SPECIAL MEETING – April , The Board of Public Works and Safety of the City of Michigan City, Indiana, met in SPECIAL SESSION on Monday morning, April 22, 2019, at the hour of 8:30 a.m., in the Council Chambers, in the City Hall Building, located at 100 East Michigan Boulevard, Michigan City Indiana – a regular meeting room of this Board. The meeting was called to order by President Steve Janus, who presided. Noted present: Steve Janus, Virginia Keating and Rich Murphy (3) Absent: None (0) A QUORUM WAS NOTED PRESENT. Also noted in attendance: Amber Lapaich, Corporate Counsel Royce Williams, Chief of Services, M.C.P.D. Chief, Mark Swistek, M.C.P.D. Julie Holbrook, Michigan City Animal Control Natalie Howe, Michigan City Animal Control Kalon Kubik, Mayor’s Administrator Gale Neulieb, City Clerk Dawn Debald, Assistant Deputy City Clerk AWARDING OF BID- One ( ) Tandem Axle Dump Truck with trade-in of one ( ) vehicle Corporate Counsel, Amber Lapaich addressed the Board stating M & K Truck Centers was the only bidder in the amount of $220,311.00; advising Robert Zondor, Superintendent, of Central Maintenance and herself reviewed all the bid documents; recommending approval. Virginia Keating made the motion to award the bid for the one (1) tandem axle dump truck with trade-in of one (1) vehicle to M & K Truck Centers in the sum of $220,311.00. The motion was seconded by Vice-President Murphy and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (:). NAYS: None ( ). Motion Carries. MICHIGAN CITY FARMER’S MARKET AGREEMENT (S)- Abigale Thayer Kuchta, Events Coordinator, requesting approval of Farmer’s Market Agreement (s) Corporate Counsel, Amber Lapaich addressed the Board stating Abigale Thayer Kuchta has two (2) additional vendors requesting approval to be in the Farmer’s Market; advising she has reviewed the agreements, applications and the Insurance; explaining both vendors are good to go; recommending approval. Vice-President Murphy made the motion to approve the Farmer’s Market agreements between the City and vendors; Mike Steinheiser and Sticky Spoons Jam, LLC. The motion was seconded by Virginia Keating and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (:). NAYS: None ( ). Motion Carries. April 22, 2019 Page 2 CONTINUATION OF DOG APPEAL- Julie Beadle, > Douglas Avenue, is requesting an Appeal of the decision of the animal control officer that deemed her animal dangerous Royce Williams, Chief of Services, M.C.P.D. addressed the Board stating at the last meeting he brought still pictures of the incident; advising he was asked why he didn’t play the video; explaining he brought the (evidence) video today to show the Board if they would like to see it. Virginia Keating made the motion to show the video. The motion was seconded by Vice- President Murphy and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (:). NAYS: None ( ). Motion Carries. Julie Holbrook, Animal Control Officer addressed the Board and explained portions of the video. Theola Wright, 1324 W. 8th Street addressed the Board explaining her side of the situation. Julie Beadle, 411 Douglas Avenue addressed the Board commenting on the matter. Wendell McCollum, son of Theola Wright, 1500 W. 82nd Place, Merrillville, Indiana addressed the board with his views and concerns on the matter. Virginia Keating made the motion to affirm the findings by Animal Control; advising this dog is a dangerous dog and presents a substantial threat to people, property and pets; stating under the City Ordinance, Animal Control is authorized to euthanize this dog. The motion was seconded by Vice-President Murphy and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (:). NAYS: None ( ). Motion Carries. ADJOURNMENT President Janus stated as there were no other items on the agenda to be considered by the Board at this time, declared the meeting ADJOURNED (approximately 9:19 a.m.). President Janus made the motion to adjourn. The motion was seconded by Virginia Keating and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (:). NAYS: ( ).
