City of Mesquite, Texas Minutes - Final City Council Tuesday, December 11, 2018 7:00 PM City Hall | Council Chamber 757 N. Galloway | Mesquite, Texas Present: Mayor Stan Pickett and Councilmembers Dan Aleman, Tandy Boroughs, Robert Miklos, Bruce Archer and Greg Noschese, City Manager Cliff Keheley and City Secretary Sonja Land. Absent: Councilmember Jeff Casper. SPECIAL CITY COUNCIL MEETING - CITY COUNCIL CHAMBER - 7:00 P.M. CALL TO ORDER PUBLIC HEARING 1 Conduct a public hearing and consider, on first reading, an ordinance imposing a moratorium on applications and plans for development, permits, plats, verifications, rezoning, site plans and new or revised certificates of occupancy for multifamily residential development within the corporate city limits of Mesquite, adopting written findings justifying the moratorium, providing for waivers and limited exceptions to the moratorium, and establishing an expiration date. A public hearing was held to consider imposing a moratorium on applications and plans for development, permits, plats, verifications, rezoning, site plans and new or revised certificates of occupancy for multifamily residential development within the corporate city limits of Mesquite, adopting written findings justifying the moratorium, providing for waivers and limited exceptions to the moratorium, and establishing an expiration date. Jeff Armstrong, Director of Planning and Development Services, reviewed the calendar for the proposed moratorium which includes the following key dates: December 6, 2018, published notice in the newspaper; December 10, 2018, the Planning and Zoning Commission held a public hearing; December 11, 2018, first reading and public hearing held by the City Council; December 13, 2018, the temporary moratorium will go into effect; December 17, 2018, second reading and public hearing held by the City Council and if approved, the moratorium will go into effect; and April 16, 2019, the moratorium expires unless extended by the City Council. Staff will research existing multifamily zoning regulations including open space requirements and density regulations, traffic management regulations, other city’s regulations and any legal parameters and will prepare options for the Planning and Zoning Commission as well as the City Council to discuss. Staff will then prepare a draft ordinance for consideration. The time schedule to approve an ordinance adopting new guidelines for multifamily residential development includes the following dates: December 17, 2018, staff to brief the City Council with possible options; January 14, 2019, staff to City of Mesquite, Texas Page 1 City Council Minutes - Final December 11, 2018 brief the Planning and Zoning Commission and receive feedback; January 28, 2019, the Planning and Zoning Commission to consider the proposed ordinance; and February 18, 2019, the City Council to consider the proposed ordinance. No one appeared regarding the proposed moratorium. Mr. Archer moved to approve AN ORDINANCE, ON FIRST READING, OF THE CITY OF MESQUITE, TEXAS, IMPOSING A MORATORIUM ON APPLICATIONS AND PLANS FOR DEVELOPMENT, PERMITS, PLATS, VERIFICATIONS, REZONINGS, SITE PLANS AND NEW OR REVISED CERTIFICATES OF OCCUPANCY FOR MULTIFAMILY DEVELOPMENTS WITHIN THE CORPORATE CITY LIMITS OF MESQUITE; ADOPTING WRITTEN FINDINGS JUSTIFYING THE MORATORIUM; PROVIDING FOR WAIVERS AND LIMITED EXCEPTIONS TO THE MORATORIUM; AND ESTABLISHING AN EXPIRATION DATE. Motion was seconded by Mr. Miklos and approved unanimously. ADJOURNMENT Mr. Noschese moved to adjourn the meeting. Motion was seconded by Mr. Aleman and approved unanimously.
