The Borough Council Meeting of the Milltown Borough Council was held at Milltown Borough
Hall, 39 Washington Avenue, Milltown, New Jersey. Mayor George Murray called the March 23,
2026, Borough Council meeting to order at 7:00 PM.
Borough Clerk Gretchen McCarthy read the Open Public Meeting Statement, confirming that
adequate notice had been provided as required under Chapter 231, Public Law 1975, by posting
notice at the municipal building, on the municipal website, and by providing a copy of the
annual notice schedule to the official newspapers of the borough. Notice is also on file in the
municipal clerk's office.

A moment of silence was observed. The Pledge of Allegiance was recited. Prior to proceeding,
Mayor Murray acknowledged and welcomed members of Girl Scout Troop 80149, who had
participated in a pre-meeting civic education session about the structure and function of
municipal government.
Public Comment:
Mayor Murray opened the floor for public comment limited to agenda resolutions. Seeing no
members of the public wishing to speak, the comment period was closed.

Resolution 2026-114
Authorizing Payment of Municipal Obligations
WHEREAS, the Borough Council of the Borough of Milltown, County of Middlesex, State of New
Jersey finds and declares that certain municipal obligations have come due and are now
payable; and
WHEREAS, the Borough Council further finds and declares that said obligations have been
itemized on the annexed schedules, which are hereby deemed part of this resolution.
NOW THEREFORE BE IT RESOLVED that the Borough Council of the Borough of Milltown,
County of Middlesex, State of New Jersey does hereby authorize payment of said municipal
obligations, in accordance with the recommendations of the Chief Financial Officer in the total
amount of $ $2,148,624.40.

Resolution 2026-119
Authorizing Execution of Shared Service Agreement with South River for Municipal Court
WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., (the
“Act”) and N.J.S.A. 2B:12-1 pertaining to the operation of municipal courts permit units of local
government to share services for a particular purpose and to effectuate agreements for any service or
circumstance that will aid and encourage a reduction of local expenses; and
WHEREAS, the Borough of Milltown and the Borough of South River are public bodies corporate
and politic of the State of New Jersey and are authorized under New Jersey law to enter into a Shared
Services Agreement pursuant to the Act; and
WHEREAS, the Borough of Milltown and the Borough of South River desire to enter into a
shared services agreement for municipal court services; and
WHEREAS, representatives of the Borough of Milltown and the Borough of South River have
negotiated a Shared Services Agreement, a copy of which is annexed hereto as Exhibit A, and the terms
of which are incorporated into this resolution as if set forth at length herein; and
WHEREAS, the Borough Council of the Borough of Milltown finds it would be in the best interest
of the residents and taxpayers of the Borough to authorize the execution of the Shared Services
Agreement with the Borough of South River in substantially the form annexed hereto and made a part
hereof;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Milltown, County of
Middlesex, State of New Jersey as follows:

AUTHORIZING TAX EXEMPTION FOR TOTALLY DISABLED VETERAN AND A TAX CREDIT TO THE
PROPERTY
WHEREAS, said Veteran(s) was the owner of the property in the Borough of Milltown on
or before October 1, 2025, and
WHEREAS said Veteran(s) was determined to be 100% permanently and totally disabled
by the Department of Veteran’s Affairs, and
WHEREAS, said Veteran(s) did not file their claim for the Veteran tax exemption with the
proper official of the Borough of Milltown, Middlesex County prior to December 31, 2025; and

WHEREAS, the Borough of Milltown needs to acquire the services of a consultant for its
Affordability Assistance Program as part of the State Affordable Housing obligation without a
"fair and open process" as defined by P.L. 2004, c.19, the "Local Unit Pay-to-Play Law''; and
WHEREAS, Community Grants, Planning and Housing (CGP&H) has submitted a proposal
offering to provide Administrative Agent services for $13,600 for the term of March 6 2026,
through December 31, 2026; and
WHEREAS, the Qualified Purchasing Agent has determined and certified in writing that
the value of the acquisition throughout the contract is anticipated not to exceed $13,600; and
WHEREAS, CGP&H has completed and filed with the Borough of Milltown a Campaign
Contributions Affidavit as required by N.J.S.A. 19:44A-20.2 et seq. certifying that CGP&H has
not made any prohibited contributions to a candidate committee or municipal committee
representing the elected officials of the Borough of Milltown; and
WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11 et seq., authorizes the award
of this contract without public bidding on the basis that this is a professional service; and
WHEREAS, the Chief Financial Officer has certified that sufficient funds are available.
NOW THEREFORE, BE RESOLVED, by the Governing Body of the Borough of Milltown as
follows:
1. The Mayor and Municipal Clerk are hereby authorized and directed to execute an
agreement with CGP&H for Administrative Agent services related to the Affordability
Assistance Program, with the amount not to exceed $13,600 for a term of March 6,
2026, through December 31, 2026.
2. A copy of this Resolution, the Certification of Contract Value, the Campaign
Contributions Affidavit, and the executed Agreement shall be placed on file in the office
of the Municipal Clerk.
3. A notice of this award shall be published as required by law.

