BOROUGH OF MILLTOWN Borough Council Meeting Minutes October 14, 2025, at 7pm The Borough Council Meeting of the Milltown Borough Council was held on October 14, 2025, at Milltown Borough Hall, 39 Washington Avenue, Milltown, New Jersey. The meeting was called to order by Mayor Murray at 7:00 pm. Borough Clerk Gretchen McCarthy read the following statement: Adequate notice of this meeting has been provided as required under Chapter 231, P.L. 1975, specifying the time, date, and location of this meeting by posting a copy of the notice in the Municipal Building, on the Municipal Website, and providing a copy of the Annual Notice Schedule to the official newspapers of the Borough. Notice is also on file in the Office of the Municipal Clerk. Approval of Bill List Resolution 2025-328 Authorizing Payment of Municipal Obligations WHEREAS, the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey finds and declares that certain municipal obligations have come due and are now payable; and WHEREAS, the Borough Council further finds and declares that said obligations have been itemized on the annexed schedules, which are hereby deemed part of this resolution. Bill lists were attached to this resolution. Councilman Collins questioned a charge of $4,892.50 labeled as "monthly general" on page 11, as well as a $4,902 charge for the Ford Avenue project. Borough Attorney Peter Vignuolo clarified that these were separate line items representing his legal fees - one for general borough matters and one specifically for the Ford Avenue redevelopment project. Councilman Collins expressed concern about the ongoing costs of the Ford Avenue project, noting that the town had previously been told the project wouldn't cost the borough anything. Attorney Vignuolo explained that circumstances had changed significantly, including a builder's remedy lawsuit filed by Mr. Berger and affordable housing obligations, making the project far more complex and lengthy than originally anticipated. He noted that the project had been ongoing for 23 years, much longer than anyone had anticipated. Resolution 2025-338 Authorizing Approval of a Homeowner/Program Agreement For Milltown Borough Home Improvement Case Number MILL-2527 WHEREAS, the Borough of Milltown currently has a housing rehabilitation program entitled the Milltown Borough Home Improvement Program (“HIP”); which complies with all applicable laws, including but not limited to New Jersey Council on Affordable Housing regulations; and WHEREAS, the Borough of Milltown has previously retained the firm of CGP&H, a professional affordable housing consultant, to administer the HIP; and WHEREAS, a Borough homeowner is seeking to participate in the HIP (Case Number MILL- 2527) and CGP&H has confirmed that the homeowner has been income qualified and approved to move forward within the HIB with the Borough of Milltown. Resolutions Removed From the Consent Agenda: Resolution 2025-337: Establishing a Subcommittee to Assist the Borough in Disposing of the South Main Street Firehouse and the Cottage Avenue Firehouse Establishing a Subcommittee to Assist the Borough in Disposing of the South Main Street Firehouse and the Cottage Avenue Firehouse WHEREAS, Eureka Engine Company Number 1 of the Milltown Fire Department was previously located in a firehouse at 120 South Main Street, Milltown, New Jersey; and WHEREAS, Eureka Hose Company Number 1 of the Milltown Fire Department was previously located in a firehouse on Cottage Avenue, Milltown, New Jersey; and WHEREAS, on February 1, 2020, Eureka Engine Company Number 1 and Eureka Hose Company Number 1 of the Milltown Fire Department relocated to new firehouse located on Washington Avenue within the Borough; and WHEREAS, following the relocation of Eureka Engine Company Number 1 and Eureka Hose Company Number 1 of the Milltown Fire Department to the new firehouse on Washington Avenue, the Milltown Fire Department no longer required the use of the firehouses on South Main Street and Cottage Avenue within the Borough of Milltown; and WHEREAS, the Mayor of the Borough of Milltown has expressed a desire to create a subcommittee of Borough residents and professionals to advise the Borough on how best to dispose of the South Main Street Firehouse and the Cottage Avenue Firehouse; and WHEREAS, the Borough Council of the Borough of Milltown concurs in this desire and wishes to create such a subcommittee. The Borough of Milltown hereby creates a “Milltown Firehouses Subcommittee” to consider and advise on the best manner to dispose of the South Main Street Firehouse and the Cottage Avenue Firehouse. 2. The membership of the Milltown Firehouses Subcommittee shall be appointed by the Mayor with the advice and consent of the Borough Council. 3. The membership of the Milltown Firehouses Subcommittee shall be made up of: a. Mayor; who shall act as Chairperson of the Subcommittee; b. Two Councilmembers (who shall be from different political parties if the Borough Council is not comprised of one political party); c. A member of the Borough Historical Society; d. A member of the Borough Revitalization Committee; and e. Two (2) individuals who are residents of the Borough. 