Page 1 November 15, 2022 REGULAR “HYBRID/ZOOM” MEETING November 15, 2022 The Common Council of the City of Michigan City, Indiana, met in Regular session on Tuesday evening, November 15, 2022, at the hour of 6:30 p.m., Hosted by “Hybrid/Zoom” and streamed live on “My Michigan City” Facebook Page. The meeting was called to order at 6:30 p.m. by President Deuitch. Roll call was authorized, and the following were noted present and/or absent. PRESENT: COUNCIL MEMBERS Bryant Dabney, Sean Fitzpatrick, Michael Mack, Angie Nelson Deuitch, Don Przybylinski, Paul Przybylinski, Gene Simmons, Dalia Zygas and Tracie Tillman (9). ABSENT: COUNCIL MEMBERS None (0). A QUORUM WAS NOTED PRESENT ALSO, PRESENT: Council Attorney Jewel Harris, Gale Neulieb City Clerk and Stacy Dudley Deputy Clerk APPROVAL OF MINUTES President Deuitch stated that we will be approving the Regular “Hybrid/Zoom” Council meeting minutes that was held on November 1, 2022, asking if anyone had any additions, deletions or corrections at this time, there was no response. Councilman D. Przybylinski made a motion to approve the minutes of the Regular “Hybrid/Zoom” meeting minutes that was held on November 1, 2022 and second by Councilwoman Tillman. The motion carried and the minutes from the November 1, 2022 council meeting were approved by the following vote: AYES: Council members Dabney, Fitzpatrick, Mack, Deuitch, D. Przybylinski, Simmons, Zygas, P. Przybylinski and Tillman (9) NAYS: Council member None (0). REPORTS of STANDING COMMITTEES Councilman D. Przybylinski reported being the liaison to the Sanitary Districts he wanted to report that they have not received any of the monies that the Town of Long Beach owes to the Sanitary District to date. President Deuitch asked if there were any additional standing committee reports, there was no response. FINANCE REPORT President Deuitch asked Finance Chair Tracie Tillman if she had anything to report on this evening. Councilwoman Tillman advised that the Finance Committee met this evening but didn’t have a quorum but reviewed the claims for November 15, 2022 in the amount of Page 2 November 15, 2022 $68,910.00 from #2042 Riverboat Fund and there were no claims received for Fund #2031 Boyd Development. Councilwoman Tillman advised the current balance in the Riverboat as of November 14, 2022 was $4,433.398.87 President Deuitch read the following claims to be paid for November 15, 2022: CLAIMS DOCKET November 15, 2022 Fund #2042 – Riverboat – Claims - $ 68,910.00 EFT $ 00.00 Fund #2031 – Boyd Development - $ 00.00 EFT $ 00.00 TOTAL CLAIMS $ 68,910.00 President Deuitch asked if anyone had any questions or comments. Councilman Simmons made a motion to adopt the November 15, 2022 Riverboat claims in the amount of $68,910.00, second by Councilman Mack with the motion being carried by the following vote: AYES: Council members Fitzpatrick, Mack, Deuitch, D. Przybylinski, Simmons, Zygas, Tillman, and Dabney (8) NAYS: Council member P. Przybylinski (1). REPORTS OF SPECIAL or SELECT COMMITTEES President Deuitch asked if there were any reports of standing committees. President Deuitch commented on the workshop that they had last Thursday on November 10, 2022 regarding annexation and that she felt it was a good dialogue; advising that there will be amendments forthcoming at our next council meeting to clean up some of the language, so we can put some of the questions to rest that have come up from different councils, attorneys, engineering firms in reference to annexations. REPORTS FROM THE MAYOR OR OTHER CITY OFFICERS AND DEPARTMENTS President Deuitch asked if there were any reports from the mayor or other city officers and departments. MCFD Chief Legault reported on the following incidents for the month of October, 2022. Rescue/Emergency Medical – 283 Hazardous conditions (non fire) – 7 Service Calls – 15 Good Intent Calls – 50 False Alarm & False Calls – 3 Narcan was used on 7 calls Chief Legault thanked the Council for amending the Inspection Fees that was adopted at the last council meeting and commented on the aged fleet the MCFD is dealing with daily and will address that under public comment. Chief Legault addressed Councilman D. Przybylinski question regarding carbon monoxide calls and what the crew does when they arrive at a home. Page 3 November 15, 2022 MCPD Chief Forker reported on the MCPD statistics regarding calls for October 2022 along with updating the status of the “flock” camera locations, advising that the MCPD has been assigned a project manager which will help with moving forward, get the building permits and start breaking ground in the next few weeks and reporting when “Raven” shot detection installation will be in the spring of 2023. MCPD Chief Forker advised that the MCPD has established a recruitment and retainment team that consist of nine (9) members of our department that want to volunteer and be a part of avenues to take to recruit new officers for our department. Chief Forker advised Councilman Fitzpatrick that the department has lost thirty-seven (37) officers the last three (3) years and it is a combination of several reasons; retirement, leaving for a different profession, chasing money, different location it is a combination of everything over the years. Chief Forker addressed Councilwoman Tilllman that the flock and raven has four (4) and will cover a total of four (4) square miles. PETITIONS President Deuitch asked Deputy the Clerk if there were