Article II, Section 2-60 of the City of Miami Gardens Code entitled "Public Participation" provides that any person making personal, irrelevant, impertinent, or slanderous remarks or who becomes boisterous while addressing the City Council shall not be considered orderly or observing decorum. If any person becomes too lengthy, abusive, obscene, and/or disruptive or otherwise fails to comply with decorum rules, the presiding officer may: - Issue a warning and provide an opportunity for the individual to conclude remarks in a decorous manner and within the designated time limit. - Interrupt and terminate the individual from concluding their remarks. - Bar the individual from further appearance before the City Council, unless or until permission to continue or again address the City Council is granted by a majority vote of the City Council. Order shall be maintained. If any person refuses to obey the orders of the presiding officer and is declared out of order, the individual may be subject to removal by the Sergeant-At-Arms. Article VII of the City of Miami Gardens Code entitled, "Lobbyist" requires all lobbyists before engaging in any lobbying activities to register with the City Clerk and submit an annual registration fee of $250.00. This applies to all persons, firms, entities, or corporations that are employed, designated, or retained by a principal, with or without compensation, or that contract with a third-party for economic consideration to perform lobbying activities on behalf of a Page 1 of 21 principal. It includes the principal that lobbies, as well as any employee that has been designated by the principal to perform lobbying activities on behalf of the principal. The percent increase of this millage rate over the roll-back rate is 14.60%. Section 4. ADOPTION OF VOTED MILLAGE RATE: The City Council hereby adopts and establishes the Voted Millage Rate for the City of Miami Gardens for FY 2023-2024 at 0.5284 mill, which is $0.5284 per $1,000 of taxable value within the City of Miami Gardens, Florida. Section 5. The City’s aggregate millage rate is 7.4647 (a combined total Millage of 6.9363 Mills for operating and 0.5284 Mills for debt service). Section 6. EXPENDITURE OF FUNDS: The City Manager is authorized to expend or contract for expenditures, pursuant to the Charter of the City of Miami Gardens and adopted Code of Ordinances, in accordance with the adopted Fiscal Year 2023-2024 budget and budget detail, which is attached hereto and made a part of this ordinance as if it were set forth here in full. The City Manager is hereby authorized to allocate City resources as deemed necessary. SECTION 4. AUTHORIZATION TO THE CITY MANAGER: The City Manager is hereby authorized and empowered to make budgetary transfers, limited to line item allocations within a single fund, including apportioning budgets within funds to line items in the Chart of Accounts for the City. Said authority shall include the authority to correct inter-fund transfers and accounting allocations. SECTION 5. AUTHORIZATION TO THE CITY MANAGER: The City Manager is hereby authorized and empowered to amend the budget on an as-needed basis in Page 16 of 21 Agenda Item #5.1 order to correct typographical errors or omissions that are purely scriveners’ errors. SECTION 6. AUTHORIZATION TO THE CITY MANAGER: The City Manager is hereby authorized to appropriate unanticipated revenues as deemed necessary including but not limited to accepting grant or donation of funds or upon issuance of a bond or other municipal debt instrument and re-appropriated “assigned fund balance” for Parks & Recreation operating purpose for completed projects funded from the General Obligation Bond. SECTION 7. AUTHORIZATION TO THE CITY MANAGER: The City Manager is hereby authorized to carry out all requirements associated with Special Events that are specifically listed by name in the attached Budget with a specific line item. The City Manager does not need additional authority from the City Council for the special event, unless the special event requires the City Manager to exceed his purchasing authority as outlined in the Code of Ordinances. SECTION 8. AUTHORIZATION: Authorizing that Charter employees be paid 50% of their earned PTO overages. Page 17 of 21 Agenda Item #5.1 SECTION 9. CARRYOVER OF FUNDS: The budget shall also automatically re-appropriate any encumbrances and outstanding contracts carried forward from fiscal year 2022-23. SECTION 10. REVENUE MANUAL: All fees shall be set as outlined in the FY 2023-2024 Revenue Manual and any amendments are included in the FY 2023- 2024 Annual Operating Budget Document. This manual may be amended from time to time during the fiscal year by City Council by resolution. SECTION 11. FINANCIAL POLICIES: All policies included under “Financial Policies” in the FY 2023-2024 Annual Operating Budget Document is adopted and approved by Council. The policies may be amended from time to time during the fiscal year by City Council by resolution. SECTION 12. INTERFUND TRANSFERS: The City Manager is authorized to effectuate all interfund transfers anticipated by this budget to include line items classified as ‘Transfers to,’ and ‘Transfers from’ regardless of fund. SECTION 13. INSTRUCTIONS TO THE CITY MANAGER: The City Manager is authorized to take all Page 18 of 21 Agenda Item #5.1 actions necessary to implement the terms and conditions of this Ordinance. SECTION 14. CONFLICT: All ordinances or Code provisions in conflict herewith are hereby repealed. SECTION 15. SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance.
