278 Commission Chamber, City Hall Millville, New Jersey May 20, 2014 6:30 p.m. The Board of Commissioners met in a regular session with Mayor Santiago presiding. Members present: Santiago, Quinn and Sooy. Absent: Porreca Compari and Ennis. Reverend Lewis Hiserote delivered the invocation followed by the salute to the flag. Mayor Santiago made the statement required by the Open Public Meeting Act of 1975. “This meeting is being conducted in accordance with the Open Public Meetings Act of 1975”, was advertised, posted and made available to the public as required by Statute. The Municipal Clerk is directed to include a statement in the minutes of this meeting. A motion was passed to approve and dispense with the reading of the minutes and to proceed with the regular order of business, by the following vote. Yeas: Quinn, Sooy and Santiago. Petitions & Letters Correspondence received from Governor Chris Christie explaining that the City has been selected to receive funding from the New Jersey Department of Transportation's Fiscal Year 2014 Municipal Aid Program for Third Street Improvements in the amount of $190,000.00 A motion was passed to receive and file the correspondence, by the following vote. Email received from Timothy Andrews resigning from the Millville Shade Tree Commission effective immediately A motion was passed to receive and file the correspondence, by the following vote. Correspondence received from Mayor Michael Santiago appointing Renee Brecht as a member of the Millville Shade Tree Commission to fill the unexpired term of Timothy Andrews with an expiration date of December 31, 2018  279 A motion was passed to receive and file the correspondence, by the following vote. Reports of Commissioners Department of Parks and Public Property Commissioner Sooy reported a Community Garden Meeting will be held at City Hall on May 22, 2014 at 6:30 p.m. and invited the public to attend. Department of Revenue and Finance Vice-Mayor Quinn thanked everyone who attended Millville Night at Citizens Bank Park and made it a success. The City of Millville gained publicity from all across the nation. For example; the LA Times, USA Today and Comcast Sports Net covered the game. It’s very exciting to have a world class athlete from the City. The Phillies Organization is rebating over $30,000.00 to the Millville Development Corporation, which will be used for matching grant funds. Millville Night will continue in future years, even though Mike Trout will not return to Philadelphia for three years. Vice-Mayor Quinn reported the Cumberland County College Baseball Team is ranked No. 1 in the United States for Junior Colleges. They play in Tyler, Texas this weekend. He recently interviewed the players on the team including Josh O’Niell, one of the top two pitchers for the team, who also played with Mike Trout at Millville High School. Tax Collector's Report for the month of April 2014, Safety Committee Meeting Minutes from March 21, 2014 were ordered received and filed, by the following vote. Yeas: Quinn, Sooy and Santiago. Department of Public Safety Mayor Santiago thanked Vice-Mayor Quinn for all he has done for Millville Night. He appreciated all that came and stated Mike Trout is the same guy he has always been. He brings positivity and pride to the City. Mayor Santiago reported that police officers will begin working at Oakview apartments in mid-June. Fred Jacob made the following comments: “Mr. Mayor, before we get into the voting and the motions and all that I just would like to tell the commission and the public that after I realized we were only going to have three Commissioners here tonight I went to check out what we might be able to do as far as making motions, seconding motions, etcetera. I know it’s been a tradition for more than 25 years that the Mayor does not make a motion or second it. However, we have a Commission form of government and as Commissioner of Public Safety that Commissioner does have the right to make a motion and to second the motion. I did check this out with the head attorney of the League of Municipalities. So our ordinance says follows Robert’s Rules of Order, the clerk and I looked at Robert’s Rules and that’s recently been revised to say that in small meetings of 12 or under it’s to be presumed that the Chairman, or the Mayor or whoever is running the meeting can  280 make a motion and second it, if it’s more people than that then that person should sit back and not do that. So, you’re in clear Mr. Mayor, if you do want to make a motion or second it and I’ll stand behind that opinion. I know it’s not what we’ve been doing in the past, but we need to move on.” Commissioner Sooy: “As long as you’re on Parlimentary Procedure. The first ordinance, we haven’t introduced it yet. I want to make a motion to table it. Do I need to do that after it’s introduced or just make a move to table right away.” Fred Jacob: “You can move to table it, before it’s introduced.” Commissioner Sooy made a motion to table the following ordinance to allow time for further review and directed the City Clerk to invite representatives from C2C Energy Advisors to the next work session to provide further information on aggregation for natural gas. Vice-Mayor Quinn seconded the motion. The motion was passed, by the following vote. This has been the biggest mess I have ever seen. Nobody in here can, even up here, you guys can’t get together. The guys in some of the other offices they tell you, hope this is all done with. Get in here, not too long ago, Joe you was talking on the thing, because we got recordings of that, on the whole thing and the lawyer that was sitting here in your place…” Fred Jacobs: “Yeah, Joe Chiarello.” Cliff Simpkins: “Yeah, I don’t know him. He said the same thing, that everything was okay. Now, the only thing they told us was that property we got down there, that road that goes through there was the last road that we could