At the regularly scheduled Planning Commission meeting on September 22, 2021, members
granted preliminary approval to Matthew Sokol for the Smith and Stroud Roads Subdivision
subject to compliance with City Engineer Michael Mackay’s memorandum of August 9, 2021,
which I have enclosed.
In accordance with Section 1111.02(k) of the Codified Ordinances, preliminaiy plans are
referred to City Council for approval. All copies of the plans approved by the Plamiing
Commission are enclosed. Please return the plans after City Council takes action. I have also
included the list of residents that asked to be notified about meetings concerning this project.

INSTRUCTIONS FOR APPEARING BEFORE THE PLANNING COMMISSION
FOR SUBDIVISIONS
1. Plans to be placed on the agenda must be submitted to the Service Department fifteen (15) days
prior to a scheduled meeting. All plans must be reviewed and receive approval from the
Enghieer and Service Director.
2. Complete tlie entire form below and submit with the following:
a. Twelve prints of proposed subdivision (scale not more than fifty (50) feet per Inch covering
entire area),
b. An Engineer's review deposit is required for all subdivisions,
c. A check, covering appropriate fees, payable to the city of Mlddleburg Heights, must
accompany application.
Pursuant to Chapter 1111 of the Middleburg Heights, Ohio, Codified Ordinances, a schedule
offees is set forth for review and approval of plans and plats by the City Engineer and Planning
Commission.
CHAPTER im SECTION 1111.08 SCHEDULE OF FEES:
In making applications for approval of a prellminaiy plan or a final plat of a subdivision,
the developer shall deposit fees as follows:
a: PrellmtnaiW Plans
The minimum fee for review of a preliminaiy plan shall be four hundred dollars ($400.00)
for each preliminary plan, plus five dollars ($5.00) for each lot exceeding twenty, plus the
fee for an Independent analysis when required by the Planning Commission, plus a
one hundred dollar ($100.00) fee for a public hearing, if necessary.
b: Final Plats
Minimum fee examination of a final plat shall be tliree hundred dollars ($300,00) for each
final plat, plus five dollars ($5.00) for each lot exceeding twenty.

Preliminary Plan
The following are my comments to the above referenced Preliminary Plan, dated June 11,
2021:
1, The Preliminary Plan must show all the information required in C.O. 1111.01
including existing and proposed sewers and water mains. C.O. Chapter 1111 also
describes the improvements that are required for a dedicated street.
2. a. A Preliminary Storm Water Control Plan is required as part of the preliminary
review process. See C.O. 1367.08. All requirements of Chapter 1367 must be
met.
b. The Preliminary Plan should show how the storm water drainage and puddling,
which occurs on the property near Smith Road at the curve, will be addressed with
the subdivision improvements,
c. The final plans must comply with the requirements ofthe attached Storm Water
Quantity Review Checklist.
3. The final plans must comply with C.O. Sections 1367.09, 1367.10,1367.13 and
1367.14, which require post-construction water quality, construction soil and sediment
controls, storm water control plan, inspection and maintenance, and easements.
4. The following inspection and maintenance items will be required for the storm water
facilities as part ofthe final plan submittal:
a. Inspection and Access Easement(C.O. 1356.14) - Attached is the form (a Word
document)that can be suitably modified by the developer,
b. Inspection and Maintenance Agreement between City and developer(C.O.
1367.09(g))- Attached is the form (a Word document)that can be suitably modified
by the developer,
c. The developer, prior to final acceptance of the improvements by the City must
submit an as-built certification signed by a professional engineer certifying that the
storm water management plan as installed meets the requirements of the approved
storm water management plan (C.O. 1367.08(g)). This requirement must also be
included as a note on the plans.

