A RESOLUTION ADOPTING THE ALTERNATIVE TAX BUDGET
INFORMATION OF THE CITY OF MIDDLEBURG HEIGHTS, OHIO,
FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2026, AND
SUBMITTING THE SAME TO THE BUDGET COMMISSION OF
CUYAHOGA COUNTY
WHEREAS, on October I 1, 2002, the Cuyahoga County Budget Commission with an
affirmative vote of all members waived the requirement for taxing authorities of
subdivisions or other taxing units (including schools) to adopt a Tax Budget as provided
under O.R.C. Section 5705.281. but instead requires the filing of Alternative Tax Budget
Information on an annual basis; and,
WHEREAS, the Alternative Tax Budget Information for the City of Middleburg Heights,
Ohio for the fiscal year beginning January 1,2026 has been prepared and presented to the
Council: and,
WHEREAS, Council, after due consideration, desires that the said Alternative Tax
Budget Information be adopted;
NOW THEREFORE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MIDDLEBURG HEIGHTS, CUYAHOGA COUNTY, STATE OF OHIO:
Section 1: That the Alternative Tax Budget Infonnation of the City of Middleburg
Heights, Ohio for the fiscal year beginning January 1, 2026 be and the same is hereby
adopted and placed on file with the Director of Finance.
Section 2: That the Director of Finance be and is hereby directed to forward a copy of
said Alternative Tax Budget Information to the Budget Commission of Cuyahoga
County, Ohio, at the earliest possible time.
Section 3. That it is hereby found and determined that all formal actions of this
council concerning and relating to the passage of this resolution were adopted in an open
meeting of this council, and that all deliberations of this council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements including chapter 107 of the Codified Ordinances
and section 121.22 of Ohio Revised Code.

A RESOLUTION
TO ADOPT THE SOLID WASTE MANAGEMENT PLAN FOR THE
CUYAHOGA COUNTY SOLID WASTE MANAGEMENT DISTRICT
WHEREAS, the City of Middleburg Heights is located within the jurisdiction of the
Cuyahoga County Solid Waste Management District (District); and
WHEREAS, the Cuyahoga County Solid Waste Management District Policy Committee
prepared and adopted a final draft of the Cuyahoga County Solid Waste Management
Plan Update in accordance with Ohio Revised Code Sections 3734.53, 3734.54 and
3734.55; and
WHEREAS, the District provided a copy of the Cuyahoga County Solid Waste
Management Plan Update (2026-2040) for ratification to each of the legislative
authorities of the District; and
WHEREAS, the City of Middleburg Heights must decide whether it approves of said
Solid Waste Management Plan Update no later than August 10, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE OOUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: The City of Middleburg Heights approves the Cuyahoga County Solid
Waste Management Plan Update.
Section 2: That the Clerk is hereby directed to send the District a copy of this
resolution to the attention of Elizabeth Biggins-Ramer, Executive Director, Cuyahoga
County Solid Waste Management District, 4750 East 131 Street, Garfield Heights, OH
44105.
Section 3: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.

A RESOLUTION
EXTENDING A TEMPORARY MORATORIUM ON VAPE AND SMOKE
ESTABLISHMENTS OR SHOPS WITHIN THE CITY OF MIDDLEBURG HEIGHTS
AND DECLARING AN EMERGENCY
WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised
Code, municipalities have the power to enact planning and zoning laws that are for the
health, safety, welfare, comfort, and peace of the citizens of the municipality, including
restricting areas used for business and trade; and
WHEREAS, on April 23, 2024, this Council passed Resolution 2024-32 establishing a
temporary moratorium on Vape and Smoke Establishments or Shops within the City of
Middleburg Heights; and
WHEREAS, this Council desires to extend the moratorium, for a temporary period of
time to further undertake a review of information on the effects of vaping and e-
cigarettes and a review and/or study of the ordinances of the City of Middleburg
Heights, includingzoning, building, and business regulations; and
WHEREAS, this Council will be able to enact reasonable regulations to protect the
health, safety, welfare, peace, and comfort of the citizens of the City of Middleburg
Heights more effectively if a moratorium is in place.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MIDDLEBURG
HEIGHTS, STATE OF OHIO, AS FOLLOWS:
Section 1: That this Council hereby extends the temporary moratorium, for a period
of six months from the effective date of this resolution, that the City shall not accept,
process, or approve any new applications or issue any new permits, licenses,
variances, or any zoning applications from or for vape/smoke establishments or shops
within the City of Middleburg Heights.
Section 2: It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Resolution were adopted in an open
meeting of this Council, and that all deliberations of this Council and any of its
committees that resulted in such formal actions were in meetings open to the public, in
compliance with all legal requirements, including Chapter 107 of the Middleburg
Heights Code and Section 121.22 of the Ohio Revised Code.
Section 3: That this Resolution is hereby declared to be an emergency measure
immediately necessary for the preservation of the public peace, health, safety, and
welfare of said City, and for the further reason that this measure is necessary in order
to establish this temporary moratorium as soon as possible. Wherefore, provided this
Resolution receives the affirmative vote of at least two-thirds (2/3) of the members of
Council it shall take effect and be in force immediately upon its passage and approval
by the Mayor.
