SPECIAL MEETING – November 10, 2016 The Board of Public Works and Safety of the City of Michigan City, Indiana, met in SPECIAL SESSION on Thursday morning, November 10, 2016 at the hour of 4:00 p.m., in the Council Chambers, in the City Hall Building, located at 100 East Michigan Boulevard, Michigan City Indiana – a regular meeting room of this Board. The meeting was called to order by President Steve Janus, who presided. Noted present: Steve Janus, Michael Palmer and Virginia Keating (3). A QUORUM WAS NOTED PRESENT. Also noted in attendance: Amber Lapaich, City Attorney Shelley Dunleavy, Personnel Director Shong Smith, Union President Eric Walker, Street Department Jennifer Clouse, City Clerk Secretary President Janus stated the only items on the Agenda are the Resolution of Pending Grievances. President Janus advised the first grievance, which was rendered on August 29, 2016 for a two (2) day suspension of an individual. Vice-President Palmer stated for Grievance No. 1 he makes a motion that the Board rescind the two (2) day suspension for the named employee, and entitle that employee to be paid for those two (2) days off. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. President Janus stated the next item of business is Grievance No. 2, which was rendered a verbal warning on September 23, 2016. Vice-President Palmer stated he would make a motion for Grievance No. 2 that the Board rescind the verbal warning issued to the employee. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. President Janus stated the third grievance has three (3) individuals concerned; naming them as 3-A, 3-B and 3-C; further stating on individual 3-A, a suspension was given on September 26, 2016. Vice-President Palmer asked Corporate Counsel Lapaich about doing these individually. Corporate Counsel Lapaich stated “yes”. Vice-President Palmer stated as far as Grievance No. 3-A, he makes a motion that the written warning stays. Regular Meeting – November 10, 2016 Page 2 Discussion ensued between President Janus and Vice-President Palmer regarding the order of the three (3) grievances; with the first one being a suspension. Vice-President Palmer stated he is naming 3-A, the first letter of the employee is “J”; further explaining 3-A is the grievance number and the employee’s first initial is “J”; making the motion the written warning stays as presented. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. Vice-President Palmer stated for 3-B, the employee starts with the letter “E”; making the motion for 3-B, which received a verbal warning, to be rescinded. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. President Janus stated 3-C, which was granted on September 26, 2016, and the first letter is “S”, which was a suspension. Vice-President Palmer stated on Grievance No. 3-C for the suspension; making the motion that the suspension stays as presented. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. President Palmer stated the next grievance is Grievance No. 4, is one individual and corrective action was granted on September 29, 2016, and was a five (5) day suspension. Vice-President Palmer stated he would make a motion on Grievance No. 4, the five (5) day suspension, be rescinded but put as a written warning, and the employee is entitled to receive the pay for the five (5) days. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. President Janus stated the fifth corrective action, which was rendered on October 28, 2016 and amounted to a five (5) day suspension and termination. Vice-President Palmer stated he would break this up into two (2), because it was two (2) on one form; asking Corporate Counsel Lapaich if this should be done as one (1). Corporate Counsel Lapaich explained it was a five (5) day suspension pending termination. Vice-President Palmer stated on Grievance No. 5 he makes the motion that the five (5) day suspension stands, but the termination is rescinded. The motion was seconded by Virginia Keating and carries as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: None (0). Motion Carries. Regular Meeting – November 10, 2016 Page 3 ADJOURNMENT President Janus inquired whether there was anything else to be considered by the Board at this time and, there being none, declared the meeting ADJOURNED (approximately 4:08 pm). Virginia Keating made the motion to adjourn. The motion was seconded by Vice- President Palmer and carried as follows: AYES: MEMBERS Janus, Palmer and Keating (3). NAYS: (0).
