3. Items removed from the Agenda
Director Kozikowski stated that items 6.1 and 6.2 were removed from the agenda. The applicant withdrew
the zoning text amendment application for allowing cannabis retail in the B-1 zone and the special exception
application to open a cannabis store at 428 Main Street.

6. Public Hearings
6.3 Request for a resubdivision to create two (2) lots from an 11.59 acre property located at 44
Chamberlain Hill Road in the R-60 zone. Applicant/Agent: Elena Ling. S2025-3.
Caroline O’Hagan, Indigo Land Design, presented the application. Ms. O’Hagan explained that this is
only for a re-subdivision of the property. They did show on the site plan a possible house, well, and
septic on the proposed new lot. The new lot will be 2.92 acres. Both lots will be conforming.
Richard Roberts, 251 Chamberlain Hill Road, asked where will they make the curb cut for the driveway.
Bartholomew Road is heavily traveled. Mr. Roberts has no objection to the plan. He is just concerned
for public safety.
Ms. O’Hagan responded to Mr. Roberts’ question. She explained that everything that is represented on
the new lot is just a possible location for the house. At a later date when they’re ready to apply to build a
home, they will work with the city.

6.4 Request for a resubdivision to create six (6) lots from a 3.49 acre property located at Talias
Trail (Map-Lot: 10-0219) and Ridgewood Road (Map-Lot: 10-0028) in the R-15 zone.
Applicant/Agent: Robert Wiedenmann/Sunwood Development Corp. S2025-5.
Robert Wiedenmann, principle owner of Sunwood Development, presented the application. This
proposal is similar to what the commission approved in May of 2022. The property owner at the time
appealed the approval. Now, they have legal access to the road. Thirty-five acres of the property will be
donated to the City as open space. The extension of the road exceeds the limit of the cul-de-sac
requirements. Mr. Wiedenmann asked the commission for a waiver on this. Mr. Wiedenmann also asked
the commission to not make the donation of the land a condition of approval because then he won’t be
able to take a tax deduction on the donation of the open space land.
Motion to close the public hearing.

Commissioner Eckstrom commented that he’s glad the applicant is donating the open space to the City.
The City can use as much open land as it can get.
Motion to waive Section 5.19.06 to allow a cul-de-sac road of 180,000 feet on this project.

6.5 Request for a modification to the Mercy View Subdivision to waive the sidewalk
requirement on Jack English Drive. Applicant/Agent: Coccomo II, LLC. S2016-1.
Thomas Coccomo, 1 Fitzwilliam Park, Farmington, CT, presented the application. Mr. Coccomo
explained that instead of having sidewalks on Jack English Drive, Mr. Coccomo will pave the driveways
of those who haven’t paved their driveways yet.
Director Kozikowski referred to a memo to staff which showed that all of the neighbors agreed to the
sidewalk waiver. Property owners are working on individual contracts to pave their driveways.
Commissioner Emery commented that she will be reluctantly supporting this application. We need the
sidewalks in order for the City to be a much more walkable place, but she will support this for the
neighbors.
Commissioner Pattavina agrees with Commissioner Emery.
Jennifer Shourds, 45 Jack English Drive, expressed her gratitude to Director Kozikowski and Thomas
Coccomo for working with her and her neighbors to resolve the construction issues in the neighborhood.
Joseph Coppola, 65 Jack English Drive, commented on the driveway contracts that the neighbors signed.
They did this to accelerate the completion of the road on Jack English Drive. The issue he has with the
contract is that it doesn’t list a start date or end date. Mr. Coppola would like a lawyer to review the
contract and add basic terms and timelines.
Beverly Kayhill, Newfield Commons, asked why is it an option not to have sidewalks where they are
needed.
Melissa Maceachern, 90 Jack English Drive, reiterated what Mr. Coppola stated. She would like to see
start dates and end dates in the contract.
Mr. Coccomo responded that they’re looking to finish paving the driveways and the road by early to
mid-November.
Motion to close the public hearing.
Moved by Commissioner Emery, seconded by Commissioner Giuliano.
Passed unanimously: 7-0.
Commissioner Giuliano commented that the agreement between the developer and the neighbors should
be more specific so that everyone knows what to expect. Commissioner Giuliano isn’t comfortable
voting on this tonight.
Commissioner Pattavina agrees with Commissioner Giuliano. If they vote tonight it would be just for the
sidewalks.
Mr. Coccomo stated that he has every intention to work with the neighbors and pave the driveways. Mr.
Coccomo has issued a bond for these driveways to be completed.
Motion to approve the modification with the condition that all the items listed in the memo dated
February 24, 2025 be completed and the bond be held until such items have been completed.

