PRE-MEETING - TRAINING ROOMS A&B - 4:00 P.M. AGENDA REVIEW STAFF PRESENTATIONS 1 Discuss results from the Public Meeting regarding the preliminary design schematic for Gus Thomasson Road from US Highway 80 to Town East Boulevard. It was Council consensus to proceed with the Gus Thomasson Road design as recommended by staff and confirmed by citizen input. 2 Receive briefing regarding the 2017 Real. Texas. Roads. Program. It was Council consensus to proceed with 2016-17 Real. Texas. Roads in Groups 2A, 2C and 2G as recommended by staff. 3 Receive briefing regarding annual investment activity and proposed changes to the City’s Investment Policy. 4 Receive briefing regarding the Summer Sizzle event. Council agreed to keep Summer Sizzle in June and suggested reducing costs and increasing attendance. 5 Receive briefing regarding the 50/50 sidewalk program. Council agreed to unit costs and to exclude residential rental property from the 50/50 sidewalk program. EXECUTIVE SESSION - EXECUTIVE CONFERENCE ROOM - 5:15 P.M. The City Council met in Executive Session pursuant to Section 551.072 of the Texas Government Code to discuss the purchase, exchange, lease or value of real property (Discuss property exchange within the IH-20 corridor between Mesquite Independent School District and the City of Mesquite); whereupon, the City Council proceeded to meet in the Executive Conference Room. After the closed meeting ended at 6:04 p.m., the City Council reconvened in Open Session. INVOCATION Gabriel Ojih, Senior Pastor, Pathway of Grace Church, Mesquite, Texas. PLEDGE OF ALLEGIANCE Participants from the Children's Church Group, Central Mesquite Assembly of God. SPECIAL ANNOUNCEMENTS (1) Mayor Pickett stated that dedication of the new Mesquite Freedom Park will take place on Sunday, September 11, 2016, which marks the 15th anniversary of the attacks on the twin towers in New York City. The ceremony will take place at 3:00 p.m., on the north lawn of the Mesquite Arts Center, 1527 North Galloway Avenue. The centerpiece of the park, which was made possible by donations from corporate and private funds, is a 15-foot, 575-pound twisted beam recovered from the site of the attacks. Mayor Pickett expressed thanks to all donors and invited citizens to attend this dedication to experience a part of our country’s history. (2) Mr. Noschese commended Mayor Pickett for his dedication in making Mesquite Freedom Park a priority and his efforts in encouraging private donations to make this park a reality. (3) Mr. Aleman stated that Mesquite Independent School District (MISD) football teams will be wearing first responder decals on their helmets this season. He commended MISD for supporting our firefighters and police officers. (4) Mr. Aleman announced that the Mesquite Ministerial Alliance will be distributing wristbands in support of the Mesquite Fire Department and Mesquite Police Department. (5) Mr. Archer stated that a Town Hall Meeting is scheduled for Tuesday, Sept. 13, 2016, at 7:00 p.m. in the Training Rooms at City Hall, 757 North Galloway Avenue, to discuss community policing and invited citizens to attend. (6) Mr. Archer recognized Northridge neighborhood resident Bryan Odom for picking up trash in his neighborhood and creating a Facebook page encouraging citizens to “Adopt A Street.” CITIZENS FORUM (1) Barry Walker, 2813 Bamboo Street, was informed his request to speak before the City Council has been approved and will be placed on the September 19, 2016, City Council agenda to discuss streets. (2) Ed Mottwiler, 2908 Catalina Drive, expressed concerns regarding the current street construction project. (3) Sabrina King, 3339 Jamaica Way, expressed concerns regarding road conditions in various locations. PRESENTATIONS 6 Presentation recognizing City Secretary Sonja Land as the 2016 Yellow Rose Clerk of the Year for the Yellow Rose Chapter of the Texas Municipal Clerks City of Mesquite, Texas Page 2 City Council Minutes - Final September 6, 2016 Association (TMCA) and 2016 TMCA Clerk of the Year nominee. Chapter President Dara Crabtree, City Secretary for the City of Seagoville, and Chapter Historian Jesse Elizondo, Deputy City Secretary for the City of Burleson, recognized City Secretary Sonja Land as the 2016 Yellow Rose Clerk of the Year for the Yellow Rose Chapter of the Texas Municipal Clerks Association (TMCA) and 2016 TMCA Clerk of the Year nominee. 