Methuen City Council – Special Meeting Wednesday, November 2, 2022 – 6:00 pm Great Hall, Searles Building 1. Roll Call 2. Acceptance of the Agenda 3. EXECUTIVE SESSION: The Methuen City Council will vote to enter into executive session with the Mayor, the Chief Administrative and Financial Officer, and legal counsel for the City of Methuen, under Exemption 3 of the Open Meeting Law (Massachusetts General Laws Chapter 30A, Section 21(a)(3)), to discuss strategy with respect to Methuen’s pending litigation, where an open meeting may have a detrimental effect on the litigating position of the public body and the Chair so declares, and the pending litigation to be considered in the executive session is as follows: • Sean Fountain v. City of Methuen, et al., U.S. District Court, District of Massachusetts Civil Action No.: 1-21-cv- 11046; • Bryan Gamby, v. City of Methuen, U.S. District Court, District of Massachusetts Civil Action No. 1:22-CV_11058-WGY; • Krystal DePardo v. City of Methuen, U.S. District Court, District of Massachusetts, Civil Action No. 1:21-CV-10603-FDS; • Maryann Munoz v. 40-44 Forest Street, LLC et al. U.S. District Court, District of Massachusetts, Civil Action No. 1:22-CV-11079-GAO; • Felix Gomez v. City of Methuen, U.S. Bankruptcy Court, District of Massachusetts, Case No. 20-40721-CJP; • City of Methuen v. AmerisourceBergen Drug Corporation, et al, No. 1:18-cv-10035 (Northern District of Ohio); • City of Methuen v. The 3M Company f/k/a Minnesota Mining and Manufacturing Co., et al., U.S. District Court, District of South Carolina; Civil Action No. 2:22-cv-02777-RMG (District of South Carolina); • Gallant v. Methuen, Essex Superior Court Civil Action No. 2277CV01013; • Tracy Blanchette v. City of Methuen, Essex Superior Court Civil Action No. 2077CV01109C; • Jose Santiago v. City of Methuen et al., Essex Superior Court Civil Action No. 2277CV00441A; • Sterling Ventures, LLC v. Methuen Community Development Board, Essex Superior Court Civil Action No. 2177CV00995; • Colchester Properties, LLC v. Joseph Leone, et al., MA Land Court: Case No.: 16 MISC 00461; • Gregory Gallant v. City of Methuen; Division of Administrative Law Appeals No. CS022-388 (D1-22-084); and • Additional cases docketed at the Department of Unemployment Assistance, the Department of Labor Relations, and the Massachusetts Commission Against Discrimination that, in the City’s view, preclude public announcement of parties. Following the conclusion of the Executive Session, the City Council will adjourn and not reconvene in open session. There will be no public participation in either the open session or executive session. David P.