Director Kozikowski clarified for the commission that the public hearing for those items have been
combined. If you are to close the public hearing, the commission would have to vote on each application
individually.
6.6 Petition to amend Section 5.6.28 of the Middletown Zoning Code regarding special
exception standards for Rear Lots. Applicant/Agent: Richard D. Carella/Updike Kelly &
Spellacy PC. Z2025-6.
Rich Carella, Updike Kelly & Spellacy, and Stephen Charton, the property owner and civil engineer,
presented the application. This is for an eight-lot subdivision on Arbutus Street. Atty. Carella passed out
a GIS map of the city showing the different zones. The zoning regulations call for R-45 zone regulations
when property in an R-30 zone doesn’t have municipal water and sewer services available. The vast
majority of the R-30 area is without city water and sewer services and is served with well and septic. For
properties in the R-30 that are not served by water and sewer services, the lot size must be a minimum of
45,000 square feet and to comply with the R-45 regulations. They are complying with the R-45
regulations but they can’t use the rear lot provisions because it’s only allowed in the R-45 or R-60 zone.
Mr. Carella explained that they are proposing a text amendment which would allow for rear lots in the
R-30 zone if the proposed lot is required to meet the R-45 zone size criteria. The next change they’re
proposing is the yard requirements. They would like to remove the required double yard requirements
because they’d be complying with the R-45 standard setbacks. This text amendment would affect other
properties in the R-30 zone. According to the POCD, one of the provisions, Connectivity, says that you
should not expand your water and sewer services territory. The other provision in the POCD is to
preserve natural resources. If you require double setbacks, it will push the construction of homes closer
to the natural resources on the property. Arbutus Street is a perfect example.
Commissioner Giuliano commented that this application should be considered separate from the rest of
the applications because it’s not so specific to any one particular subdivision application.
Motion to separate item 6.6 from the combined motion.

Norman Danner, 216 Arbutus Street, asked the commission to carefully consider this text change. This
would open up more land for development instead of keeping it as open space which would be in
opposition of the POCD.
Pamela Deiter-Sands, 689 Arbutus Street, expressed her concern about the development of the back lots.
The ecology of the land will be greatly affected.
Edward Long, 288 Arbutus Street, stated that his house will be in the middle of blacktop. Mr. Long’s
homes elevation is lower than the rest of the property. That means that all the runoff will run into his
property. Mr. Long also spoke about the effect of the development on the ecology.
Nancy Long, 288 Arbutus Street, stated that she would be ok with the homes being built to the sides of
their house, not behind their house. Mr. Charton told Ms. Long and her husband that he wants to build a
family compound. Ms. Long added that her and her husband have maintained that property for twenty-
three years.

Commissioner Giuliano commented that if this property was zoned R-45 we wouldn’t be here tonight.
Atty. Carella stated that the commission will have to deal with this in the R-30 zone for those who want
to subdivide their property that doesn’t have water and sewer. Atty. Carella and Mr. Charton showed a
concept plan for a fourteen lot subdivision with a road in which the water and sewer lines were
extended. If the property was developed in this way, the owner would have to sell all those properties
and not allow the owner to do what he wants with the property and that’s to have a family compound.
Commissioner Giuliano clarified that the proposal that is being brought forward tonight is treat an R-30
zone without water and sewer as an R-45.
Atty. Carella stated that he thinks the code requires that right now. We’re trying to make that allowable.
The code is at odds with itself.
Commissioner Giuliano stated that the whole reason of treating R-30 without water and sewer as R-45 is
environmental. The larger lots are required to support wells and septic tanks without contaminating each
other. This falls within an oversite within the code that needs to be corrected. The current language of
the code is going to be an invitation to a lawsuit someday.
Atty. Carella said that if we have to use the R-45 standards, we should be able to use all of the R-45
requirements.
Norman Danner, 216 Arbutus Street, this oversite should be verified. The POCD actually limits
development in areas that don’t have water and sewer services.
Pamela Dieter-Sands, 689 Arbutus Street, stated her agreement with Mr. Danner’s comments. Ms.
Dieter-Sands added that it seems in this conversation we’re only talking about how many houses can fit
on this property. There isn’t a discussion yet on whether there should be many houses fitting on this
property.
Director Kozikowski highlighted some of the staff comments prepared by Gary Middleton, Assistant
City Planner, approved by Director Marek Kozikowski. In 2003 the Planning and Zoning Commission
issued a moratorium on subdivisions in response to a rapid growth of subdivisions. At that time, rear lots
were allowed in all R zones. The commission then amended the zoning code eliminating rear lots in the
RPZ, R-15, and R-30 zones. If this current proposed amendment is approved, there could potentially be
about one hundred special exception applications for rear lots in the R-30 zone. Back lots disturb backs
of properties. The R-45 standards needs to be followed in any R zone that doesn’t have access to city
water and sewer. It’s not unique to the R-30 zone. The zone is fixed to the land. If the land is in the R-30
zone it’s not in the R-45 zone. There were comments about a conceptual plan. It’s not clear if it meets
criteria. This concept would require the extension of water and sewer services. It would be assumed that
the Water and Sewer Commission and the Planning and Zoning Commission would have approved the
plan. In the 2020-2030 Plan of Conservation of Conservation and Development, in the Connected
chapter, it has a goal: A sewer service area limited to the core. Director Kozikowski read into the record
the text under that title. Director Kozikowski asked the commission to be cognizant of your decision.
This will affect the City as a whole.
Atty. Carella doesn’t disagree with his reading of the POCD. We’re stuck here in an area south of the

