill Bailey inquired how the United Stated Postal Service would be notified. Mr. Dyer stated that the city assigns the addresses and updates Johnson County AIMS Mapping system that in turn updated the postal service. Commissioner Sarah Limbocker inquired if the principal structure and ADU would be allowed to have two (2) address points painted on the curb. Mr. Dyer stated they both addresses could be on the curb. Page 2 of 5 Planning Commission Minutes December 4, 2024 Commissioner Sarah Limbocker inquired if the principal structure and ADU would be required to have house numbers posted on the structures. Mr. Dyer stated that city code requires that the house numbers be readily visible. Chairperson Bill Bailey inquired if alpha identifiers would be allowed. Mr. Dyer stated that staff tries to stay away from alpha identifiers and prefers to use numeric identifying addresses. Chairperson Bill Bailey inquired if there were any additional questions from the Planning Commissioners for Mr. Dyer. Hearing none, Chairperson Bill Bailey opened the Public Hearing meeting up for public comment. Billy Croan residing at 6633 Wedd St., Merriam KS 66203 introduced himself to the Planning Commission. Mr. Croan stated that ADU’s empower landowners and residents to achieve the highest and best use for land that they already own and pay taxes every year to keep. Mr. Croan stated that they keep families together and reduce cost of living and reduce cost for residents and he supports ADUs coming before the Planning Commission and before Council at the previous meetings. Mr. Croan stated it will benefit the community to help remove some of the strings attached that are in draft ordinance. Mr. Croan stated he took some notes before the meeting today and has some suggestions for some items that should be stricken and why. Mr. Croan stated letter C (one ADU per lot) is not needed because property owners will probably limit themselves to one ADU so it isn’t necessary for the city to intervene and tell them how many they can have. Mr. Croan stated that letter D (property owner must occupy one of the dwellings) is a mandate that legally may not be enforceable. Mr. Croan stated that letter E (ADU setback requirements) requires a 6-foot setback which is arbitrary and duplicates existing regulations and doesn’t feel that is needed in this specific section. Mr. Croan stated that section H requires separate utility connections is extremely burdensome and expensive if there isn’t already a connection to go to could be $50,000 to $60,000 to do the excavation to do new lines. Mr. Croan stated additionally if utility companies already require different taps, then it is redundant for Merriam to also require it. Mr. Croan stated that section I (ADU design requirements) is subjective and interferes with design prerogatives of the homeowner. Mr. Croan stated that section J is arbitrary limitation on floor space as there are some large lots and an ADU may not even be visible from the street with an existing smaller home up front is problematic and he doesn’t see how that benefits the community. Mr. Croan stated that section K limits the ADU to two (2) bedrooms and is equally arbitrary on the inside of the ADU which is not visible and the impact to a neighborhood is dubious. Page 3 of 5 Planning Commission Minutes December 4, 2024 Mr. Croan stated that letter N (requiring the ADU to meet building code) is a superfluous regulation as it duplicates preexisting city code. Mr. Croan stated we already have existing building codes and acknowledges those codes exist and it doesn’t need to be on this list as less is more. Mr. Croan stated that Commissioner Sean McConnell asked a good question about new buildings behind an old one and turning those into an ADU and if that would be okay. Mr. Croan stated section E states that detached ADUs shall be set back at least 6 ft. behind the existing structure so if the new ADU became in the front position that would not be allowed in the way this is written. Mr. Croan thanked the Planning Commission and stated he thinks that for city code, less is more. Chairperson Bill Bailey inquired if there were any other comments from the public. Hearing none, he closed the Public Hearing. Chairperson Bill Bailey asked if there were any additional questions for staff. Commissioner Shawn McConnell inquired if a larger home were to be build behind a smaller home that would become the ADU that staff has the discretion and/or with the approval of the Board of Zoning Appeals could be dealt with. Mr. Dyer stated that would be a setback issue not a use issue and could be considered by Board of Zoning Appeals. Chairperson Shawn McConnell stated that a resident would have avenues to seek relief from the setback requirement. Mr. Dyer stated that was correct. Chairperson Bill Bailey inquired if the Planning Commissioners had any additional questions or comments for staff. Hearing none he entertained a motion. BIIL BAILEY MOVED THAT THE PLANNING COMMISSION APPROVE THE DRAFT ORDINANCE FOR ADUS, AND FORWARDING IT TO THE CITY COUNCIL. SHAWN MCCONNELL SECONDED THE MOTION. THE MOTION WAS UNANIMOUSLY APPROVED. V. BUSINESS FROM THE FLOOR • There will not be a meeting in January as there were no submittals. • There will be a lane drops on