NOTICE OF A REGULAR MEETING OF THE GOVERNING BODY OF THE CITY OF MIDLOTHIAN, TEXAS TUESDAY, AUGUST 11, 2026 Pursuant to the provisions of Chapter 551 VTCA Government Code, notice is hereby given of a Regular Meeting of the Midlothian City Council, to be held in the City Council Chambers at Midlothian City Hall, 215 North 8th Street, Midlothian, Texas. The regular meeting may be viewed online at www.midlothian.tx.us/watchlive. REGULAR AGENDA 6:00 P.M. Call to Order, Pledges, and Invocation 2026-254 Announcements/Presentations A. Receive a presentation on the status of the Recreation Center bond project. B. City Council report on items of community interest. 2026-255 Citizens to be heard - The City Council invites citizens to address the Council on any topic not already scheduled for a Public Hearing. Citizens wishing to speak should complete a “Citizen Participation Form” and present it to the City Secretary prior to the item being opened for discussion. Speakers are limited to 3 minutes. In accordance with the Texas Open Meetings Act, the City Council cannot act on items not listed on the agenda. However, your concerns may be addressed by City Staff, placed on a future agenda, or responded to by some other course. Citizens not attending in person may submit comments on our website at www.midlothian.tx.us/Participate. CONSENT AGENDA All matters listed under Consent Agenda are considered to be routine by the City Council and will be enacted by one motion without separate discussion. If 2026-256 discussion is desired, that item will be removed from the Consent Agenda and will be considered separately. A. Consider and act upon minutes from the City Council meeting of July 28, 2026. B. Consider and act upon a resolution adopting the updated City of Midlothian Emergency Management Plan – Basic Plan to meet new Texas Division of Emergency Management planning standards for Emergency Support Function alignment. C. Consider and act upon a resolution authorizing the 2026 Heritage Day, an event hosted by the Midlothian Downtown Business Association, scheduled for Saturday, October 31, 2026, in accordance with a Special Event Permit as established by the City of Midlothian Zoning Ordinance 2013 24, as amended, Section 2.04 (Use Table) (Case No. SEP20 2026). D. Consider and act upon an ordinance amending the City of Midlothian’s Fiscal Year 2025-2026 Midlothian Community Development (MCD) Fund Budget Appropriations in an amount not to exceed $2,000,000 from the Unreserved Fund Balance to provide to the City of Midlothian the first portion of the costs associated with Heritage Plaza improvements in an amount not to exceed $2,000,000. PUBLIC HEARINGS 2026-257 Conduct a public hearing and consider and act upon an ordinance amending and restating the development and use regulations of Planned Development District No. 184 (PD-184) for 16.24+ acres out of the Martha Brenan Survey, Abstract No. 43. The property is generally located on the west side of S. 14th Street, and north of McAlpin Road. (Z17-2026-047) 2026-258 Conduct a public hearing and consider and act upon an ordinance rezoning 593.939+ acres out of the W. M. Lick Survey, Abstract No. 620, J.P. Neill Survey, Abstract No. 1387, E. Rice Survey, Abstract No. 929, A.R. Newton Survey, Abstract No. 807, P.I.C. Survey, Abstract No. 1240, Z. Heath Survey, Abstract No. 455, J. Kyser Survey, Abstract No. 597, W. Wilkins Survey, Abstract No. 1162, JR Beauchamp Survey, Abstract No. 1201, AR Newton Survey, Abstract No. 809, and I. REGULAR AGENDA 2026-259 Consider and act upon a resolution consenting to the annexation of certain land into Midlothian Municipal Management District No. 2 2026-260 Consider and act upon a resolution authorizing the issuance by the Midlothian Municipal Management District No. 2 of Unlimited Tax Utility Bonds, Series 2026, in the amount of $7,615,000. 2026-261 Consider and act upon a resolution accepting and approving a preliminary amended and restated service and assessment plan and preliminary assessment rolls for the Redden Farms Public Improvement District, calling a public hearing on the levy of special assessments against Improvement Areas #3-6 of the District and approving all other matters related thereto. 2026-262 Consider, discuss and take a record vote to establish a maximum ad valorem tax rate of $0.640000 and schedule a public hearing regarding the proposed ad valorem tax rate for September 8, 2026. https://www.midlothian.tx.us/945/Budget-and-Tax-Rate-Information 2026-263 Consider and act upon an ordinance calling a special election to be held on November 3, 2026, relating to the issuance of bonds; providing for the conduct and the giving notice of the election; providing an effective date; and enacting other provisions relating to the subject. 2026-264 Receive a presentation from SAMCO Capital Markets, Inc. outlining a General Obligation Bond issuance for the construction of streets and road improvements, and Tax Notes to fund new and replacement equipment, sidewalk and curb rehabilitation, facility repairs and software. 2026-265 Consider and act upon a resolution authorizing an expenditure in the amount of $85,109 by Midlothian Community Development (MCD) to El Primo’s Midlothian for the costs associated with a cabinet sign, sidewalk, railing and trim lights at 211 W. Main St., Midlothian, TX 76065. 2026-266 Consider and act upon a recommendation from Midlothian Economic Development to approve the program and expenditures outlined in the Economic Development Performance Agreement with 67287 CCOT Investors, LLC for project related infrastructure improvements necessary to promote new or expanded business enterprise. 2026-267 Consider and act upon nominations for appointments to the Planning and Zoning Commission, Zoning Board of Adjustment, and Midlothian Development Authority. 2026-268 Consider and act upon authorizing the City Manager to enter into an agreement with Mayes Media Group to provide public relations/public education communication services for the November 3, 2026, special election bond referendum for a consulting fee of $18,500 and materials fees estimated at $76,873 for a total not to exceed $95,373. 2026-269 Consider and act upon an ordinance amending the City of Midlothian’s Fiscal Year 2025-2026 General Fund Budget Appropriations in an amount not to exceed $95,373 from the Unreserved Fund Balance for the public relations/public education communication services for the November 3, 2026 special election bond referendum in accordance with Chapter 102, Local Government Code; appropriating various amounts thereof; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. EXECUTIVE SESSION The City Council will convene into executive session pursuant to the following sections of the Texas Government Code. Executive Session items are discussed in closed session but any and all action is taken in regular open session. 1. Section 551.071(2) Legal: Consultation with city attorney on any agenda item listed herein. 2. Section 551.072 Real Estate: Deliberation regarding real property–to deliberate the purchase, exchange, lease or value of real property located within the city limits of Midlothian, Texas. 3. Section 551.087 Economic Development: (1) Deliberation regarding commercial or financial information received from a business prospect; and (2) To deliberate the offer of a financial or other incentive to a business prospect.