4. Members of the Milltown Firehouses Subcommittee shall serve at the pleasure of the Mayor and Borough Council. The Borough Council shall annually review the membership of the Subcommittee and, in its discretion, make such appointments as necessary to maintain the Subcommittee’s full active membership. 5. The Milltown Firehouses Subcommittee shall meet to consider and recommend how best to dispose of the South Main Street Firehouse and the Cottage Avenue Firehouse; including consideration of the following issues: a. What specific parcels comprise the South Main Street Firehouse and the Cottage Avenue Firehouse; and what are the parameters of each parcel; b. Whether one or both of the firehouses should be sold and/or leased; c. Whether any Borough owner property adjacent to the South Main Street Firehouse should be included in the sale or lease; either through subdivision or an easement; and d. Whether any restrictions should be placed on the sale and/or lease of the South Main Street Firehouse and the Cottage Avenue Firehouse. 6. The Milltown Firehouses Subcommittee shall be permitted to utilize the services of the Borough Professionals; including, but not limited to, the Borough Attorney, the Borough Engineer and the Borough Planner. 7. The Milltown Firehouse Subcommittee shall remain in existence until dissolved by the Borough Council. 8. This resolution shall take effect immediately, according to law. Page | 9  BOROUGH OF MILLTOWN Borough Council Meeting Minutes October 14, 2025, at 7pm Considerable discussion took place regarding this resolution: Councilman Manco expressed concern that the resolution didn't incorporate previous analysis from the South Main Street rehab plan as a template. He suggested that the existing Finance Committee and borough professionals already had sufficient talent to handle this matter without forming a subcommittee. Councilwoman Payne stated that creating a subcommittee would only delay the work needed to move the process forward. Councilman Posnansky questioned whether property evaluations had been completed for the structures. He argued that while subcommittees sometimes delay progress, they don't have to if properly managed with time limits. He recommended obtaining an outside assessment of the properties' values. Councilman Manco suggested the Finance Committee should handle this matter with an immediate outside assessment of the properties' values. He emphasized that time was of the essence, noting that the new firehouse had been in use since 2020 and the old properties should have been addressed sooner. Councilman Collins advocated for the subcommittee, stressing the importance of public input in the decision-making process. He argued that residents might have better ideas than council members, and that the longer they waited, the more property values might change. The debate became somewhat heated, with disagreement about whether forming a subcommittee would expedite or delay the process. Councilman Collins emphasized the importance of incorporating public input, while others maintained that moving quickly through the Finance Committee would be more efficient. Councilman Collins – Environmental, Health, & Social Services Councilman Collins provided a detailed report from the library committee, listing numerous events scheduled for October including movie matinees, yoga sessions, a pumpkin carving contest, creative journaling, craft corner, and the Harvest Day Festival scheduled for October 25. Councilman Manco - Utilities Councilman Manco reported on both electrical and water utilities: Page | 10  BOROUGH OF MILLTOWN Borough Council Meeting Minutes October 14, 2025, at 7pm For the electrical department, he noted that substation maintenance had been performed, including oil sample analysis to monitor transformer health. Broken streetlights were repaired and replaced with energy-efficient LED fixtures at five locations. LED floodlights were installed at little league batting cages, line clearance was performed, and lighting at the senior center was replaced. Regarding water utilities, he reported that the wet well at Church Street Station had been cleaned, removing 12-16 yards of debris, much of which consisted of needles and personal care wipes that should not be flushed. He emphasized that "no wipes are flushable" and that cooking grease should not be rinsed down drains. Several fire hydrants were replaced, including one at 32 South Wilson, and hydrant flushing was completed. Councilman Manco also reported that approximately 210 residents still needed to get their water meters replaced, preventing the borough from accessing grant money for lead line assessments. He warned that those not scheduling meter replacements would likely face a surcharge in the near future, with implementation expected around January 1, 2026. Councilwoman Payne – Public Safety Councilwoman Payne reported on police, fire, and rescue activities: For the police department, she reported 1,485 calls for service in September, 116 radar details, 569 motor vehicle stops, 24 motor vehicle accidents, and 7 arrests for shoplifting, DWI, and active warrants. She shared comparative data showing significant increases in police activity: traffic stops