REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION MIDDLETOWN CONNECTICUT MAY 9, 2018 1. Pledge of Allegiance Chairman Devoto called the meeting to order at 7:00 PM with the Pledge of Allegiance 2. Roll Taking Present: Commissioner Stephen Devoto Commissioner Joyce Rossiter Commissioner Richard Pelletier Commissioner Elizabeth Emery Commissioner Tyrell Brown Commissioner Steven Kovach (seated for Commissioner Fazzino) Commissioner Christopher Sugar (seated for Commissioner Salafia) Absent: Commissioner Nicholas Fazzino Commissioner Molly Salafia Commissioner Thom Pattavina Staff: Joseph Samolis, Director of PCD Public: 1 member 3. Items removed from the agenda and why Item #7.2 – Applicant has asked to be tabled to the next meeting. 4. Public comment on items on agenda which are not currently scheduled for a public hearing None 5. ZEO Certification that all public hearing signs have been properly noticed (when scheduled) None 6. Public Hearings (when scheduled) None 7. Old Business 1 1) Request for a 90 day extension of the final approval for the Spring Meadow Estates on Training Hill Road. Applicant/agent The Nevar Company S2017-4 Commissioner Kovach moves for approval for a 90 day extension of the final approval for the Spring Meadow Estates on Training Hill Road. Commissioner Sugar seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. 2) Request for final approval for the two-lot subdivision located at 297 Ballfall Road. Applicant/agent Joseph Mazzotta S2017-1 Commissioner Rossiter moves to table application for a final approval for the two-lot subdivision located at 297 Ballfall Road. Commissioner Kovach seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. 8. New Business 1) Proposed Special Exception to Section 44.08.45 to construct a mixed use development which would include lower floor retail/restaurant and upper floor residential use at 211 South Main Street. Applicant/agent 211 South Main Street LLC c/o Robert Kempenaar II / Attorney Michael Dowley SE2018-3 (Date of receipt 5/9/18; To be scheduled for a Public Hearing) Commissioner Rossiter moves to schedule a public hearing for a Special Exception to Section 44.08.45 to construct a mixed use development which would include lower floor retail/restaurant and upper floor residential use at 211 South Main Street for the May 23, 2018 meeting. Commissioner Kovach seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. 2. Request for a public hearing regarding Section 40 of the Zoning Regulations for review of the parking requirements. Applicant/agent City of Middletown PCD Dept. Z2018-5 (Date of receipt 5/9/18; To be scheduled for a public hearing) Joe Samolis explained the proposal. Commissioner Pelletier moves to schedule a public hearing for application regarding Section 40 of the Zoning Regulations for review of the parking requirements. Commissioner Kovach seconds the motion. The chair calls for the vote. The chair states the matter passes unanimously with 7 affirmative votes. 9. Public comment on topics which are not or have not been the subject of a public hearing Attorney Martin Lipka, property owner of 668 East Street explained that he came before the Commission six (6) months ago regarding concerns that the builder of the subdivision (Ron DeGenarro) did not fulfil his obligations. Nothing has been done in those six months and he cannot get hold of the developer. Property owners are missing the following: 1) pins so they know where their property lines are; 2) drainage pipes to handle water issues; 3) concrete aprons have not been installed; 4) grading is not done to plan specifications (too steep); and 5) missing topsoil. He is looking for the Commission’s help to resolve these issues. 2 Director Samolis explained to the Commission that the City is holding a bond for $30,000 to complete the work. If the work is not done within a certain amount of time, the City can pull that bond to finish the work for the betterment of the homeowners. He will reach out to the City Engineer, Tom Nigosanti. 10. Minutes of the Regular Meeting, Transcripts, Staff Reports and Commission Affairs 10.1 Minutes of March 14, 2018, March 28, 2018 and April 11, 2018 Commissioner Rossiter moves for approval of the minutes of March 14, 2018. Commissioner Kovach seconds the motion. The chair calls for the vote. The Chair states the matter carried with 6 affirmative votes and 1 abstention. Commissioner Rossiter moves for approval of the minutes of March 28, 2018. Commissioner Kovach seconds the motion. The chair calls for the vote. The Chair states the matter carried with 6 affirmative votes and 1 abstention by Commissioner Emery. Commissioner Rossiter moves for approval of the minutes of April 11, 2018. Commissioner Kovach seconds the motion. Director Samolis suggests tabling the minutes of 4/11/18 as there are some corrections. Commissioner Rossiter withdraws the motion. The chair calls for the vote. The Chair states the matter carried with 7 affirmative votes. 10.2 Other Commission Affairs a. River-Cog Report Commissioner Emery stated that RiverCog is still moving forward with Regional Planning, Conservation and Development. They should have a full document in the next couple of months. 11. Adjournment Commissioner Rossiter moves to adjourn at 7:23 PM.