7 Recognize Real. Texas. Service. Employee Champions. Mayor Pickett, City Councilmembers and City Manager Cliff Keheley presented certificates of appreciation to the following employees in honor of their service to the City of Mesquite: District Park Supervisor Todd Clearman, Parks and Recreation Department; Building Inspector Brian Bader, Planning & Development Services; Public Safety Dispatcher II Christy Russell, Police Department; and Kellye Karpinski, Valerie Crosby, Lisa Tomaszewski, Barry Jenkins, Jesse Gutierrez and David Marshall, Health Division team. CONSENT AGENDA Approval of the Consent Agenda Mr. Noschese requested that Item No. 14 be removed from the Consent Agenda to be considered separately. Mr. Archer moved to approve the remaining items on the Consent Agenda, as follows. Approved on the Consent Agenda. 9 An ordinance amending Chapter 14 of the City Code regarding commercial solid waste collection rates, effective October 1, 2016. Approved on the Consent Agenda. Ordinance No. 4437, AN ORDINANCE OF THE CITY OF MESQUITE, TEXAS, AMENDING CHAPTER 14 OF THE CODE OF THE CITY OF MESQUITE, TEXAS, AS AMENDED, BY DELETING THE RATE TABLE (CHART) IN SECTION 14-45 IN ITS ENTIRETY AND ADDING A NEW RATE TABLE (CHART) IN SECTION 14-45 THEREBY AMENDING THE COMMERCIAL SOLID WASTE COLLECTION RATES; PROVIDING FOR A REPEALER CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE THEREOF. Resolution No. 39-2016, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MESQUITE, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE THE RECIPROCAL WATER AND/OR WASTEWATER SERVICE AGREEMENT WITH THE CITY OF DALLAS. (Authorize the City Manager to finalize and execute the necessary documents with CIGNA providing employee/retiree Dental Preferred Provider Organization (DPPO) and Dental Health Maintenance Organization (DHMO) dental plans, effective January 1, 2017.) Approved on the Consent Agenda. 12 Bid No. 2017-003 - Annual Maintenance for Computer Aided Dispatch (CAD), Records Management System (RMS), and Premier Mobile Data Computer (PMDC). (Authorize the City Manager to execute a contract with sole source provider Motorola Solutions Inc., in the amount of $183,000.00.) Approved on the Consent Agenda. 13 Authorize the City Manager to execute an Agreement for Sharing Intelligent Transportation Systems Data with the Texas Department of Transportation (TxDOT) to receive and utilize TxDOT transportation-related information. Approved on the Consent Agenda. 15 Authorize the City Manager to execute a Master Grant Agreement with the Texas Department of Transportation, Public Transportation Division, and subsequent annual Project Grant Agreements allowing the City to receive grant funding for the demand response transportation service. Approved on the Consent Agenda. 16 Confirm the City Manager appointment of Charles Cato as Police Chief for the City of Mesquite, effective March 7, 2016. Approved on the Consent Agenda. 17 Consider amending Rule 3.1 of the City Council Rules of Procedure at the September 19, 2016, City Council meeting by adding a third regular City Council meeting in the month of September of each year to be held on the fourth Monday of each September unless otherwise changed or cancelled, providing the starting time for all regular City Council meetings and providing that all regular City Council meetings that fall on an official City holiday shall be held on the Tuesday following the official City holiday. Approved on the Consent Agenda. CONSENT AGENDA ITEM CONSIDERED SEPARATELY 14 Authorize the City Manager to negotiate, finalize and execute a contract and all other documents necessary to purchase a tract of land along Shannon Road from the Mesquite Independent School District for the future joint development of a school/park site for a purchase price not to exceed $180,000.00. END OF CONSENT AGENDA PUBLIC HEARINGS AND OTHER BUSINESS 18 Conduct a public hearing and consider an ordinance for Zoning Text Amendment No. 2016-02 amending Section 5-101 of the Mesquite Zoning Ordinance by adding procedures for notice of revocation of a certificate of occupancy, the hearing, and appeals. A public hearing was held for Zoning Text Amendment No. 2016-02. Richard Gertson, Director of Planning & Development Services, stated that the proposed ordinance establishes procedures for notification and due process when the City intends to revoke a certificate-of-occupancy. The certificate holder may appeal an adverse decision to the Board of Adjustment. No one appeared regarding the proposed text amendment. Mayor Pickett declared the public hearing closed. Mr. Tarpley moved to approve Ordinance No. 4438, AN ORDINANCE OF THE CITY OF MESQUITE, TEXAS, AMENDING THE MESQUITE ZONING ORDINANCE ADOPTED ON SEPTEMBER 4, 1973, AND RECODIFIED ON NOVEMBER 21, 1988, BY MAKING CERTAIN DELETIONS AND ADDITIONS UNDER SECTION 5-100 THEREBY AMENDING THE PROCEDURES FOR NOTICE OF REVOCATION OF A CERTIFICATE OF OCCUPANCY, THE HEARING AND THE APPEAL; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE THEREOF. Motion was seconded by Mr. Casper and approved unanimously. (Ordinance No. 4438 recorded on page of Ordinance Book No. 107.) 