water and sewer service area in an R-30 zone that’s required to develop to R-45 standards. We don’t
want to bring the sewer line down. This is a low density subdivision. We’re not putting in a road or
sidewalks. This petition does meet the goals of the POCD.
Commissioner Giuliano stated that if the applicant came to the City and asked to extend the water and
sewer lines, at the applicant’s expense, to where they wanted to develop it in accordance with the R-30
zone requirements, and for the City to say no to that, that’s a lawsuit. If the zoning code is saying if
you’re in the R-15 or R whatever and you don’t have water and sewer you have to abide by at a
minimum the R-45 standards, then you should be able to do what the R-45 says you can do.
Director Kozikowski clarified a zoning language interpretation. If a lot in the R-30 zone doesn’t have
water and sewer, if it’s required to meet the R-45 criteria, it should be allowed to develop. However a lot
in R-45 is allowed to be developed. Director Kozikowski asked Commissioner Giuliano if any use
allowed in the R-45 zone but not currently allowed in the R-30 zone, would that use be allowed.
Commissioner Giuliano responded you’re talking about a subdivision for single family uses. The code
doesn’t mention uses.

Director Kozikowski stated that the code mentions lots not residential lots.
Atty. Carella stated that we’re not talking about uses, we’re talking about setbacks and the size of the
lot.
Commissioner Giuliano commented that the property will be developed. It’s just a matter of do you
want eight lots that includes rear lots or do you want fourteen smaller lots? Something is going to
happen there.
Commissioner Emery expressed her concerns about residents in this area so they don’t have driveways
on all four sides of their property. That doesn’t seem fair. Also, who is responsible for the wells if the
quality of the well water changes?
Director Kozikowski responded to the water quality of the wells. The Health Department tests the
quality of the soils and the ability to create a well. Once the Health Department approves the well, there
is most likely an inspection of the well after it’s been installed. Any type of issue with an adjoining lot
would be a civil matter between property owners. In regards to driveways, the best way to address the
problem is to regulate lot shapes and frontages which is the responsibility of this commission.
Commissioner Giuliano commented that rear lots are still special exceptions. If somebody proposes
driveways all over the place, we can tell the applicant to reconfigure the plan.
Steve Kalber, 339 Arbutus Street, stated that when he first came here tonight, he had no issue with Mr.
Charton developing this land but after hearing Mr. Long’s comments. Mr. Long purchased his house in
an R-30 zone. He never considered his backyard would be considered an R-45 zone. If his well fails, Mr.
Long has to take legal action because the Planning and Zoning Commission approved this amendment?
That doesn’t seem fair. Mr. Charton does have a right to develop his land, but develop it in the way that
it’s zoned, R-30.

Commissioner Pattavina commented that the fourteen house subdivision concept would be the
development for the R-30 zone.
Director Kozikowski stated that the property owner does have the ability to develop it under the R-30
zone which would be a four lot subdivision with no water and no sewer service.
Edward Long, 288 Arbutus Street, has a problem with the rear lots. It’s not fair to him and the animals
in the area.
Jennifer Scott, 216 Arbutus Street, the space is a beautiful area. This will completely change the area.
Atty. Carella stated for the record that they’re trying to develop this property in a way that meets the
Plan of Conservation and Development. Mr. Charton went around to all the neighbors to get signatures
that support the eight lot subdivision as opposed to the fourteen lot subdivision. This amendment will
make the zoning code more clear.
Commissioner Giuliano stated that this won’t go away and somebody is going to challenge this. This
text change clears up the ambiguity. The applicant’s plan for a rear lot still need to make sense in light
of the Plan of Conservation and Development. The text change is not a bad idea.

Commissioner Giuliano stated that he will support this text amendment. It solves more problems that it
creates. We’re just clearing something up that is unclear.

