In looking ahead to the 2025 Annual Meeting of Delegates for the Southwest Community Health System,
your assistance is requested.
Requested is an approved list by the legislative body of all civic, educational, fraternal, and religious
organizations of adults in the taxing district of Middleburg Heights. The organizations will be eligible to
name delegates to the Southwest Community Health System to participate in an annual meeting, elect
certain Trustees to the Southwest Community Health System Board and from time-to-time are called
upon to vote on important issues regarding the Health System.
The following are reminders in honoring this request:
● We respectfully ask that the Middleburg Heights legislative body review the enclosed list and
approve a new list noting any organizational additions or deletions it deems appropriate. The list
was last approved and provided by your legislative body in 2022.
● As a reminder, the organizational documents of the Southwest Community Health System
provide that an organization is considered to be in your community if it maintains its
headquarters or generally holds its meetings in your community.
● By August 31, 2024, please return a legislative body approved list via email to Sarah Brooks at
sbrooks@swgeneral.com or by mail through the enclosed postage paid envelope.
Once approved lists are received. Southwest General will in turn notify each organization that it is
entitled to identify one delegate and/or one alternate delegate. If you should have any questions or

A RESOLUTION
ACCEPTING THE BID OF SIGNAL SERVICE COMPANY
FOR THE BAGLEY ROAD TRAFFIC SIGNAL IMPROVEMENTS REBID
WHEREAS, pursuant to legal advertisement duly made, sealed bids were received on
June 17, 2024, forthe Bagley Road Traffic Signal Improvements Rebid, in accordance
with specifications on file in the office of the City Engineer; and
WHEREAS, the City Engineer is recommending acceptance of the bid of Signal Service
Company, 4341 Cranwood Parkway, Warrensville Heights, OH 44128 for the Bagley
Road Traffic Signal Improvement in the amount of $512,642.00 and is determined to be
the lowest and best bid, therefore.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the bid of Signal Service Company, 4341 Cranwood Parkway,
Warrensville Heights, OH 44128 for the Bagley Road Traffic Signal Improvements
Rebid for work generally including pavement reconstruction, sidewalk and curb
replacement, reconstruction of driveways, installation of pedestrian crossings, and
traffic signal replacement in the amount of $512,642.00 being the lowest and best bid
submitted pursuant to legal advertisement and specifications on file in the office of the
City Engineer, be and the same is hereby accepted.
Section 2: That the Mayor and Finance Director are hereby authorized to enter into a
contract with Signal Service Company in accordance with Section 1 of this Resolution.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.

RE: 2024 Bagley Road Traffic Signal Improvements
Attached is the bid tabulation for the referenced project. We have reviewed the bids for each of
the three bidders and we also perfonned a certified search of the unresolved findings database for
Signal Service Company, and a copy is attached hereto.
The low bidder was Signal Service Company in the amount of $512,642.00. See attached bid
tabulation for bid amounts. Signal Service Company has the required experience and equipment
and has previously provided a similar type of work in several cities and departments. Dan Good,
Traffic Technician for the City of Parma, Nino Piccoli, the Service Director for the City of Medina,
and Brad Kosco, Uie City Engineer of Hudon, all gave favorable references. Signal Service
Company is ODOT prequalified for this type of work.
I recommend that the contract in the amount of $512,642.00 be awarded to
Signal Service Company

AN ORDINANCE
AMENDING SECTIONS 1129.07 AND 1143.04
OF THE MIDDLEBURG HEIGHTS ZONING CODE
WHEREAS, pursuant to Section 1123.02 of the Middleburg Heights Zoning Code,
Breaking Through Intensive Therapy is requesting a text amendment to the Zoning Code
to permit a medical, dental & vision office use to occupy and run businesses in
properties zoned General Industrial; and
WHEREAS, the Zoning & Building Code Committee of Council has reviewed the request
and pursuant to Section 1123.02 (d) (1) of the Middleburg Heights Zoning Code has
requested preparation of zoning amendment legislation; and
WHEREAS, pursuant to Section 10.02 (d) of the Charter of Middleburg Heights, and
Section 1123.03 (e) of the Middleburg Heights Zoning Code, such legislation shall be
referred to the Planning Commission for its consideration and recommendation; and
WHEREAS, pursuant to Section 10.02 (d) of the Charter of Middleburg Heights and
Section 1123.03 (f) (7) of the Middleburg Heights Zoning Code, Council shall establish a
time for a public hearing on zoning matters after action by the Planning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That Section 1129.07 “Land Use Matrix Chart” of the Middleburg Heights
Zoning Code shall be amended so as to permit a Medical, Dental & Vision Office as a
conditional use in the Gl zoning district to read as follows:

Section 2: That Section 1143.04 “Specific Standards for Each Conditional Use” of
the Middleburg Heights Zoning Code shall be amended so as to add a new sub-section
numbered “1143.04 (bb)” to include the following new zoning code text:
(bb) Medical Dental & Vision Office.
(1) These conditional use requirements apply only to a medical, dental & vision
office land use when located in the Gl General Industrial zoning district.
(2) A medical, dental & vision office establishment shall occupy no more
than ten thousand (10,000) square feet of space.
(3) All active and passive uses associated with a medical, dental & vision
office located within the Gi General Industrial zoning district shall be
conducted inside the principal building on the property."
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Ordinance were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in

AN ORDINANCE
AUTHORIZING THE MAYOR AND FINANCE DIRECTOR TO ENTER INTO A
PURCHASE AGREEMENT FOR THE PURCHASE OF CERTAIN REAL ESTATE IN
THE CITY OF MIDDLEBURG HEIGHTS TO BE USED FOR THE ABRAM CREEK
DETENTION BASINS PROJECT
AND DECLARING AN EMERGENCY
WHEREAS, flooding of public and private property has been a concern throughout the
City of Middleburg Heights for many years; and
WHEREAS, it is the desire of the Mayor and Council to work towards the elimination of
all flooding concerns within the City and to improve stormwater management within
the City; and
WHEREAS, the acquisition of this parcel of land will allow the City to proceed with
necessary improvements to increase stormwater detention capacity to reduce flooding
within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the Mayor and Finance Director are hereby authorized to enter into a
purchase agreement, a copy of which is attached hereto and marked ‘‘Exhibit A”, for
the purchase of certain real estate and improvements in the City of Middleburg
Heights.
Section 2: That there is hereby appropriated from the Streets/Infrastructur e
Improvements Fund $, for the purchase of a certain parcel of real estate,
closing costs and related fees, expenses, and demolition and removal improvements
on said parcel.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Ordinance were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.
Section 4: That this Ordinance is hereby declared to be an emergency measure
immediately necessary for the preservation of the public peace, health, safety, and
welfare of said City. Such necessity exists by reason of the fact that it is immediately
necessary to acquire property to construct detention basins to control flooding and
address the proper handling of stormwater runoff and stream flow improvement within
Abram Creek. Wherefore, provided this Ordinance receives the affirmative vote of at
least two-thirds {2/3) of the members of Council it shall take effect and be in force
immediately upon its passage and approval by the Mayor.

WHEREAS, the City has title to a 2006 Ford F-350 truck, VIN 1FTWF31586EB57954
which is no longer needed for any municipal purpose; and
WHEREAS, the Cuyahoga County Agricultural Society, dba: Cuyahoga County
Fairgrounds, has requested the City to donate said equipment to the Fairgrounds for use
on the Fairgrounds property only.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MIDDLEBURG HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the Service Director is hereby authorized to transfer ownership of the
2007 Ford F-350 truck, VIN 1FTWF31586EB57954 to the Cuyahoga County
Agricultural Society.
Section 2. That it is hereby found and determined that all formal actions of this
council concerning and relating to the passage of this ordinance were adopted in an open
meeting of this council, and that all deliberations of this council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements including chapter 107 of the Codified Ordinances
and section 121.22 of Ohio Revised Code.

A RESOLUTION
AUTHORIZING THE MAYOR TO ENTER INTO A PURCHASE AGREEMENT
FOR THE PURCHASE OF CERTAIN REAL ESTATE
WHEREAS, the Little Red SchooLhouse, built in 1912 began as the Old District 10
Schoolhouse, serving children from Middleburg, Berea and Brook Park; and
WHEREAS, the structure contains five rooms and 2,055 square feet and sits on
approximately % of an acre near Sheldon and Fry Roads; and
WHEREAS, the building was the site of Middleburg’s first City Hall, as well as a speak
easy during Prohibition and a railroad way station. It was then purchased in 1940 and
used as a private home until 1970; and
WHEREAS, the City previously obtained ownership of the site and sold the property to
the Fabrizi Family who was the highest bidder in 1985; and
WHEREAS, the City of Middleburg Heights is desirous of re-purchasing the Little Red
Schoolhouse site to commemorate a 112-year-old piece of Middleburg Heights history.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the Mayor and Finance Director are hereby authorized to enter into a
purchase agreement, with terms and conditions the same or similar to “Exhibit A”, for
the purchase of certain real estate in the City of Middleburg Heights.
Section 2: That there is hereby appropriated from the Capital Improvements Fund
$45,000 and the Finance Director is hereby authorized to transfer the same amount
from the General Fund to the Capital Improvements Fund to implement this
Resolution.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.
