BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIDDLEBURG HEIGHTS,
CUYAHOGA COUNTY, STATE OF OHIO:
Section 1. That in order to provide for current expenditures and expenses for the City of Middleburg
Heights for the calendar year 2025, the following sums be appropriated from the Streets/Infrastructure

AUTHORIZING THE SALE OF CERTAIN AUTOMOBILES
NO LONGER NEEDED FOR ANY MUNICIPAL PURPOSE
WHEREAS, the City has title to city owned vehicles; a 2001 Tilt Trailer (Serial
#4KNTT18201 LI 62962), a 2006 Ford Crown Vic (VIN 2FAFP71W16X144 013), a 2008
Ford Crown Vic (VIN 2FAFP71V28X13843), a 2009 Dump Truck (VIN
1HTWDAAR49J088367) and a 2014 Dodge Charger (VIN 2C3CDXAT2EH2333 07), which
are no longer needed for any municipal purpose; and
WHEREAS, the Service Director has recommended that the above listed automobiles
be sold through Manheim Cleveland Public Auctions.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the Service Director is hereby authorized to sell a 2001 Tilt Trailer

A RESOLUTION
AUTHORIZING THE SERVICE DIRECTOR TO DISPOSE OF
EQUIPMENT NO LONGER NEEDED FOR ANY MUNICIPAL PURPOSE
WHEREAS, the City owns equipment that is no longer in service and is no longer
needed for any municipal purpose, a list of the equipment is attached and marked as
“Exhibit A”; and
WHEREAS, the Cuyahoga County Agricultural Society, dba Cuyahoga County
Fairgrounds, has by email dated February 28, 2025, requested the City to donate said
equipment to the Cuyahoga County Fairgrounds for use on the fairground’s property
only.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the Service Director is hereby authorized to transfer ownership of
the equipment Listed, which is no longer in service and is no longer needed for any
municipal purpose to the Cuyahoga County Agricultural Society, a copy is attached
hereto and marked “Exhibit A”.
Section 2: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg

AN ORDINANCE
ESTABLISHING AN EXTERIOR HOME MAINTENANCE GRANT PROGRAM
FOR RESIDENTIAL DWELLINGS IN THE CITY OF MIDDLEBURG HEIGHTS
WHEREAS, the City of Middleburg Heights is committed to maintaining and enhancing
the visual appeal, safety, and structural integrity of our neighborhoods; and
WHEREAS, the exterior maintenance of property plays a key role in contributing to the
overall aesthetic and vitality of our community; and
WHEREAS, the City of Middleburg Heights is excited to offer an exterior home
maintenance grant; the Middleburg Exterior Maintenance Opportunity (MEMO) Grant, a
new initiative aimed at supporting homeowners in our community with the cost of
exterior repairs, renovations, improvements, and exterior property maintenance code
remediation; and
WHEREAS, by supporting exterior improvements, we aim to help residents maintain
and enhance their property and ensure that our community remains a welcoming and
thriving place for all.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That there is hereby established the Middleburg Exterior Maintenance
Opportunity (MEMO) Grant to provide reimbursement to eligible homeowners in the
City of Middleburg Heights in their efforts to improve and enhance the value of their
property and the community.
Section 2: That there is hereby appropriated from the Capital Improvements Fund
$150,000.00 and the Finance Director is hereby authorized to transfer the same
amount from the General Fund to the Capital Improvements Fund to implement this
Ordinance.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Ordinance were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.

AN ORDINANCE
AMENDING ORDINANCE 2023-70 SO AS TO EXPAND THE CURRENT
SANITARY SEWER BACKUP REDUCTION GRANT PROGRAM FOR
RESIDENTIAL DWELLINGS IN
THE CITY OF MIDDLEBURG HEIGHTS
WHEREAS, the City of Middleburg Heights is committed to helping residents reduce the
chances of flooding; and
WHEREAS, on September 12, 2023, Ordinance #2023-70 was passed establishing a
Sanitary Sewer Backup Reduction Grant Program to diagnose sewer-related problems
our residents are facing and to assist residents by offsetting a portion of the expense
that a homeowner would incur to modify the residential plumbing systems to provide
sewer backup protection; and
WHEREAS, the City would like to expand the current program to include septic
replacement, septic to sanitary conversion, and waterproofing in addition to the
current eligible projects that include the elimination of sanitary sewer cross
connections; the replacement of sanitary sewer laterals, the lining of sanitary sewer
laterals, the installation of backwater prevention devices and other similar basement
flooding protection measures approved by the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That the current Sanitary Sewer Backup Reduction Grant Program is
amended to the Sanitary Sewer, Septic, Waterproofing Assistance Grant (SSWAG)
program to continue to provide financial assistance by expanding the eligible home
improvement projects designed to reduce the risk of basement flooding of residential
dwellings in the City of Middleburg Heights.
Section 2: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Ordinance were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.