19 Conduct a public hearing to receive input from citizens regarding the proposed fiscal year 2016-17 budget. A public hearing was held to receive input from citizens regarding the proposed fiscal year 2016-17 budget. No one appeared regarding the proposed fiscal year 2016-17 budget. Mayor Pickett declared the public hearing closed. 20 An ordinance providing funds for the fiscal year 2016-17 by adopting and approving the budget for said period and appropriating and setting aside the necessary funds out of the general and other revenues of the City for said fiscal year for the maintenance and operation of various departments and activities of the City, for capital and other improvements of the City and for all City of Mesquite, Texas Page 5 City Council Minutes - Final September 6, 2016 other expenditures included in said budget. Mayor Pickett stated that this is a separate requirement from the tax rate public hearing process and is required by State law. This is the third public hearing with the first two public hearings held on July 18, 2016, and August 1, 2016, with no input received. State law requires the City Council to take action following the public hearing by voting to adopt the budget or voting to postpone to the next City Council meeting. Mr. Casper moved to postpone an ordinance providing funds for the fiscal year 2016-17 by adopting and approving the budget for said period and appropriating and setting aside the necessary funds out of the general and other revenues of the City for said fiscal year for the maintenance and operation of various departments and activities of the City, for capital and other improvements of the City and for all other expenditures included in said budget to the September 19, 2016, City Council meeting. Motion was seconded by Mr. Noschese and approved unanimously. 21 An ordinance ratifying the increase in property tax revenue reflected in the fiscal year 2016-17 budget. Mayor Pickett stated that State law requires a separate vote to ratify any increase in property tax revenue from the current budget. Mr. Casper moved to postpone an ordinance ratifying the increase in property tax revenue reflected in the fiscal year 2016-17 budget to the September 19, 2016, City Council meeting. Motion was seconded by Mr. Aleman and approved unanimously. 22 Conduct a public hearing regarding the proposed 2016-17 ad valorem tax rate of $.687 per $100 valuation. A public hearing was held regarding the proposed 2016-17 ad valorem tax rate of $.687 per $100 valuation. Mayor Pickett stated that there is an increase this year due to the street bond tax. No one appeared regarding the proposed 2016-17 ad valorem tax rate of $.687 per $100 valuation. Mayor Pickett declared the public hearing closed. Mayor Pickett announced that the vote on the tax rate will take place on September 26, 2016, at 6:00 p.m. in the City Council Chamber, 757 North Galloway Avenue, Mesquite, Texas. RECEIPT OF RESIGNATION 23 Receive resignation from Betty Leonardo as a member of the Mesquite Housing Board. Mr. Tarpley moved to accept the resignation of Betty Leonardo as a member of the Mesquite Housing Board. Motion was seconded by Mr. Casper and approved unanimously. 24 Receive resignation from Brad Hanley as a member of the Mesquite Quality of Life Corporation Board of Directors. Motion was seconded by Mr. Porter and approved unanimously. APPOINTMENTS TO BOARDS AND COMMISSIONS 25 Consider appointment of five members to the Animal Control Advisory Committee for terms to expire September 8, 2018. Mr. Tarpley moved to appoint Clark Elerson, Valerie Bradley, Karen McLeod-Ellis, Mark Pirrung, DVM, and Jimmy Stephens as members to the Animal Control Advisory Committee for terms to expire September 8, 2018. Motion was seconded by Mr. Archer and approved unanimously. 26 Consider appointment of six members to the Mesquite Veterans’ Affairs and Memorial Advisory Board for terms to expire September 7, 2018. Mr. Archer moved to appoint Bill Porter, Kenneth Burris, Gene Chennault, Jerry Dittman, Jerry Jochum and Gary Ward as members to the Mesquite Veterans’ Affairs and Memorial Advisory Board for terms to expire September 7, 2018. Motion was seconded by Mr. Aleman and approved unanimously. 27 Consider appointment of one regular member to the Mesquite Housing Board for a term to expire December 3, 2017. Mr. Casper moved to change the appointment of Patrick Patterson from an alternate member of the Mesquite Housing Board to a regular member for a term to expire December 3, 2017.
