Winckle Staff: James Sipperly, Environmental Planner A. Call to Order Chairman J. Carta called the meeting to order at 7:02pm and led the Pledge of Allegiance. B. Public Hearing None C. Old Business 1. Request to install an 18’x36’ in ground pool with a 1,100sq.ft. concrete patio within the upland review area at 326 Brush Hill Road. Applicant/Agent: Aquatic Pool & Spa. 2023-9. David Dimartino the homeowner presented the plans. He is proposing to install a 18’x 36’ in ground pool behind the existing house. There were questions on the grade and proposed silt fence and haybayles. Motion: To approve the proposed pool as shown on the plans with the standard 16 stipulations. Moved by K. McClellan; seconded by P. Dyka; approved unanimously. 2. Modification application request of an existing wetlands permit #18-16+ granted on March 6, Page 1 of 4 2019, Applicant/ David Coleman – Hillside Investments. 2023-10 Staff gave an overview of this request. The project has been down sized considerably with less impacts to the wetlands on site. D. Coleman presented the concept in detail. A new detention basin will be added as a result of the site changes. Because of this change, the Commission requested a review by the City Engineer. A memo dated September 15, 2023 from Tom Nigasanti had four comment items that staff read into the record. All four comments were addressed by the applicant’s engineer Solli Engineering in a letter dated October 4, 2023. K. McClellan had questions regarding the pipe and drainage near the road. J. Carta had questions regarding the wooded watercourse. Those questions were addressed by D. Coleman Motion: To approve the modification request of Hillside Investments application 2023-10 as presented with the standard 16 stipulations and stipulation 17 is to require a bond for erosion and sedimentation control measures calculated by the City Engineer. Moved by J. Middleton; seconded by K .McClellan; approved unanimously 3. Request for a declaratory ruling to construct 2 multi-family buildings with 36 units each, within the 100’upland review area, Newfield Street Apartments- Phase III Applicant / Newfield Residential, LLC. 2023-11 Staff explained that the proposed buildings are just within the 100’ upland review area and that the commission made a determination at the last meeting that a permit would be required. Attorney Meghan Hope explained the history of this project and the need for this request. Ron Bomengen, P.E. explained the project in detail and that they were able to move the buildings outside of the 100’regulated area by shifting the parking and building locations. George Logan, Soil Scientist, explained the wetlands and their function and values. Discussion ensued. F. Terasi had a question about parking lot drainage. T. Davis asked about the square footage and number of units. J. Carta asked about the concrete patio and the drainage outlet. F. Terasi asked about the grading behind the buildings. R. Bomengen answered those questions. Motion: To approve application 2023-11 as revised showing the buildings outside of the 100’regulated area with the standard 16 stipulations including 17 which requires the applicant to submit an erosion and sedimentation control bond. Moved by K. McClellan; seconded by F. Terasi; unanimously approved with T. Davis voting against the motion. D. New Business None E. Agency Review 1. LRE Enterprises (Shelco Filters) new manufacturing facility and corporate offices, Parcel ID# 03-0209, 0 Middle Street (Previous approval granted on November 14, 2014, Permit # 14-12) Gary Dayharsh, representing LRE Enterprises explained the project in detail and stated that this Agency previously granted an approval for a similar wetland crossing years ago in 2014. The project did not move forward at that time. This project is to build a 99,000sqft. building, that will be an office and distribution center for Shelco Filters. Page 2 of 4 Staff requesting that the wetland area where the crossing is being proposed be re-delineated by a soil scientist. An application will be submitted for the next meeting. 2. General Permit Review item: Public Works Department, requests to perform channel maintenance work to address an existing erosion issue that presented itself 2 years ago after a significant storm event. As a result the channel continues to erode. This project will restore the channel bed and prevent further erosion. The project is making use of flexible geotextile fabric for armoring. This will allow the channel to be quickly vegetated and minimize the use of hard armoring. The work will be performed by Derita Construction. Staff reported on this item in detail and showed maps of the project area. K. McClelllan said that the work should be done in low flow conditions in the proper summer months. J. Carta would like staff to be present when the work is being done. Motion: To allow the Public Works Department and their contractor to do this work under the general permit guidelines. Moved by K. McClellan; seconded by T. Davis approved unanimously. F. Reports of Officers and Committees None G. Public Open forum D. Winkle 408 Mile Lane, thanked the commission for its work on the Kaplan Drive Apartments. He also talked about permanently protecting the Red Maple Swamp Property around Laurence School. Staff reported that the conservation commission is working on that. H. Minutes October 16, 2023 regular meeting Motion: To approve the minutes of the October 16, 2023 meeting, with Brian Gartner’s name removed from absent and page 2, 4th paragraph from the bottom: change the second “application” to for commission review. Moved by K. McClellan; seconded by T. Davis; approved unanimously with J. Carta abstaining. I. Communication and Bills J. MIWWA regulation amendments This item will be discussed at the meeting in December. J. Greenberg will send the revisions to the Commission prior to that meeting. K.