use, after that it was going to fall into this one here, where everybody’s got a go through some deal here with this. But, if you’d like I can bring you in the recordings of that meeting where everybody was agreeing with what’s going on. So, you know, this has been a joke. I don’t know what you guys expect people to do. I don’t understand. First, you’re okay it’s alright, the next thing I know we’re popping up on something that’s included in this and you can go right there in the office, I can take you to the guys in the office over there and they said “it’s over with Cliff, it’s over with, thank God it’s over with.” They were getting tired of hearing about it and I don’t blame them. We all were. But, I mean, I just, I get, I hear this about this road over here, how oh, it’s been shut off for a thousand years, no it hasn’t been. Because, I was using it back about 37 years ago, I was using it and I was hauling stuff out from up the back, we had greenhouses up there. But, all of a sudden just wasn’t  292 using it no more. That’s all. Mr. Cooper, he used it when he had his farm, you know, when he was farming back there. So, I don’t understand how you guys can flip-flop like that so blessed quick.” Commissioner Sooy: “Can I address that. This doesn’t affect anyone using that particular road. What this affects is if someone wants to improve any other paper street they’ll need a permit before they do it…” Cliff Simpkins: “Right, I agree with you.” Commissioner Sooy: “So, this really doesn’t solve anybody’s problems…” Cliff Simpkins: “That’s not what was just told to me…” Commissioner Sooy: “Well, I talked to you yesterday on it…” Cliff Simpkins: “Now, honest to God Joe, I’m not trying, when I was ??? up there, everybody’s got their own interpretation about this and I know you’re going along with the guys, the office guy said the same thing that whatever happens, you know, if they want to build back there or something like that, then they’ve got to, I guess tar the road or asphalt, I don’t know what you got to do to it. But, I don’t care about that, that’s nothing to do with me.” Commissioner Sooy: “The situation, and I’m not trying to give legal advice, but I guess you’re going to have to watch out for it, is if the vote comes up to vacate the road. Now, that will affect it, maybe according to the attorney’s depending which one, not in your firm, but depending which lawyer I talk to I get a different story. There’s different interpretations, so I’m sure it’s all going to end up in court, I’m just positive of that…” Cliff Simpkins: “I don’t care where it winds up in, but I mean it’s just gone, it’s gotten out of hand…” Commissioner Sooy: “You’re right.” Cliff Simpkins: “I mean this is, God, you might think somebody is tearing down half of Millville and going to do something downtown. I mean this is a little dirt road that goes down there; down to Millville Avenue, in the back of my property and down there; that road has been there for years, long before I was even born, so it’s been a long while, so it’s been there a long time. But, I just don’t understand how all of a sudden we can just, today it’s okay, tomorrow it’s not. State guy comes into us there; you tell me if I’m talking too much…” Mayor Santiago: “Go ahead Mr. Simpkins.” Cliff Simpkins: “But, the state guy comes in and he says, you know, he says most roads he says are like these roads out here, he said the city owns half this way and the state owns half that way. That one he says uh-uh. That road is just a paper road. It’s old. That was what was told to me from the guy from the state. So, I don’t know.” Mayor Santiago: “Mr. Simpkins I think Commissioner Sooy answered the best, that this is going to continue and you’re  293 going to have to stand where you want to stand and it’s going to probably end up in a legal situation. Thank you for coming up though. I appreciate it. Thank you.” Dawn Ludwig: “Hi, I’m Dawn Ludwig, 136 Lysenko. I’m just going to speak about the ordinance. I think it’s important that there is oversight when you’re cutting down trees on property that doesn’t belong to you. There are dozens and dozens of paper roads throughout this City. Most people are not even aware of what a paper road is; they’re not aware that there are paper roads in their “backyards”. If I want to dig a ditch in my front yard I need a permit. I needed a permit to put a diving board on my pool in my backyard. So, it would only seem logical that before you start cutting down forestry and vegetation that you need some kind of City oversight and that would be a wise decision. Doreen Gov, 423 Buck Street, asked for an update on the condition of the property she reported on at the last meeting with Mayor Santiago responding that Commissioner Porreca Compari was not here this evening to comment, however he would like to speak with her after the meeting regarding his response relating to the public safety aspects of the property. Joe Sutherland, 51 Dorset Avenue, stated Millville Night was a great night at the ballpark and announced June 1, 2014 is the Officer Christopher Reeves Poker Run, registration is from 9:00 a.m. to 11:00 a.m. at the Elk’s Lodge and invited everyone to attend. Carolyn Vinci, 220 Maple Terrace, Buena, New Jersey, Coordinator, Animal Friends Foundation, explained the Feral Cat Program to the Board of Commissioners. The foundation has a good cooperative working relationship with the City for the last two years. Twenty-five thousand dollars in grant funding from Pet Smart has been obtained to fix stray cats. Rick Kuhns is the Coordinator for the City of Millville. If the City did not have the Feral Cat Ordinance there would be more cats for the public to deal with. The ordinance is in place; there are 38 registered colonies in the City each with an average of 10 cats.  312 There being no further comments the meeting was adjourned subject to the call of the chair, by the following vote.