increased from 2,657 in 2023 to 5,405 in 2024, and to 6,000 in 2025 - a 125% increase. Arrests rose from 71 in 2023 to 139 in 2025. Meanwhile, crimes such as burglaries decreased from 11 in 2023 to 5 in 2024, though they increased slightly in 2025. She credited these improvements to the hiring of "young, new, energetic recruits." For the fire department, she reported 35 incidents during September with a year-to-date total of 269, and 365 service hours for the month with 4,594 year-to-date. She noted their presence at the 9/11 service and Milltown Day, and acknowledged the department's ongoing process to find a new deputy chief following the loss of Deputy Chief Tony Kerber. For the rescue squad, she reported 69 total calls in September, with 57 in Milltown and the remainder on the turnpike or for mutual aid. She mentioned their successful blood drive and assistance at the Hornet Riverwalk event. Councilman Posnansky – Public Works & Senior Center Councilman Posnansky first clarified he is liaison to Public Works, Senior Center, and Milltown Historic Preservation Committee, not Recycling as listed. For the Senior Center, he detailed upcoming trips including an October 22nd bus trip to Ria Mara restaurant, October 23rd to the Amish market, and October 30th to the Shrimp Box. He also noted upcoming events including a flu clinic on November 6th, a presentation from police liaison Michael Olesinski on November 10th, and a new Whole Body Fitness class on Mondays. He mentioned their ongoing pet shelter donation program. Regarding DPW, he reported on a recent meeting to discuss year-end reviews and plans for the coming year. Updates were provided on projects including Northbrook Drive, East to West Foch milling, paving, drainage plans, and the Albert Avenue bike path phase 2. He noted the success of the new recycling drop-off center, availability of leaf bags, and upcoming projects including HVAC replacement at the DPW and firehouse. He also mentioned discussions about potential uses for the old DPW yard and new equipment needs. Councilman Potter – Parks & Recreation Councilman Potter provided updates from the Recreation Department, highlighting the success of the 9/11 Candlelight Remembrance Service and Milltown Day. He noted ongoing fall programs and announced upcoming events including a pumpkin carving contest on October 24-25, the Descendants Musical Theater Program performance on November 11, late fall soccer clinics, and youth basketball registration. He also mentioned that the adult coed softball league championship game would take place on October 30. He briefly noted that the October Planning Board meeting had been canceled with the next meeting scheduled for November 5, and announced a "Red, White, and Brew" event planned by the Fourth of July Committee for April 18. Reports from Professionals Borough Attorney Peter Vignuolo and Borough Engineer Lou Ploskonka had no reports. Old Business No old business was discussed. New Business Councilman Collins inquired whether the Ford Avenue property tax lien had been sold. Borough Attorney Vignuolo explained that to his knowledge it had not been sold, likely because the property was in bankruptcy and potential buyers would be hesitant to take on the financial risk. Councilman Collins questioned why the property owner wasn't required to pay taxes despite bankruptcy proceedings, and the attorney confirmed the owner was still obligated to pay taxes. Public Comment A student from Rutgers University named Emily Reyes attended the meeting for a class assignment and inquired about the pending litigation mentioned in the Executive Session agenda item. Borough Attorney Vignuolo clarified it concerned the Ford Avenue redevelopment litigation. Council Comments Councilwoman Payne commented on her positive experience using the extra recyclable day service at the DPW garage, noting the excellent service she received when dropping off cardboard and other recyclables. Councilman Manco expressed appreciation for the police department data presented by Councilwoman Payne, noting it provided valuable context for understanding crime and enforcement trends in the borough. Councilman Posnansky expressed concerns about recent changes to the meeting agenda format, arguing they reduced transparency. He stated that changing the unanimously voted-for agenda without input from the majority of council was improper, and that eliminating committee reports from certain meetings was detrimental to public information. Mayor Comments Mayor Murray congratulated Tax Collector Kelly McCormick on her diligence in contacting property owners, resulting in no properties requiring a tax sale this year - the first time this had occurred in many years. L. 1975, Chapter 231 permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist; and WHEREAS, the Governing Body wishes to discuss: Pending Litigation; and WHEREAS, minutes will be kept and once the matter involving the confidentiality of the above no longer requires that confidentiality, then the minutes can be made public. NOW THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Milltown, County of Middlesex, State of New Jersey that the public be excluded from this meeting.
