REGULAR MEETING OF THE ZONING BOARD OF APPEALS MIDDLETOWN CONNECTICUT DECEMBER 12, 2019 1. CALL TO ORDER 2. ROLL CALL Present: Gary Middleton Judy Pehota Dina For Nick Ficaro (seated as a regular member) Jonathan Pulino (arrived at 5:55 PM) Absent: Linda Reil Brandon Chafee Kevin Brignole Staff: Ron Baia, ZEO & WEO 3. MINUTES of September 5, 2019 and November 7, 2019 Regular Meeting The minutes of September 5, 2019 have been tabled to the next meeting. Dina Ford moves for approval of the minutes of the regular meeting of November 7, 2019. Nick Fazzino seconds the motion. The chair calls for the vote. It is unanimous to approve with 4 aye votes. The chair states the matter passes unanimously with 4 affirmative votes. 4. OLD BUSINESS None 5. NEW BUSINESS 1. Request for a favorable G.S.14-54 Review for location approval for sale of used cars at 1075 Newfield Street. Applicant/agent Mevlut Akkoyum G.S.14-54 2019- 6 John Moore represented to applicant. He said that Mr. Akkoyum just purchased this property and needs the Board to sign off for the transfer of ownership for 1075 Newfield Street. Judy Pehota moves to close the public hearing. Dina Ford seconds the motion. The chair calls for the vote. It is unanimous to approve with 4 aye votes. The chair states the matter passes unanimously with 4 affirmative votes. Judy Pehota moves for a favorable G.S.14-54 Review for change of ownership for sale of used cars at 1075 Newfield Street. Dina Ford seconds the motion. The chair calls for the vote. It is unanimous to close public hearing with 4 aye votes. The chair states the matter passes unanimously with 4 affirmative votes. 6. PUBLIC HEARING 1. Continued: Request for a variance to Section 12.4 to keep dwelling behind 459 East Main Street as residential. Applicant/agent Fikret Cecunjanin ZBA2019-10 Fico Cecunjanin represented the application. He explained that they purchased a few buildings in the area and there is an 800 sq. ft. building in the rear with separate utilities. He would like to build it up for rental so to keep the area clean. Gary Middletown said it doesn’t look like a residential place to him. Fico said there was previously a bathroom and kitchen area. Judith Pehota asked staff if there was any possibility to have 2 separate residential properties on one lot. She asked Fico if this was ever taxed as a separate home. He said he didn’t know. He feels that it would be a much safer area if there were tenants in the building. Dina Ford moved, seconded by Nick Ficaro to close the public hearing for a variance to Section 12.4 to keep dwelling behind 459 East Main Street as residential. The chair calls for the vote. It is unanimous to close public hearing with 4 aye votes. The chair states the matter passes unanimously with 4 affirmative votes. A discussion ensued among the Board. Dina Ford noted that there is proof that the applicant did notify the abutters and nobody came tonight to speak against it. Judy Pehota said you cannot have 2 separate houses on one lot. Nick Ficaro said that what was presented tonight does not fit the hardship requirements. Gary Middletown agrees with Nick in that it does not meet the requirements. They would have to prove with evidence that it was at one time used as a residence. Gary Middletown told the applicant that there are not enough votes to approve at this time and is giving the applicant the chance to withdraw his application. If he would like to look into it more and see if it was ever used as a residence, he can come back with a new application. Fico Cecunjanin withdraws the application. 2. Continued: Request for a G.S.14-54 location approval for a general repairer at 804 Washington Street. Applicant/agent Washington West LLC and Bridgestone Retail Operations LLC. ZBA2019-11 Gary said that the Board received a request by the applicant that this application be tabled until the February 6th meeting. 7. ADJOURNMENT Dina Ford moves for adjournment at 5:57 PM. Judy Pehota seconds the motion. The chair calls for the vote. It is unanimous to adjourn with 4 aye votes. The chair states the matter passes unanimously with 4 affirmative votes.
