Present: Brian Gartner Joseph Carta Paul Dyka David Pritchard Jennifer Greenberg Fred Terrasi Jack Piper Trevor Davis Ken McClellan Steve Skultety Absent: David Pritchard Kristen Rzasa Jammie Middleton Public: Domenic DiMartino, Dave Carson, PE, and 19 members of the public Staff: James Sipperly, Environmental Planner A. Call to Order J. Carta, Chairman called the meeting to order at 7:01 pm and led the Pledge of Allegiance. J. Carta, Chairman stated that before we start I need compelled to bring something up. He has been made aware that an application coming up before this commission was mentioned on social media sites. An agenda of the meeting was posted as well and he hopes that the person who posted it was not a member of this commission or the Planning and Zoning Commission. There were also a lot of comments and replies that were not accurate, false and deceptive, and he is bothered by that. J Carta said that this is the way it works. When an application is submitted, the commission has to accept it. Then the commission has to decide if a public hearing is required. The public can petition for a public hearing with 25 signatures. B. Public Hearing None C. Old Business 1. Request to place millings /gravel to park 20-50 cars for a new used car dealership within the upland review area at 1397 Newfield Street. Applicant /Agent: Joshua Freeman/Freeman Page 1 of 3 Enterprises LLC. The applicant is not in attendance tonight. J. Sipperly stated that a basic plan was submitted and told the applicant that it would have to be designed by a professional engineer. Nothing was ever submitted. Motion: To deny the application without prejudice. Moved by K. McClellan; seconded by F. Terrasi Approved unanimously. 1. D. New Business 1. Request for Kaplan Drive access to construct two identical four story apartment complex buildings at Map-Lot: 10-0147 Mile Lane. Applicant/Agent: D&V Development of Middletown, LLC 2023-6 Dave Carson, PE, explained that the plans have been changed as a result of comments made on the last application, prior to it being withdrawn. A supplemental document was also received and new drainage calculations. Motion: To accept the application and to schedule a public hearing for July 5, 2023. Moved by K. McClellan; seconded by J. Greenberg, approved unanimously Discussion ensued regarding setting a date for a field trip. Several dates and times were discussed. Motion: To set a field trip for July 8, 2023 at 10:00am. Moved by B. Gartner; seconded by K. McClellan, approved unanimously. J. Sipperly noted that this field trip is a public meeting and the public is invited and encouraged to attend. J. Sipperly stated that signs will be installed like last time and the abutters will be notified by certified mail. E. Agency Review None F. Reports of Officers and Committees J. Sipperly reported that he has visited, Big Y, Wesleyan dirt pile, Phedon Parkway and Pameacha Pond sewer project. G. Public Open forum None H. Minutes of May 3, 2023 The minutes were reviewed. Comments, K. McClellan would like the “D” off his last name on page 4. Motion: To approve the minutes of Ma3, 2023 as amended. Moved by B. Gartner; seconded by T. Davis, vapproved unanimously with S. Skultety abstaining. I. Communication and Bills J. Greenberg finished revising the wetland regulations but the subcommittee has not met yet. Correspondence received from the Pond and Lake Connection that West Lake Pond will be treated on 5/31/23 as well as Sliders Bar and Grill Pond; and Butternut Park Pond on 6/5/23 Page 2 of 3 J.
