METHUEN CITY COUNCIL REGULAR MEETING MONDAY, SEPTEMBER 19, 2022 @ 7:00 P.M. GREAT HALL, SEARLES BUILDING Chair Beauregard called the regular meeting to order at 7:00 p.m. Members present: Councilor Saba, Councilor Saffie, Councilor Finocchiaro, Councilor McCarty, Councilor Zeigler, Councilor Simard, Councilor Faretra, and Chairman Beauregard. Councilor DiZoglio was absent. Acceptance of Agenda MOTION BY: Councilor Simard, seconded by Councilor Saffie to accept the agenda. Councilor Finocchiaro noted there were a couple items that didn’t get put forward. Some of them needed special hearings. Others might not have. One was for the municipal training resolution. One was for the retirement board reinstatements and one was for the maximum age. Chair Beauregard said in speaking with the Solicitor and Chief, Council could schedule public hearings prior to the October 3rd meeting and then address those items as a second read. It would be well within the time period we need to make sure those are submitted. Council had a public hearing earlier regarding some public safety issues relative to stop signs. He was thinking of getting the public safety issues that needed to be addressed out of the way. That will clear the way to have a less busy evening on the third in the way of public hearings. Councilor Finocchiaro said just because Council didn’t discuss two of those items the first time, would be that she wouldn’t want Council to have the public hearing right before the next meeting and then vote right after because there wouldn’t be time for people to have heard about it because Council didn’t have any discussion the last time. Municipal training doesn’t apply because Council already discussed that. UPON VOTE: 8 yes, 1 absent (Clr. UPON VOTE: 8 yes, 1 absent (Clr. DiZoglio) Public Participation Linda Soucy, 10 Kirk Street, spoke regarding cannabis. She referred to the ballot question in November of 2016. Then on November 2nd of 2021, TR-21-50 was on the ballot. She read the last paragraph “the Methuen City Council believes that the voters in the City of Methuen should consider with respect to the city’s municipal election in November 2021 a binding ballot on whether to allow cultivation, transportation, purchase and sale of cannabis”. She doesn’t understand. These are the words that were drafted by the City Council, “a binding ballot”. The voters voted on this binding ballot question and they said “no”. She stated she has attended too many meetings on the same issue over and over again. This should be voted down tonight as the voters have already said “no”. Nine people should not be making the decision for a body of people that live in Methuen when they have already voted and gone to the polls and said “no”. She read off how many meetings she has been to on the same issue over and over again August 3, 2017, joint public hearing, September 22, 2017 moratorium, March 4, 2019 created a cannabis policy working group, March 20th, March 25th, November 14th, 2019 established cannabis commission, PPT 101409, November 6th 2020 brought it to the Community Development Board, March 17th 2020 Council voted no, October 20th 2020, October 15th 2020 (TR-20-69), October 30th, 2020, another public hearing, January 28th Health Department, March 30th 2021, April 14th 2021, April 29th 2021, May 18th 2021, June 22, 2021, September 15th 2021, November 2nd, 2021 the voters said “no”. She doesn’t get and is sick of tired of coming and addressing this issue over and over again. It’s a “no”. She doesn’t know how nine people can change what the voters want. The voters said “no”. She also spoke in support of the CDBG funding. The $40,000 funding does a lot for the neighborhood. The see over 250 children over an average year. She gave the Mayor information about the Epilepsy Foundation who will pickup small appliances, clothing, pocketbooks, shoes, etc. she hoped it could be posted to the website for anybody who has these items to get rid of at no cost. METHUEN CITY COUNCIL REGULAR MEETING MONDAY, SEPTEMBER 19, 2022 @ 7:00 P.M. GREAT HALL, SEARLES BUILDING Bill Hannefant, 6 West Ayer Street, said the cannabis issue was covered quite well. The voters in this community voted on that issue, twice they voted it down. Less than a year later Council brings it back up again. To bring it so quickly it is a slap in the face to people that voted already for it. “If you’re listening to the people of Methuen, why are you sitting there? He can’t think of any other way of saying it. It is blatant arrogance to bring this back up so quickly.” Mayor’s Report Mayor Perry announced and invited Council to the ribbon cutting ceremony on Tuesday at 10:00 a.m. at the