Shawnee Mission Parkway in front of Merriam Grand Station due to utilities being put underground. Construction is scheduled to be completed by July 2025. • Merriam Grand Station is on schedule with construction and the apartments were toured by staff and City Council. • The new Mercedes Benz automobile dealership is coming along. Commissioner Shawn McConnell inquired if there were any conversations regarding the old library. Chairperson Bill Bailey stated that if any development conversation occurs regarding Shawnee Mission Parkway and Antioch Road to encourage staff to bring up an overhead walkway. Mr. Dyer stated staff brings it up during pertinent conversations. Mr. Dyer stated that staff continues to have conversations with the Army Corp of Engineers and they are making progress on the design plans. Commissioner Sarah Limbocker inquired if the city had purchased any additional properties. Mr. Dyer stated not recently. VI. UNFINISHED BUSINESS None VII. OLD BUSINESS None VIII. The subject properties are located at 5206 and 5156 Hayes Street and are part of the South Park plat that dates from 1887. The properties are zoned R-1 (Single-Family Residential) District. This request is for a replat. The southern parcel, 5206 Hayes Street, consists of the vacated Ida Avenue (W. 52nd Street) right-of-way. This parcel was developed with a single-family residence that was constructed in 1931 and demolished in 2012. However, a non-conforming accessory structure remains on the parcel. The parcel does not meet city lot bulk size requirements. 5156 Hayes Street is developed with a single-family residence. This proposed final plat will create two developable lots, Lot 1 and Lot 2, that meet R-1 District bulk requirements. The existing residence at 5156 Hayes Street will be located on Lot 1. Lot 2 will be a developable lot on which a single-family home can be constructed. Comments from Public Utilities As part of the review process, staff provided copies of the proposed plat to the public utilities and city departments. The applicant addressed all comments. Access Access to Lot 1 will be via the existing access point on Hayes Street. Access to Lot 2 will be via Hayes Street. There is one existing access point for Lot 2. However, it is likely that the access point will be moved or modified with the construction of a new residence. Easements/Dedication of Rights of Way The plat dedicates five (5) foot utility easements along the side lot lines and ten (10) foot utility and drainage easements along the front and rear lot lines No right-of-way is being dedicated by this plat. Dyer, Community Development Director RE: Comprehensive Plan Review The Merriam Comprehensive Plan 2040 was adopted in March 2021. The comprehensive plan serves as a guide for the city's growth and development through the year 2040, assisting in decision-making regarding various issues including; land use and zoning, housing, commercial and industrial development, sustainability and the environment. Per state statue 12-747 (d) at least once a year the Planning Commission shall review or reconsider the “Comprehensive Plan.” This document serves as the official review of 2024. Previous reviews were done as part of the adoption process of the various area, corridor, and transportation plans. The Merriam Comprehensive Plans 2040 outlines ten key goals that the city aims to achieve and showcase: Housing Choice and Diversity, Neighborhood Investment, Quality Public Services, Identity and Character, Mixed-Use and Commercial Activity Centers, Sustainable Growth, and Transportation Safety and Mobility. In order to evaluate the city's advancement toward meeting the Comprehensive Plan’s key goals staff reviewed city grants, adopted plans, and development projects. The review assessed how the projects addressed the Plan’s key goals to determine if any updates to the Comprehensive Plan are necessary. Based on our review, staff does not recommend any updates to the Comprehensive Plan at this time. Since the plan’s adoption, the city has undertaken numerous projects that align with the goals of the Merriam Comprehensive Plan 2040. These projects represent significant progress in various areas, including housing, infrastructure improvements, neighborhood revitalization, and sustainability projects, as outlined in the staff summary on the following page. The following projects supported key goals of the 2040 Comprehensive Plan. 1. Housing Choice & Diversity • Between 2021 and 2024 ten (10) final plats were approved creating 16 residential lots • Renewed the Special Use Permit (SUP) for House of Hope group residences • Adopted ordinance allowing and regulating short-term rentals (STRs) • Adopted ordinance allowing and regulating accessory dwelling units (ADUs) 2. Neighborhood Reinvestment • Between 2021 and 2024, the city allocated $1,185,000 for grants aimed at neighborhood reinvestment 3. Quality Public Services • Approved two SUPs for adding and replacing cell tower equipment • Advent Health Cancer Center completed • Merriam Plaza Library completed • Approved three (3) Capital Improvement Program plans 4. Identity & Character • Advent Health Cancer Center completed • Merriam Plaza Library completed • Merriam Grand Station redevelopment of the Kmart property 5.