any petitions. Clerk Neulieb stated that there are no petitions this evening. COMMUNICATIONS President Deuitch asked if there was any correspondence received in the Clerk’s Office for the Council. Clerk Neulieb read the following dockets received in the Clerk’s Office. In accordance with Ordinance No. 4538 correspondence was received in the Clerk’s Office on November 4, 2022, regarding an accident that happened on 10/27/2022 with a MCPD vehicle. In accordance with Ordinance No. 4538 an accident report was received in the Clerk’s Office on November 4, 2022, regarding an incident that took place on 11-2-2022 regarding a MCPD vehicle. Correspondence was received in the Clerk’s Office on November 7, 2022, from Porter County Superior Court 2 regarding a summons filed by Kyle A. Kazmierczak. In accordance with Ordinance No. 4538 an accident report was received in the Clerk’s Office on November 9, 2022, that took place on 5/8/2022 involving a MCPD vehicle. RESOLUTIONS The Clerk read the following resolution by title only. MICHIGAN CITY COMMON COUNCIL RESOLUTION NO. 4860 A RESOLUTION INCREASING AND DECREASING CERTAIN APPROPRIATIONS WITHIN THE BUDGET OF THE MOTOR VEHICLE HIGHWAY FUND #2001 FOR THE YEAR 2022 IN MICHIGAN CITY, INDIANA Page 4 November 15, 2022 WHEREAS, there exists certain circumstances within the budget of the Motor Vehicle Highway Fund #2001 of Michigan City which require increasing and decreasing appropriations for certain line items in that Fund for the year 2022. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Michigan City, La Porte County, Indiana, that: Section 1. Councilman Dabney stated that this is another transfer to cover funds for gasoline. President Deuitch asked if anyone from the public had any questions or comments, there was no response. Councilman D. Przybylinski asked if by making this transfer will this cover the gas shortfall for the rest of 2022. Controller Hoffmaster stated that this should cover the shortfall for the rest of this year. Discussion ensued between Controller Hoffmaster and Councilman P. Przybylinski regarding the monies being transferred from Repair/Maintenance line item for $60,000, that we were over budgeted, if this line item will still have an operating budget if there is a major breakdown, the amount of money left in this line item and that the price of gasoline is high at this time. Councilwoman Zygas made a motion to approve the proposed resolution, second by Councilmen Simmons and Dabney; the motion carried and was approved by the following vote: AYES: Council members Deuitch, D. MICHIGAN CITY COMMON COUNCIL ORDINANCE NO. 4661 APPROVING ADDITIONAL APPROPRIATION IN THE BUDGET OF THE RIVERBOAT FUND FOR THE CONSTRUCTION OF A NEW FUEL FARM AT THE MICHIGAN CITY MUNICIPAL AIRPORT WHEREAS, it has been demonstrated to the Common Council of the City of Michigan City that it is necessary to appropriate more money than was appropriated in the 2022 Annual Budget for the construction of a new fuel farm at the Michigan City Municipal Airport, and WHEREAS, the City Controller has determined that sufficient unappropriated funds are available in the Riverboat Fund #2042 to be appropriated for that purpose, and WHEREAS, the Board of Aviation Commissioners (“Aviation Commissioners”) will receive Bi-Partisan Infrastructure Law funds allocated to the Airport totaling approximately $671,332, and the Aviation Commissioners have agreed to return to the Riverboat Fund over the next five (5) years (See copy of minutes from Aviation Commissioners dated July 14, 2022, which is attached hereto and incorporated herein as Exhibit A); and WHEREAS, the Federal Aviation Administration has issued a FAQ regarding the use of the Bi-Partisan Infrastructure Law funds and said funds can be used as reimbursement (See Question Q-U24 on page 12 of Exhibit B, which is attached hereto and incorporated herein) and also for the construction of fuel farm (See Question Q-U47 on page 15 of Exhibit B, which is attached hereto and incorporated herein). Page 7 November 15, 2022 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Michigan City, La Porte County, Indiana, that for the expenses of the City the following additional sums of money are hereby appropriated out of the fund named and for the purpose specified above, subject to the laws governing the same: AMOUNT AMOUNT REQUESTED APPROPRIATED DECREASE Riverboat Fund 2042 Unappropriated balance $800,000.00 INCREASE ACCOUNT#2042 901.444.050 Capital Outlay – Improvements Other than Buildings $800,000.00 TOTAL FOR FUND $800,000.00 This Ordinance to be effective upon passage by the Council, approval by the Mayor, any necessary publication, and any necessary approval by the Indiana Department of Local Government Finance. Przybylinski commented on the ARP money that was allocated to the city giving the federal government kudos for giving our city this money to be able to do what we’re doing; that without this sixteen (16) million dollars the government allocated we wouldn’t be able to buy three garbage trucks, along with other equipment and items we are spending from the ARP monies; and that we are taking one million dollars out of Riverboat Fund to be able to move forward on the fuel farm at the airport. Councilman D. Przybylinski also commented on the snow equipment that was purchased with the ARP monies the city will be receiving soon; that this council adopted an ordinance over two (2) years ago that sidewalks