Methuen Nail Salon at the Loop. Mayor Perry recognized Kelly Townsend and Yasmin Nunez as employees of the month for their service to the city and homelessness, in particular with significant amounts of seniors that were evicted from housing. These individuals have gone above and beyond. He gets a tremendous amount of feedback from the seniors at the Senior Center and department heads who applaud the efforts of these two individuals. The city appreciates all of these efforts. Councilor Faretra asked for an update on the trash barrels. Mayor Perry reported they a little more than half-way through the city and will finish by Sunday this week. There are a couple of areas where individual houses were missed. The city is handling that. The other issue is there are packets with the trash carts. Individuals get two carts: the 64-gallon trash and 95-gallon recycling and then there is a packet that has two overflow bags, a lot of information on recycling and trash information shared. They started delivering carts in the west and they’ve been in the central. They are about to move out of the central after tomorrow. Then they will go to the east. There are multiple crews working on it. It is a third party, not DPW workers or E.L. Harvey. It is contracted to the third party through the work with the recycling company. The packets go with the carts when they are delivered. Jordan has approximately 100 requests to swap carts. They will be acting on that shortly. The 35-gallon carts are just coming in. There are specific requests from seniors largely on specific situations that the city is working on with them. The intent is to do this as well as possible. Cart delivery should be completed by Sunday. In response to Councilor Faretra’s question, the Mayor said they have not turned on the link for the additional barrel. He applauded the efforts of Director Bower and Luis Santiago. He explained there are multiple places to get the additional bags. The process is fairly straightforward, but at least four clicks. He asked Luis Santiago, CIO, to make a video script that guides the residents how to do this. By next week the city will open that up so there is time for people to do swaps in between now and the October 3rd start to use the new carts. Councilor Faretra asked if the old barrels could be dropped off at the transfer station. Mayor Perry explained residents can keep old barrels to use for lawn or leaf waste and the city will set a date to go out and pick up the barrels or old trash carts. Some will be donated to contractors. The rest will be destroyed. Councilor Simard spoke of the grand opening of the nail salon Tuesday at 10:00 a.m. (Methuen residents). He asked: “If a resident has a 64-gal trash bin, they can not get a bigger trash bin, only an additional one?” METHUEN CITY COUNCIL REGULAR MEETING MONDAY, SEPTEMBER 19, 2022 @ 7:00 P.M. GREAT HALL, SEARLES BUILDING Mayor Perry explained there are only 95-gal recycling bins. Councilor Simard noted they could change it for the smaller one if they want to. Mayor Perry responded, yes. He noted the carts are serialized. The serial number is attached to an address. Residents can put their name and address on them to personalize them. The city encourages the swaps and are trying to encourage the recycling. Getting people to compost food waste would shrink down the trash which would probably happen in the spring. Councilor Saba asked if the swap is trash and recycling. Mayor Perry responded yes. The additional trash cart is $100. Mayor Perry explained the $100 is not for the cart it is the weight of the trash that goes in it over the course of the year. If a resident has a landfill permit there would be a charge for the weight an individual is dumping unless you are a senior citizen. Mayor Perry reported there is a TEC contract on the agenda that deals with traffic management to upgrade crossings in the city. Councilor Finocchiaro questioned the diversity update. Mayor Perry said the city interviews a diversity candidate for every position. He further explained the city received a $100,000 grant to upgrade all of our job description and prioritize what we are doing. Councilor Finocchiaro requested an electronic copy. The Mayor agreed. Mayor Perry reported, as the bids come in, there is a surplus on ARPA and there is a half of million dollars on the table for Forest Lake. The infrastructure has been ignored for a long time. With extreme temperatures (hot/cold) causes water main breaks. The Mayor explained there is a contract for an individual to go through all the windows. He plans to buy a window in memory of his mother. His office was her home room. Councilor Zeigler asked for a