REGULAR MEETING - MARCH 20, 2001 The Common Council of the City of Michigan City, Indiana, met in regular session on Tuesday Evening, March 20, 2001, at the hour of 7:30 p.m., local time, in the Common Council Chambers, located in the lower level of the City Hall Building, 100 East Michigan Boulevard, Michigan City, Indiana. The meeting was called to order at 7:30 p.m. by Council President Virginia Martin, who presided. The Pledge of Allegiance to the Flag and a short period of silent prayer were observed. Roll call was authorized and the following were noted present and/or absent: PRESENT: COUNCIL MEMBERS Evelyn D. Baker; Carolyn Harmon; Joseph LaRocco; Charles Lungren; Virginia R. Martin; Willie Milsap; Paul A. Przybylinski; Denzil D. Wilson and JoEileen Winski (9) ABSENT: None (0) A QUORUM WAS NOTED PRESENT. APPROVAL of MINUTES President Martin inquired whether there were any corrections, deletions, or additions to the minutes of the Regular Meeting of March 6, 2001, and, there being no objections, declared the minutes approved as printed. REPORTS of STANDING, SPECIAL, or SELECT COMMITTEES President Martin recognized members of the Salvation Army Boy Scout troop who were present. Councilman Lungren requested suggestions as to how to eliminate the problem of deer on the airport runway. REPORTS of OTHER CITY OFFICERS and DEPARTMENTS Note was taken of receipt of the Monthly Financial Statement for February. PETITIONS There were no petitions. COMMUNICATIONS There were no communications. RESOLUTIONS The Clerk read by title only, there being no objections, RESOLUTION NO. 4091 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF MICHIGAN CITY, INDIANA DECLARING A MORATORIUM ON ALL CELLULAR TOWERS WITHIN THE CITY OF MICHIGAN CITY WHEREAS, there is legislation currently pending before the Michigan City Common Council to amend existing Michigan City Code with regard to the erection of cellular towers within the City of Michigan City; and WHEREAS, it is now necessary that the current legislation, along with existing Code be further reviewed, studied, and otherwise amended to address specific concerns as to the Community's health, welfare, and safety; and Page 2 March 20, 2001 WHEREAS, it is critical that the existing Code be immediately further reviewed, studied, and otherwise amended to address erection of additional cellular towers within the City of Michigan City; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Michigan City, Indiana, that a moratorium on the issuance of cellular tower permits is hereby declared far a period of ninety (90) days, so that existing Ordinances and/or Michigan City Code may be reviewed and modified as necessary, relating to aesthetics, public health, welfare, and safety. This Resolution shall be in full force and effect from and after its adoption by the Common Council and its approval by the Mayor. There was discussion by Councilmen Przybylinski, LaRocco, and Lungren and Rich Harding (510 Bies Street). The motion carried and the Resolution was adopted by the following vote: AYES: COUNCIL MEMBERS Wilson, Winski, Harmon, LaRocco, Lungren, Martin, Milsap, and Przybylinski (8). NAYS: None (0). There being no objections, the Clerk read by title only, RESOLUTION NO. 4092 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF MICHIGAN CITY, INDIANA REGARDING THE DISPOSAL OF BRICKS FROM ANY STREETS WITHIN THE CITY OF MICHIGAN CITY OF MICHIGAN CITY WHEREAS, there is legislation currently pending before the Common Council for the City of Michigan City amending the existing code concerning brick streets; and WHEREAS, the pending legislation before the Common Council requires that any bricks removed from any brick streets within the City of Michigan City be returned to the City of Michigan WHEREAS, it is the Common Council's position that any bricks removed from any City streets while this legislation is pending before the Common Council be retained by, and for the City of Michigan City, Indiana. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Indiana, that the Board of Works, the Sanitary District, and the Water Department are hereby informed not to dispose of any bricks removed from City streets until the current legislation before the Michigan City Common Council is concluded. This resolution shall be in full force and effect from and after its adoption by the Common Council and its approval by the Mayor.
