SPECIAL MEETING – January 11, 2017 The Board of Public Works and Safety of the City of Michigan City, Indiana, met in SPECIAL SESSION on Wednesday morning, January 11, 2017 at the hour of 8:30 a.m., in the Council Chambers, in the City Hall Building, located at 100 East Michigan Boulevard, Michigan City Indiana – a regular meeting room of this Board. The meeting was called to order by President Steve Janus, who presided. Noted present: Steve Janus, Richard Murphy and Virginia Keating (3) A QUORUM WAS NOTED PRESENT. Also noted in attendance: Amber Lapaich, City Attorney Lt. Jeff Loniewski, M.C.P.D. Traffic Skylar York, Assistant City Planner Aaron Borngraber, Associate City Planner Charles “Spike” Peller, City Engineer Kim Sliwa, Deputy City Clerk Jennifer Clouse, City Clerk Secretary REQUEST FOR STREET CLOSURE- Richard Murphy, City Controller, is requesting the temporary closure of Franklin Street at the intersection of 8th Street for a video shoot on Monday, January 16, 2017 from 9:00 am to 2:00 pm for a promotional video for the 2017 Shelf Ice Brew Festival The following request was received in the City Clerk’s Office on January 5, 2017 by Richard Murphy: Temporary street closure of 8th and Franklin Streets to shoot Shelf Ice Brew Fest video. Vice-President Murphy addressed the Board explaining the request; advising the Mayor and Marketing team would like to promote the Shelf Ice Brew Festival with a video at the intersection of 7th and Franklin Streets; further advising the concept involve includes some drone footage which the drone will fly over the shelf ice and then some smaller up close shots; requesting on January 16, 2017 between the hours of 9:00 am and 10:00 am the intersections of Franklin and 7th Streets be closed with barricades being placed at 7th and Washington Streets, at Franklin and 6th Street, at 7th and Pine Street, and Franklin and 8th Streets; then between the hours of 10:00 am and 2:00 pm intermittent closings of the intersections of Franklin and 7th Streets, 7th and Washington Streets, Franklin and 6th Street, as well as 7th and Pine Street; asking for approval. Discussion ensued between Vice-President Murphy and Virginia Keating regarding parking along 7th Street; Vice-President Murphy asked Lt. Loniewski if barricades could be moved for people arriving to work. Lt. Jeff Loniewski addressed the Board there were no problems with the closures since Pine and Washington Streets are two-way now, the only concern he has was the merchants along 7th Street but an officer can be at the corners to assist with the barricades. Special Meeting – January 11, 2017 Page 2 Corporate Counsel Amber Lapaich addressed the Board that Liability Insurance was not need for this event. Virginia Keating made the motion to approve the request for street closure on January 16, 2017 with rain date of January 17, 2017 for the video shoot for Shelf Ice Brew Festival. The motion was seconded by Vice-President Murphy and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (3). NAYS: None (0). Motion Carries. M C DESIGN MARK – An Agreement between the City of Michigan City and Botkin & Hall, LLP Attorneys & Counselors for Legal Services Corporate Counsel Amber Lapaich addressed the Board explaining this is for legal services for the city’s trademark of “Create, Play and Repeat”; asking for approval. Vice-President Murphy added that this comes as a recommendation from the Roger Brooks Plan. Discussion ensued between Corporate Counsel Amber Lapaich and President Janus regarding anyone being able to use these three words after this trademark is approved; Counsel Lapaich stated that not in the pattern or artistic design that the city approved. Vice-President Murphy made the motion to approve the agreement between the City of Michigan City and Botkin & Hall, LLP Attorneys & Counselors for Legal Services per Mrs. Keating’s recommendation adding the retainer is $1,416.00 after this there will be an hourly rate plus expenses. The motion was seconded by Virginia Keating and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (3). NAYS: None (0). Motion Carries. 2017 LANDSCAPE AGREEMENT RENEWAL – Renewal of Landscape Maintenance Agreement between the City of Michigan City and Servicescape, LLC for Michigan Boulevard and Franklin Square for 2017 Corporate Counsel Amber Lapaich asked the Board to defer this request until the January 17, 2017 meeting. Vice-President Murphy made the motion TABLE the 2017 Landscape Agreement Renewal until the January 17, 2017 meeting. The motion was seconded by Virginia Keating and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (3). NAYS: None (0). Motion Carries. ADJOURNMENT President Janus inquired whether there was anything else to be considered by the Board at this time and, there being none, declared the meeting ADJOURNED (approximately 8:48 am). Virginia Keating made the motion to adjourn. The motion was seconded by Vice- President Murphy and carried as follows: AYES: MEMBERS Janus, Murphy and Keating (3). NAYS: (0).