Councilman Posnansky raised a series of questions regarding the engagement of CGP&H as the
borough's Affordable Housing Administrative Agent. Borough Attorney Vignuolo addressed
each question in turn.
Councilman Posnansky asked whether an affirmative marketing plan and an administrative
agent were new requirements for Milltown. Borough Attorney Vignuolo clarified that these are
longstanding obligations tied to the borough's affordable housing compliance, and that while
the borough had previously retained CGP&H for related services, the administrative agent role
had lapsed at some point between the late 2010s and the present. This resolution formally
remedies that gap.
Councilman Posnansky asked whether there were other companies capable of providing this
service and whether a competitive process had been undertaken. Borough Attorney Vignuolo
acknowledged that other providers likely exist but explained that given the borough's need to
meet an affordable housing compliance deadline of March 16–17, CGP&H was engaged directly.
He noted that the contract would likely be put out as a fair and open process at the next
reorganization.
Councilman Posnansky questioned why the contract's effective date of March 6 preceded the
meeting date of March 23. Borough Attorney Vignuolo explained that CGP&H had already
begun providing advance assistance with the affirmative marketing plan in order to meet the
compliance deadline.
Councilman Posnansky further asked whether the list of organizations notified under the
affirmative marketing plan included veteran’s groups, seniors’ groups, and disability groups. He
expressed concern that these groups were not currently on the notification list and suggested
they should be added. Borough Attorney Vignuolo indicated he would follow up with CGP&H on
that question, noting that the firm was the appropriate expert to address the specifics of the
marketing plan's outreach. Councilman Posnansky also confirmed that qualified Milltown
residents would be made aware of unit availability through public postings.
Councilman Manco noted that CGP&H, as professionals who make their living in the affordable
housing field, would be the most knowledgeable resource for direct questions on those
specifics.

Resolution 2026-117
Requesting an Extension of time to Award Project for Municipal Aid Program Grant Through
the Transportation Trust Fund Act
WHEREAS, the Borough of Milltown has received a Fiscal Year 2024 Municipal Aid
Program grant through the Transportation Trust Fund Act for the Foch Avenue Roadway
Improvements Project; and
WHEREAS, a condition of this funding was the award of a construction contract on or
before January 31, 2026; and
WHEREAS, due to the mitigating circumstances mentioned in the attached letter, there
is a need to respectfully request an extension of time to award the construction contract; and
NOW THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Milltown,
County of Middlesex, State of New Jersey that the Borough of Milltown hereby requests a six-
month (6) month extension of time from January 31, 2026, until July 31, 2026, to award a
construction contract for the Foch Avenue Roadway Improvements Project.
Councilman Potter, noting he had been absent from the previous meeting when the contract
was awarded, relayed that he had received numerous resident inquiries about the start date for
this project. Borough Engineer Ploskonka explained that now that the contract is awarded, the
next steps are completing the insurance and bonds process and finalizing contract documents.
A preconstruction meeting would be scheduled thereafter, at which point a construction
schedule would be provided to the council. He anticipated the preconstruction meeting could
take place within approximately one month.

citizen/disabled person deduction, yet were disallowed. Borough Clerk McCarthy clarified that
those deductions were disallowed because the affected property owners' income exceeded the

Resolution 2026-124
Resolution Authorizing an Emergency Contract Award to B&W Construction for the
Emergency Repair of a Water Main
WHEREAS, the Borough of Milltown has suffered a complete failure of a water main
related to storm damage, causing a disruption in the delivery of water for the residents of the
Borough,
WHEREAS, Borough officials have determined that the water main needs immediate
repair and replacement in a timely and emergent manner, and
WHEREAS, these emergency repairs will consist of the following:
• Repair broken water main
• Repair of curbs and roadway surface
• Necessary plumbing work to facilitate installation
• Traffic control
WHEREAS, the cost of this emergency service will not exceed $35,000.00, and
NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of
Milltown that an emergency contract will be issued to B&W Construction Company of NJ, PO
Box 574, South River, NJ 08882, with funds certified by the Chief Financial Officer not to exceed
$35,000.00.
Councilman Posnansky asked whether the work had been completed and where the break had
occurred. Mayor Murray confirmed that the emergency water main repair on Main Street had
been completed.

Resolution 2026-125
Municipal Budget of the Borough of Milltown, County of Middlesex for the Fiscal Year 2026.
BE IT RESOLVED, that the following statements of revenues and appropriations shall
constitute the Municipal Budget for the year 2026 and that said Budget be published on the
official website www.milltownnj.org on March 28th, 2026.
BE IT FURTHER RESOLVED, that the Governing Body of the Borough of Milltown does
hereby approves the following as the Budget for the year 2026
Councilwoman Miller remarked that she looked forward to reviewing a simplified version of the
budget document. Mayor Murray noted that the budget would be formally adopted on April
27, at which time a more detailed presentation of the budget figures would be provided.

