The meeting was held both virtually and in -person. Members of the public had access via
https://webex.com, the WebEx application, and via telephone.

8.1. Request for an affirmative GS 8-24 report for a new commercial lease for Cloak Tactical
Performance Physical Therapy, LLC at the R.M. Keating Historical Enterprise Park, 180
Johnson Street. Applicant/Agent: Christine Marques/Economic and Community
Development. GS 8-24 2024-19.
Director Kozikowski presented the application on behalf of Director Marques. This application is for a
five year lease with a five year renewal option. They are looking to occupy one thousand square feet on
the second floor of the building for a physical therapy business. It’s consistent with other uses that have
been placed in the building.
Motion for a positive GS 8-24 report.
Moved by Commissioner Spencer, seconded by Commissioner Emery
Passed unanimously: 7-0.
8.2. Executive Session- Approving the Planning and Zoning Commission enter Executive
Session pursuant to the exception set Forth in Section § 1-200(6)(D) of the Freedom of
Information Act to discuss a C.G.S. § 8-24 review of the sale of real estate and the
conveyance of an easement over City property to the State of Connecticut; with the
following City agents, officers, and/or employees invited to attend the Executive Session,
provided such persons’ attendance shall be limited to the period for which their presence
is necessary to present such testimony or opinion: members of the Planning and Zoning
Commission, Staff to the Commission, Director Marek Kozikowski, and Assistant General
Counsel Christopher Forte.
Motion to enter into executive session.
Moved by Commissioner Spencer, seconded by Commissioner Cunningham.
Passed unanimously: 7-0.
Entered Executive Session at 7:11pm.
Exited Executive Session at 8:06pm.
8.3. Recommending an affirmative C.G.S. § 8-24 approval for the sale of real property and
conveyance of a maintenance easement to the State of Connecticut. GS 8-24 2024-20.
Commissioner Giuliano made a motion to postpone this item to a special meeting to be held at 7pm one
week from tonight and that the item be revised to include the location of the property and the proposed
use, seconded by Commissioner Pylant.

Commissioner Pattavina stated that there will be a special meeting on Wednesday, October 16 at 7pm.

Motion to approve the September 25, 2024 regular meeting minutes.
Moved by Commissioner Spencer, seconded by Commissioner Cunningham.
Passed unanimously: 7-0.

10.3. Staff Report
Director Kozikowski informed the commission that the next meeting in November is the election of
officers. The November meeting will be a very busy meeting with a number of applications and public
hearings.
10.4. Commission Affairs
Commissioner Giuliano stated that Commissioner Emery raised a concern about what do we do when
this Chamber is not available. Theoretically, we can meet somewhere else, however this is the only
place you can broadcast from. Since the Council Chambers has been designated as an early voting place,
it affects every board and commission in the city. What are we going to do about it for the Planning and
Zoning Commission?
Commissioner Emery asked if it’s State Statute that mandates the amount of time the commission has to
settle items on the agenda.
Director Kozikowski answered yes, its State Statue driven. An 8-24 application has thirty-five days for
the commission to act on from the date of receipt.
Commissioner Emery suggested notifying the State their concerns over the time limitations for acting on
an 8-24 application in light of early voting mandates.
Director Kozikowski will draft a letter signed by the Chair on behalf of the commission expressing this
concern.
