SPECIAL MEETING – October 26, 2017 The Board of Public Works and Safety of the City of Michigan City, Indiana, met in SPECIAL SESSION on Thursday morning, October 26, 2017 at the hour of 8:30 a.m., in the Council Chambers, in the City Hall Building, located at 100 East Michigan Boulevard, Michigan City Indiana – a regular mee ng room of this Board. The mee ng was called to order by President Steve Janus, who presided. Noted present: Steve Janus, Rich Murphy and Virginia Kea ng, (3) Absent: (0) A QUORUM WAS NOTED PRESENT. Also noted in a endance: Skyler York, Assistant Planner Aaron Borngraber, Associate Planner Steve Stanford, M.C. Sanitary District Gale Neulieb, City Clerk Kim Sliwa, Deputy Clerk Dawn Debald, Assistant Deputy Clerk CERTIFICATE OF APPROVAL – William McLinden, Whisper Dunes Subdivision (Pe on 908-17 Major Subdivision PUD (Secondary Plat) Vice-President Murphy addressed the Board sta ng that it is his understanding the plat has a signature line on it for the Board of Works to sign, to acknowledge the plat; the plat will need to be recorded at the LaPorte County Recorder’s O ce. Mr. Murphy stated this mee ng was called to acknowledge that you as President have signed it and it is to be a ested by the City Clerk; explaining we needed a public mee ng to do so; advising, it is not an approval by the Board of Works; however, it stems from a provision in the zoning code that calls for a cer cate of signature on a plat to be recorded for a Subdivision. Mr. Murphy also stated this does not have to be more complicated than it is; it is simply a signature in a public mee ng for the Board of Works to execute the signature. Mr. Murphy then stated, that in his conversa on with Craig Phillips, Director, Planning & Inspec on, Mr. Phillips is on the same page with what was just explained. Mr. Murphy does not believe that Corporate Counsel, Amber Lapaich has any issues with this. Mr. Murphy asked that we keep this simple and execute the signature. President Janus asked if Vice-President Murphy was making this a mo on, and Mr. Murphy replied, yes. President Janus explained that he understood what Mr. Murphy was saying, but he has not heard from Corporate Counsel. Virginia Kea ng, Member, concurred. Mr. President Janus, advised he does not know what our legal stance is; sta ng any mo on should include the approval of Corporate Counsel. President Janus asked if there was any further discussion; asking if there is anything on the pe on or plot approval; further sta ng we are accep ng the plot of the subdivision for Whisper Dunes. Skyler York, Assistant City Planner, stated the Board is accep ng/con rming that the roads there will remain private, and a con rma on for the cer cate for signature. Vice-President Murphy stated we have a mo on on the table with a second, with the condi on that Corporate Counsel is ok with it. President Janus made a mo on to call for the vote, it carries as follows: AYES: MEMBERS Janus, Murphy and Kea ng (3). NAYS: None (0). Mo on Carries. REQUEST FOR STREET CLOSURE – Michael Kuss, Sanitary District, is reques ng the closure of Riviera Drive South in Suburban Estates Subdivision for installa on of a sanitary sewer from November 6, 2017 to November 10, 2017. Steve Stanford, M.C. Sanitary District, addressed the Board sta ng this is a rou ne street closure request for an essen al sewer upgrade for the Suburban Estates Subdivision. President Janus asked if this project will take the en re week. Mr. Stanford stated it is a 4 day closure and will more than likely be a one lane restric on, not a complete closure. Virginia Kea ng made the mo on to approve the request for the street closure of Riviera Drive South in Suburban Estates Subdivision for installa on of sanitary sewer from November 6, 2017 through November 10, 2017. The mo on was seconded by Vice-President Murphy and carries as follows: AYES: MEMBERS Janus, Murphy and Kea ng (3). NAYS: None (0).
