MINUTES OF THE MEETING Wednesday, June 19, 2019 9:15 a.m. Room B-19, Municipal Building MCA Subcommittee: Public Art Commissioners Charlotte McCoid, Joyce Kirkpatrick, Pamela Steele, Charlotte McCoid arrive at 9:35 a.m., Kisha Michael, Staff 1. Call to order a. The meeting was called to order by Joyce Kirkpatrick, Chair pro tem, at 9:27 A.M. 2. Public session a. No one from the public was present 3. Discussion of request from Zipf family a. Discussion of Zipf family request to purchase the Abby Carter painting in the City Art Collection followed. It was decided to recommend that the paining was not available for sale, but that a printed copy of it might be possible if desired by the Zipfs. 4. Policy suggestions for purchasing and borrowing a. The committee recommends establishment of policies about i. Selling works from the City Art Collection ii. Borrowing works from the City Art Collection iii. And that the policies be established by the City upon recommendation of the Commission on the Arts 5. Discussion of rights of ownership a. Copyrights were then discussed. Kisha consulted with Kori Termine Wisneski, Deputy General Council. She recommended that, since no contract between the City and the artist was made when the painting was purchased, future purchases have a Purchase & Sales Agreement or Contract spelling out the rights of the Artist and those of the City regarding ownership; copyrights; intellectual property rights. In this case, Kori advised the Subcommittee to ask the artist. The Subcommittee called Abby Carter and explained the possible need for permission to make a copy of the “Carmela” painting. She immediately agreed, and will send a document via email to the Arts Office. 6. Any further business a. Work with city departments to i. Establish policies for purchase and borrowing CAC works of art ii. Design a contract that spells out such rights for future purchases 7. Adjournment a.