6.7 Request for a subdivision creating eight (8) lots from a 17.6 acre property located at
Arbutus Street (Map-Lot: 38-0183) in the R-30 zone. Applicant/Agent: Richard D.
Carella, Esq/Updike, Kelly & Spellacy PC. S2025-4.
Atty. Carella stated that there will be a few changes to the driveways per the comments earlier.
Stephen Charton, 154 East Ridge Road, continued with the presentation. Mr. Charton explained that this
is a family compound of sorts. We’re proposing an eight lot subdivision with each lot having their own
driveway. In response to Mr. Long’s concerns about runoff draining into their property, Mr. Charton
will pitch the driveway to the south. On the back lots, they’re looking to construct more towards the
front of the properties so as to leave more open space in the rear of the properties.
Atty. Carella continued with the presentation stating that the lots in the front are all 45,000 square feet.
The rear lots are all 80,000 square feet. Lot five and six will combine the driveways. They can combine
the driveways of lots two and three. There will be a required vegetative buffer between the rear lots and
the front lots.

Edward Long, 288 Arbutus Street, pointed out on the site plan his driveway and lot six’s driveway are
right next to each other. Mr. Long suggested adding the lot six driveway to the lot five driveway and
eliminate the driveway next to his.
Michael Cubetta, stated that in his discussions with Mr. Charton on driveways, it is at odds with what is
being presented tonight.
Mr. Charton stated that Mr. Cubetta is correct. Mr. Charton wanted to have separate driveways for
everyone. If the commission wants driveways combined, he is fine with that.
Commissioner Pattavina asked Mr. Charton if he would be willing to move his driveway as suggested
by Mr. Long.
Mr. Charton responded that moving the driveway won’t solve the runoff issue.
Commissioner Giuliano commented that he would like to minimize the number of driveways. The large
space in the rear of the property, would you be opposed to a conservation easement over that area?
Mr. Charton responded isn’t against that suggestion.
Mr. Carella doesn’t think putting a conservation easement as a condition of approval would be a
problem.
Mr. Charton explained that he will address the additional runoff. Mr. Charton also conducted a drainage
study of the area.
Director Kozikowski asked if the commission wants a conservation easement, who is the benefactor of
the easement? Would it be to the City or Homeowner’s Association?
Mr. Charton answered it would either go to the City or just put restrictions on the area and have it
remain privately owned.
Director Kozikowski asked what the boundary of this conservation easement will be.
Mr. Charton showed where the conservation easement would be.
Motion to continue the public hearing for items 6.7, 6.8, 6.9, 6.10, and 6.11.

Brendan Geraghty, 62 Loveland Street, Transit Planner for River Valley Transit, presented the
applications. CT DOT is working with River Valley Transit on this project. Mr. Geraghty discussed the
different locations as to where they are proposing the bus stop passenger shelters. These will be ADA
compliant. These bus shelters are within the POCD.
Ron Scheffer, 11 Long Lane, commented that the River Valley Transit is doing a great job. Mr. Scheffer
is a long time bus rider. Having bus shelters will make a difference. He is in support of these
applications.

Commissioner Giuliano commented that these locations all make sense. Can bus riders still flag the bus
down anywhere?
Mr. Geraghty responded riders can flag down the bus anywhere. These passenger shelters will focus
that.
Commissioner Pattavina asked if this is the first phase and will there be more bus shelters proposed?
Mr. Geraghty responded this is the first phase with the State of Connecticut funding. They do plan to
have more bus shelters.
Commissioner Emery asked about trees. Is there any possibility to add trees to the FedEx location?
Mr. Geraghty responded that’s a good idea. Trees aren’t on the list but it’s a good thought.

Director Kozikowski presented the application. He started by stating that the agenda item description for 8.4
lists the wrong application number. S2022-6 should be S2025-1. Director Kozikowski explained that the
deadline for filing the Mylar is July 1, 2025. The commission does have the authority to grant the extension
time up to ninety days.

10.2. RiverCOG Report
Commissioner Emery reported RiverCOG met on Monday. The good news was the Governor has vetoed
PA 5002 as far as RiverCOG is concerned. Commissioner Emery stated that she felt this was unrealistic
particularly for the small towns. She thinks they did the right thing. There are things they need to change
in the bill.
10.3. Staff Report
Director Kozikowski reported on July 9th there will be a subdivision application and special exception
application for an historic preservation use converting St. John’s School into sixteen apartments. Four
units would be deed restricted for affordable housing. These will be public hearings.
10.4. Commission Affairs
Commissioner Giuliano commented on the Bartholomew Road truck repair business. The large trucks
that are going in and out of the site are impeding traffic. The sign is terrible, the gates are not
maintained, and there isn’t any buffering to the residential areas.

Director Kozikowski stated that they can investigate from a zoning enforcement standpoint.