school update. Mayor Perry said it has been difficult getting into schools. There is a plan to address traffic issues. Councilor McCarty suggested that the Mayor refrain from going forward with the deputy chief. The city needs to focus on the lower ranks Other Committee Reports Councilor Zeigler reported that the Economic Development Committee met last Tuesday. She noted their monthly meetings would be on a Tuesday. Councilor Finocchiaro reported on the Substance and Mental Health committee as well as the Veterans Committee meeting targeting early October. Councilor Saba said this is rather vague. If there is a requirement for certification or license is the person going to take certification classes during work hours or after hours. Maggie Duprey indicated this doesn’t have a financial impact but could have a financial impact in the future. Councilor Saba asked what the ultimate goal is for an employee to get certified in order to wear a camera. Councilor Faretra said it would pertain to a department, not individual. If there are roles that require it, for instance training in mixing chemicals, a higher qualified employee. Councilor Saba asked if the employee would get more money. METHUEN CITY COUNCIL REGULAR MEETING MONDAY, SEPTEMBER 19, 2022 @ 7:00 P.M. GREAT HALL, SEARLES BUILDING Maggie Duprey responded it could be, but it is unknown at this time. Councilor Saba reiterated it is too vague. Councilor McCarty disagreed and said it is too broad. We do not know what we are signing up for. There is not a lot of guidance. He would like to see special accreditation in the city and develop a plan over two years. Councilor Zeigler noted the financial impact would go to the Mayor or CAFO. Councilors are part-time leaders. This gives flexibility which accreditation is going to do for their department and field and allows them to go in this direction. “How we can prepare employees to be more well-rounded?” She supports this. Councilor Simard noted this relies on Human Resources and he does not support it. MOTION BY: Councilor Finocchiaro, seconded by Councilor Faretra to change the word “requiring” to “supporting”. Councilor Faretra noted employees in their roles should be as best as possible. there is a financial savings with workmen’s comp by them not getting hurt on the job. It is an investment the city is willing to make so people answering a call are certified to handle it. Mayor Perry expressed concern with accreditation and certification. Every job should have requirements from laborer to director. That is the essence of what we are. For years we have not had a robust HR department. DPW will take three months to finish. We need to be careful what we are doing, what it takes for every job to satisfy criteria. There is not enough detail in DPW audit, job by job what they need to have. We are not overstaffed. Under this ordinance, a “year” is the 365-day period that follows the disposal of the first free bulk item. By way of illustration, if a qualifying resident disposes of a free bulk item on December 1, 2022, that resident is entitled to dispose of up to three (3) additional bulk items, free of charge, up until December 1, 2023. Beginning on December 2, 2023, that resident can dispose of up to four (4) bulk items, free of charge, up until December 1, 2024. In response to Councilors’ questions, Mr. Bower explained the pickup schedule would be similar to last year, beginning the end of October and continue until it snows. The city could buy but the vendor cannot sell until after six months of leasing the packer to the city. There was a discussion on purchase, the dollar amount ($7700/month), and when the contract would begin. Maggie Duprey said the funding would be from tipping fees for leaf pickup, all within solid waste budget and it can be done. UPON VOTE: UNANIMOUS yes. Executive Session Chair Beauregard read: “The Methuen City Council will vote to enter into Executive Session with the Mayor, Methuen’s Chief Administrative and Financial Officer, Methuen’s Chief Information Officer, and legal counsel for the City of Methuen, in accordance with Exemption 4 (Massachusetts General Laws Chapter 30A, Section 21(a)(4)), in order to discuss the deployment of security personnel or devices, or strategies with respect thereto; and in particular, to review and approve two contracts, one in the amount of $61,500 (C-23-25) and the other in the amount of $140,045 (C-23-27), for the provision of cybersecurity services to the City of Methuen – public discussion of which may be reasonably likely to harm the security of the City’s information systems. METHUEN CITY COUNCIL REGULAR MEETING MONDAY, SEPTEMBER 19, 2022 @ 7:00 P.M.