Reports from Professionals
Borough Engineer Ploskonka provided an update on the water meter replacement project. As of
that day, 11 additional meters had been completed, bringing the total to 2,435 units complete.
Of the remaining units, 28 are incomplete due to various access or logistical reasons, and the
borough is working with the contractor to resolve those. There are 79 units currently scheduled
for replacement, and 69 that remain unscheduled. The contractor has availability during the
current and following weeks, and residents in the unscheduled group were encouraged to
schedule their appointments promptly.
A question was raised regarding the ARISA properties on Main Street, where a commercial
building is slated for demolition. Borough Engineer Ploskonka noted that when this question

had previously arisen, the administration had determined that meters should still be installed
given the uncertainty about the demolition timeline. He confirmed that the contractor is
expected to access those properties toward the end of that week. Mayor Murray requested
that efforts be made to obtain a confirmed demolition date from the developer, and Borough
Administrator Stevens noted that the tax collector has been in ongoing dialogue with the
property's landlord. Councilman Potter added that the matter is scheduled to come before the
planning board on April 1.
Borough Administrator Stevens had no report.
Borough Attorney Vignuolo had no report.
Borough Clerk McCarthy had no report.
Old Business
Councilman Posnansky raised a question regarding a towing bill from George Logan Towing that
appeared in the prior month's bill list. The invoice totaled $550, which included $125 for
towing, $400 for storage, and $25 for an administrative fee. Councilman Posnanski noted that it
is uncommon for the municipality to pay storage fees on a towed vehicle, as those costs are
typically borne by the vehicle owner. Borough Administrator Stevens indicated he would look
into the matter and provide clarification.
New Business
No new business was presented.
Public Comment
Steve Gregus, 25 Lincoln Avenue, addressed the council on three topics.
First, Mr. Gregus inquired about the current status of the Schwendeman Cabin. He expressed
frustration that nearly seven years have passed since grant funding was obtained, and that no
visible progress had been made. Mayor Murray responded that a committee had been formed
to develop recommendations for the borough council regarding the property.
Second, Mr. Gregus spoke on behalf of the Milltown Historical Society, noting that the
organization has spent approximately $40,000 of its own funds over the past 15–20 years
maintaining borough-owned museum buildings, after repeatedly being denied budget
allocations for repair work. He stated that the Society had recently arranged for a local
contractor to paint the back building at a favorable price, funded entirely by the Society. He
expressed frustration that this work was being subjected to a public bidding requirement, given
that the borough is not contributing any funds and the contractor is insured. He asked the
council to minimize administrative barriers for the Society's volunteer-driven maintenance
efforts.

Third, Mr. Gregus expressed personal concern about the cumulative impact of multiple ongoing
residential development projects in the borough specifically referring developments near
ACME, on South Main Street, and at Ford Avenue — on local taxes and municipal infrastructure.
He raised the point that the borough may bear a share of utility upgrade costs associated with
the Ford Avenue site, citing a disclosure made in 2000. He stated his opinion that these
approvals were mistakes and expressed hope that some of the projects would be further
delayed.
No other members of the public came forward, and the public comment period was closed.
Council Comments
Council President Zambrana wished a Happy Passover to all those celebrating, noting that
Passover and Easter would coincide during the coming week, which he remarked is an
uncommon occurrence. He also wished a Happy Easter to all those celebrating.
Councilman Posnansky requested that the council undertake a formal review of the format and
structure of the borough's annual candidate debate and forum. He expressed disappointment
in the quality of questions posed at a recent forum, stating that they were overly simplistic and
did not challenge candidates on substantive municipal issues. He advocated for a new standard
that would better inform residents and voters and offered to share materials that could serve
as a guide for reform.
Councilman Potter acknowledged the approval of Resolution 2026-120 and publicly thanked
James LeBlon for his years of service as both member and chairman of the Planning Board. He
also reminded residents of a dine-to-donate fundraiser for the Fourth of July Committee at
Dusal's restaurant, taking place that evening and the following night.
Councilwoman Miller reported that the Environmental Commission had recently hosted a
community energy planning grant town hall, at which residents participated and shared their
priorities. She thanked council members who attended in support. She noted that the feedback
gathered would be reviewed and used to develop recommendations.
Councilman Manco commented on the state's affordable housing mandates, expressing the
view that the current framework is inequitable for small, older municipalities like Milltown,
which face significant infrastructure constraints. He noted that each new development only
increases the borough's outstanding affordable housing obligation, making compliance a
seemingly endless challenge. He also expressed satisfaction with the council's continued
support for the water meter replacement project.
Mayor Comments
Mayor Murray reminded residents that the Annual Easter Egg Hunt will be held on Saturday,
March 28, at noon at Albert Avenue Park. He also took the occasion to wish his wife Louise a
happy birthday.