d. A written inspection report(signed by a qualified professional) ofthe storm water
management facility must be submitted by the owner to the City Building
Department each year(C.O. 1367.13). This requirement must also be included as a
note on the plans.
5. a. The Preliminary Plan must comply with the requirements of C.O. Chapter 1363 -
Controlling Riparian and Wetlands Setbacks,
b. A wetland dclineation/report for the project area is required per C.O. 1363.09(b)and
a copy should be provided to the Cit}' prior to Preliminary Plan approval,
c. The Preliminary Plan and wetland delineation must be submitted by the developer to
the Cuyahoga SWCD for approval and a copy of the approval must be provided to
the City,
d. The City would like the developer to provide signs showing the location of any
wetlands and riparian setbacks. The CSWCD should be consulted about this
requirement.
6. Die developer should provide to the City a current geotechnical report on tlie existing
soil conditions at the site and the report should provide recommendations on the
preparation ofthe subgrade prior to concrete roadway construction.
7. Die developer shall provide a written report from a traffic engineering consultant which
report shall provide the recommendations of the consultant concerning the location of
this proposed street as related to the curve of Smith Road and the location ofthe railroad
tracks. If the report appi'oves the location of the proposed street then the report shall
recommend any signage within the proposed development or along Smith Road and
also any recommendations on the new intersection pavement, including lane tapers.
8. Please show proposed drive grades and yard grades for each sublot on the Preliminaiy
Plan.
9. The Building Department should review and confinn the “Area and Yard Regulations
- Detached Clusters” on Sheet Cl.0 of the Preliminary Plan.
10. The Preliminaiy Plan should be submitted by the developer to the Middleburg HeighLs
Fire Department for review and approval. The cul-de-sac right-of-way is shown at a
radius offifty (50)feet; this radius is in accordance with the City’s code, 'fhe cul-de-
sac pavement is shown at a radius of 38 feet, We recommend a cul-de-sac pavement
radius of 42.5 feet.
1 1. Please provide on the Preliminary Plan a typical section for proposed roadway. Please
see the attached typical section which is acceptable to the City.
12. A drive entry onto Smith Road from Sublot 2 will not be permitted. Please remove
Note 4 from Sublot 2.

13. The final improvement plans must be submitted by the developer to the Northeast Ohio
Regional Sewer District(NEORSD)for review and approval ofthe Storm Water
Management Plan and a copy of the approval must be provided to the City.
14. The Preliminary Plan must be submitted by the developer to the Cuyahoga County
Public Works Department, Sanitary Sewer Division for review and approval of the
sanitary sewers. It is not necessary for the County to review the storm water system.
15. The Preliminary Plan must be submitted by the developer to Cleveland Water
Department for review and approval and a copy of the approval must be provided to the
City.
16. The final plans and reports must be signed and sealed by an Ohio Registered Professional
Engineer.
Designer shall respond to all comments in writing and indicate the plan sheets on which
changes have been made.

A RESOLUTION
REZONING PERMANENT PARCEL NUMBER 371-17-016
FROM ITS PRESENT ZONING CLASSIFICATION MS(MOTORIST
SERVICE DISTRICT) TO GB(GENERAL BUSINESS DISTRICT)
USE DISTRICT CLASSIFICATION
WHEREAS, the property owner, Camille Dakdouk has requested that permanent
parcel number 371-17-016 located at the Southeast corner of Sheldon Road and
Engle Road be rezoned from MS (Motorist Service District) to GB (General Business
District) Use District Classification; and
WHEREAS, the Planning Commission recommends to Council that the requested
zoning change be made; and
WHEREAS, Council deems that the requested zoning change in the hereafter
described property should be made and the same is conducive to the public health,
safety, convenience, prosperity, and the general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MIDDLEBURG HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That Ordinance No. 1982-170, the Zoning Ordinance of the City of
Middleburg Heights and the zone map made a part of said Ordinance be changed
and amended so as to rezone Permanent Parcel Number 371-17-016 from its
present Use Classification MS (Motorist Service District) to GB (General Business
District) Use District Classification, a copy of the legal description of permanent
parcel number 371-17-016 marked “Exhibit A” is attached hereto and made a part
hereof.
Section 2: That the City Engineer be, and he is hereby directed to immediately
make the proper marking and changes on the zone map made a part of said Zoning
Ordinance 1982-170 to clearly indicate the aforesaid zoning change in the use
district of the above-described property from its present MS (Motorist Service
District) to GB (General Business District) Use District Classification.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public,
in compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.

A RESOLUTION
ACCEPTING THE FY2020 ASSISTANCE TO FIREFIGHTERS GRANT
(AFG)FROM THE U.S. DEPARTMENT OF HOMELAND SECURITY
WHEREAS, the purpose of the Assistance to Firefighters Grant program is to protect
the health and safety of the public and firefighting personnel against fire and fire-
related hazards; and
WHEREAS, the City applied for an Assistance to Firefighter Grant (AFG) from the
U.S. Department of Homeland Security; and
WHEREAS, FEMA has determined that the application submitted was consistent
with the Assistance to Firefighters Grant Program’s purpose and was worthy of
award; and
WHEREAS, the Fiscal Year 2020 Assistance to Firefighters Grant (AFG) funding
has been approved in the amount of $135,433.33 in Federal funding, the City is
required to contribute non-Federal funds equal to or greater than 5.00% of the
Federal funds awarded, or $6,771.67; and
WHEREAS, the grant will be used to purchase SCBA (Self Contained Breathing
Apparatus) and associated equipment to improve and support the fire department’s
respiratory equipment improvement program.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MIDDLEBURG HEIGHTS, STATE OF OHIO, AS FOLLOWS:
