Present: Joseph Carta Paul Dyka Fred Terrasi Jack Piper Trevor Davis Ken McClellan Kristen Rzasa Absent: David Pritchard Kristen Rzasa Jammie Middleton Brian Gartner Jennifer Greenberg Public: Domenic DiMartino, Dave Carson, PE, George Logan, soil scientist, Rich Reynolds, PE, Lenny Leibenhaut and 17 members of the public Staff: James Sipperly, Environmental Planner A. Call to Order J. Carta, Chairman called the meeting to order at 7:03 pm and led the Pledge of Allegiance. B. Public Hearing 1. Request for Kaplan Drive access to construct two identical four story apartment complex buildings at Map-Lot: 10-0147 Mile Lane. Applicant/Agent: D&V Development of Middletown, LLC, 2023-6 Joe Carta explained the rules of the Public Hearing and requested comments only be made regarding wetland issues. J. Sipperly verified that the meeting signs were up and that the certified mail cards were received. Dave Carson, PE presented the plans in detailed. D. Carson explained the changes to the plans from the last application and requested that all the previous application’s plans, reports, minutes and staff comments be incorporated herein by reference. Mr. Sipperly noted that for the record and stated that this is a common request for larger applications. Page 1 of 4 Mr. Carson discussed the feasible and prudent alternatives. Mr. Carson also discussed the revised wetland enhancement plans. Joe Carta read a letter from Ashley Rivera. J. Sipperly read a letter from the Scaliola family at 601 Mile Lane. Davis Winkle 418 Mile Lane had concerns about the retention of stormwater on the site and discussed the cull tech units being used. Kathryn Kennedy Castanea court talked about displaced wildlife. John Cooper 237 Mile Lane discussed wildlife issues. David (?), farmer 987 Newfield Street, concerned about stormwater flowing and flooding his property and stated that the soil is all clay and all the runoff goes into West Swamp Brook. Emily Smith, 283 Mile Lane, concerned about destroying the natural environment of the neighborhood and impact their lives forever. Leonard Brooks, Mile Lane stated these houses already flood and knows that they shouldn’t have been built. He doesn’t want garbage and salt and sand in the wetlands. Mike Rigelski, 317 Bichwood Drive, submitted pictures of his flooding problems at the previous meeting there is continued flooding and it is worse. Ronald McDonald 806 Ridgewood Road. Also spoke about flooding problems and it getting worse. Felisha Randall 20 Mulberry Lane, spoke about all the flooding up and down Mile Lane now. Stew Lapiere, 707 Ridgewood Road asked about the species of special concern and about the wetland commissioner site visits. Glen Chamberlain 94 Mile Lane asked the developer to find another place to build, not here. J. Carta opened up questions from commissioners. K. Rzasa asked about the revised distances from the retaining wall and the wetlands. J. Carta recommended holding off on questions for the applicant until after the field trip. Motion: To continue the Public Hearing until August 2, 2023. Moved by K. McClellan; seconded by T. Davis; approved unanimously C. Old Business None Page 2 of 4 1. D. New Business Request to construct an indoor and outdoor pickleball court facility at Industrial Park Road, Map-Lot 05-0052 in the IT Zone. Applicant/Agent Tall Properties, LLC/Lennie Leibenhaut. 2023-7 L. Leibenhaut explained the concept of the project and the history of pickleball courts. Rich Reynolds, PE discussed the site plan in detail and the impacts to the existing detention basin. J. Sipperly indicated that that the existing detention basin will be filled in and a new one created constitutes a significant activity and recommended the Commission schedule a public hearing. Motion: To accept the application and schedule a public hearing on this application for August 2, 2023; moved by K. McClellan, seconded by J. Piper; approved unanimously E. Agency Review None F. Reports of Officers and Committees J. Sipperly reported that he has visited, Big Y site, Phedon Parkway and Pameacha Pond sewer project. Regarding Phedon Parkway, the lining of the watercourse was to be river rock, a decorative stone, but it can’t be found. J. Mazzotta would like to use rip rap from Suzio quarry. The commission concurred that this would be allowed and staff recommended it as well. G. Public Open forum H. Minutes of June 7, 2023 The minutes were reviewed. No comments or corrections. Motion: To approve the minutes of Ma3, 2023 as amended. Moved by K. McClellan; seconded by K. Rzasa approved unanimously I. Communication and Bills Correspondence received from the Pond and Lake Connection that West Lake Pond will be treated on 6/26/23 as well as Veteran’s Pond on 6/26/23 J. Adjournment Motion to adjourn at 8:55pm Moved by K. Rzasa; seconded by K. McClellan approved unanimously.