would be plowed/shoveled when the snow is four (4) inches or more that we haven’t done since it was adopted; stating that when the double track is finished this equipment may have to be used to plow 11th Street since the one way street is going to be so narrow; stating that he didn’t believe a City truck with their plow attached would be able to plow; asked the refuse department to create a replacement program for replacing garbage trucks. President Deuitch stated that we will finish comments from the council on second reading after the vote to have third reading this evening. Councilman D. Przybylinski made a motion to have third reading this evening, second by Councilman Tillman, with the motion to have third reading approved by the following vote: AYES: Council members Zygas, P. Przybylinski regarding the new equipment being purchased will save a lot of manpower in the Street Department; stating several concerns regarding how narrow the road is going to be next to the NICTD double track, wondering if a regular plow truck will even fit due to the concrete embankments. President Deuitch stated that we need to step back to have the formal public hearing this evening: Opening the formal public hearing (repeating three times) “if there was anyone from the public that wished comment on the proposed ordinance” there being no response the formal public hearing was closed. Przybylinski thanked Marty Corley, Bunny Dimke, and Albertine Allen for the hard work and dedication on the Human Rights Commission and looks forward to working with Gregory Coulter. President Deuitch read the following FYI appointments to the Council; advising that nominations for each of these will take place at the December 6, 2022 Council meeting. FYI: The Council has one (1) appointment to the Michigan City Women’s Commission representing a non-for-profit organization/women issues (term expires December 21, 2022) Incumbent: Ms. Nicole Coleman FYI: The Council has two (2) appointments to the Redevelopment Commission representing the Council (term expires December, 2022) Incumbents: Angie Nelson Deuitch Kathy Dennis FYI: The Council has one (1) appointment to the Fire Merit Commission (term expires December 31, 2022) Incumbent: Desiree Nichols FYI: The Council has one (1) appointment to the Veteran’s Commission representing a member of the service that deals with PTSD (expires December 31, 2022) Incumbent: Keith Devereaux FYI: The Council has one (1) appointment to the Board of Zoning Appeals (expires December 31, 2022) Incumbent: Kathryn Stransky UNFINISHED BUSINESS President Deuitch advised that the Council has received a letter from the Michigan City School Board appointing Dwayne Hurt to the Social Status of African American Males Commission with his term beginning immediately and expire February 15, 2023. Councilwoman Tillman made a motion to approve the Michigan City Area School Boards appointment of Mr. Dwayne Hurt representing them on the Social Status of Page 11 November 15, 2022 African American Males Commission, second by Councilman P. Przybylinski and Tillman (9) NAYS: Council member None (0). COMMENTS FROM THE PUBLIC President Deuitch asked if there was anyone from the public that would like to speak. Tommy Kulavik, 1316 Ohio Street, wanted to alert the public that last week a gentleman came to his door telling he was there to do a house inspection; that he advised him that he needed to go to the city and get a permit to be able to go door to door and asked him to leave. Tommy Kulavik announced that the “Black McDonald’s Operator of Chicago” is having their “Turkey Give Away” tomorrow November 16th at the McDonalds on Michigan Boulevard starting at 7:30 a.m. MCFD Chief Legault addressed the Council reminding them that the Fire Department still needs to replace their fifteen-year-old firetruck and that he is available anytime to meet with all Council members or just a few; that we need to move forward on this matter. President Deuitch asked if there were any more comments from the public, there was no response. COMMENTS FROM THE COUNCIL President Deuitch asked if there were any comments from the Council at this time. Councilman D. Przybylinski thanked the Exchange Club members and all the volunteers that helped put on the Veterans Parade this past Saturday; stating that there were more people in the parade than people watching and that he hopes in the future that their will be more people attending, that this is a big deal in our community to celebrate such an important day. Councilman D. Przybylinski commented about his request regarding the streetlights in the city that have turned purple taking his concern to the Board of Public Works and Safety Board in July 2022; updating the council regarding the status of these lights referring this matter back to the Council since it was not a contract with the Board of Works. Discussion ensued between Council D. Przybylinski, President Deuitch and Councilman P. Przybylinski regarding the purple lights, the ESG project/contract that was signed in 2019, the warranty of these lights. Councilman D. Przybylinski wished everyone a Happy Thanksgiving. President Deuitch sent her condolences to the Edward Bohle family. President Deuitch commented on the annexation ordinance that will be coming in December and that the Public Safety LIT tax will be a subject being discussed in December also. Page 12 November 15, 2022 ADJOURNMENT A motion by Councilman D.
