MICHIGAN CITY URBAN ENTERPRISE ASSOCIATION NOTICE OF EXECUTIVE SESSION Notice is given that, pursuant to the Indiana Open Door Law, an Executive Session of the Special Committee of the above-named entity shall be held on Thursday, the 28th day of September 2023 at 6:00 pm. It will be held in the Madeline & George Smrt Community Center located at 301 Grant Avenue Michigan City, IN 46360. The subject matter of the Executive Session involves those matters which are indicated by a check mark below: ✓ (1) Where authorized by federal or state statute. _ (2) For discussion of strategy with respect to any of the following: __ (A) Collective bargaining. __ (B) Initiation of litigation or litigation that is either pending or has been threatened specifically in writing. As used in this clause, “litigation” includes any judicial action or administrative law proceeding under federal or state law. __ (C) The implementation of security systems. __ (D) The purchase or lease of real property by the governing body up to the time a contract or option to purchase or lease is executed by the parties. __(3) Interviews and negotiations with industrial or commercial prospects or agents of industrial or commercial prospects by: __(A) the Indiana economic development corporation; __(B) the office of tourism development; __(C) the Indiana finance authority; __(D) the ports of Indiana; __(E) an economic development commission; __(F) the Indiana state department of agriculture; __(G) a local economic development organization that is a nonprofit corporation established under state law whose primary purpose is the promotion of industrial or business development in Indiana, the retention or expansion of Indiana businesses, or the development of entrepreneurial activities in Indiana; or __(H) a governing body of a political subdivision. __ (4) To receive information about and interview prospective employees. __ (5) With respect to any individual over whom the governing body has jurisdiction: __ (A) to receive information concerning the individual's alleged misconduct; and __ (B) to discuss, before a determination, the individual's status as an employee, a student, or an independent contractor who is: (i) a physician; or (ii) a school bus driver. ✓ (6) For discussion of records classified as confidential by state or federal statute. __ (7) To discuss a job performance evaluation of individual employees. This subdivision does not apply to a discussion of the salary, compensation, or benefits of employees during a budget process.
