146 Richard C. McCarthy Commission Chamber Miliville City Hall August 15, 2017, 6:30 p.m. The Board of Commissioners met in a Regular Meeting with Mayor Santiago presiding. Members present: Commissioner Enms who arrived late at 6:35 p.m., Commissioner Davis, Commissioner Porreca Compari and Commissioner Soov. City Attorney, Brock Russell and Administrator Regina Burke were also present. Absent: None. Invocation was delivered by Reverend Dingle of First Assembly of God followed by the salute to the flag. Mayor Santiago made the statement required by the Open Public Meeting Act of 1975. “This meeting is being conducted in accordance with the Open Public Meetings Act of 1975”, was advertised, posted and made available to the public as required by Statute. The Municipal Clerk is directed to include a statement in the minutes of this meeting. Presentation Mayor Santiago presented a proclamation to Ruth McCullen of the Susan Mane Rupp Foundation — “Sisters, Mothers, Relatives, and Friends against Ovarian Cancer” City Clerk to Review Changes to the Agenda Ms. Hitchner announced the following additions to the agenda: 1) Report from QPA added for “Occupational Health Services,” 2) Notification that Mayor Santiago has sent a letter to the State Ethics Commission for an opinion, 3) Item 10 which changes directorship also changes backup Commissioners, 4) Item 12 Professional Service Contract with Inspira was added for “Occupational Health Services,” 5) Item 13 awarding uniform contract to Landsmen and Specialty Graphics, 6) New Business Item 2 which authorizes City Clerk to advertise for RFP’s for “Broker of Record for Employee Benefit Services.” Minutes A motion made by Commissioner Soov was passed to approve to dispense with the reading of the minutes for the August 1, 2017 Work Session Meeting and Regular Session Meeting. Commissioner Davis seconded the motion which was carried by the following vote. Yeas: Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Seeing nobody come forward, Mayor Santiago closed the public comment portion of the meeting on agenda items only. Commissioner Ennis arrived to the meeting late at 6:35 p.m. Old Business City Clerk stated there is a report from QPA/ Administrator regarding bids received for “Occupational Health Services.” Commissioner Porreca Compan moved, seconded by Commissioner Sooy to receive and file the report. The motion was carried by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy, and I\iayor Santiago. Nays: None. Petitions & Letters City Clerk stated that Mayor Santiago advised of a confidential letter which he recently forwarded to the State Ethics Commission requesting a legal opinion on multiple conflicts of interest within the City of MillviIle. Ms. Hitchner stated that this was advisory only and no action is required from the Board of Commissioners. Reports of Commissioners Commissioner Davis Commissioner Davis did not have anything to report at this time. Commissioner Sooy Commissioner Sooy announced the upcoming events in.the City include the Regional Home Run Derby, Play Street on Pine Street on Wednesday nights all summer for the youth, the Fishing Tournament, the Baby Show on  147 September 17, 2017, and the Pet Show on September 3,2017 all at Corson Park. He also stated that there will be a 911 Ceremony on September 11, 2017 and an upcoming celebration at the Phenom Factory for their 2’ Anmversary. He stated that residents can reach out to Samantha Cruz in the Recreation Department for more details. Commissioner Sooy also stated that the Streets and Roads Department collected 227 tires, issued 127 street sweeping violations, finished up the road repair behind City Hall, working on the sinkhole on Ware Avenue. They are also cleaning culverts due to clogs and will be overseeing the paving around Hankin’s Pond soon when the weather is more cooperative. Commissioner Ennis Commissioner Ennis did not have anything to report at this time. Commissioner Porreca Compari Commissioner Porreca Compari stated that the City has been working really hard to receive FEMA money from previous storms that wreaked havoc in the City and is pleased to announce that we just received $60,000.00 for our efforts. Commissioner Porreca Compari motioned, seconded by Commissioner Sooy to receive and file the Tax Collector’s Report for 2017. The motion was carried by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Mayor Santiago Mayor Santiago read the Fire Report stats from July 2017 and asked for a motion to receive and file same. Commissioner Sooy moved, seconded by Commissioner Ennis to receive and file the report which was carried by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Ordinances on 2nd Reading City Clerk read ordinance No. 31-2017 on 2’ and final reading: Ordinance amending Chapter 30, Article IX, Zoning Board of Adjustment, Section 30-85 Membership to — correct a clerical error that was made when Article IX was previously amended on November 14, 2011 by Ordinance No. 21-2011 to increase the number of Alternates on the Zoning Board of Adjustment from two to four. Commissioner Davis motioned, seconded by Commissioner Sooy. Mayor Santiago opened the meeting to a public hearing on this ordinance only. Seeing nobody come forward, Mayor Santiago deemed the public hearing to be closed. Ordinances on 1st Reading City Clerk read the following proposed ordinance on first reading: Ordinance amending the salary ordinance to create a new part-time title and range of compensation for the following: Title Minimum Maximum Code Enforcement Officer/ PT $12.OOp/h $20.OOp/h Commissioner Porreca Compari moved seconded by Commissioner Sooy to adopt the ordinance on first reading with second reading and public hearing scheduled for September 5, 2017. Resolutions Resolution No. 246-2017 authorizing the insertion of an additional item of revenue in the budget of the Calendar Year 2017 which is now available as revenue from the County of Cumberland, Municipal Alliance on Alcoholism and Drug Abuse, Municipal Alliance Program in the amount of $31,594.00 with City matching funds in the amount of $7,898.50 was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. Commissioner Porreca Compari announced she is in receipt of the appropriate certification of funds. The motion was earned by the following vote. Yeas: Commissioner Enms, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Commissioner Ennis complimented the work of Joseph Sutherland, especially with the drug epidemic we are facing. Resolution No. 247-2017 authorizing the insertion of an additional item of revenue in the budget of the Calendar Year 2017 which is now available as revenue from the NJ Department of Transportation FY 2016 — Transportation Trust Fund in the amount of $225,481.00. A motion was made by Commissioner Sooy and seconded by Commissioner Davis. The motion was carried by the following vote: Yeas: Commissioner Emits, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago.  148 Resolution No. 248-2017 authorizing adjustments in the Tax and Utility records was adopted on a motion by Commissioner Porreca Compan and seconded by Commissioner Sooy. The motion was carried by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compars, Commissioner Sooy and Mayor Santiago. Resolution No. 249-2017 authonzsng the Tax Collector to enter into an installment plan, pursuant to NJSA 54:5-19, with Patricia Getka to pay the delinquent amount of $1,680.00 in 42 equal installments of $40.00 each beginning July 28, 2017 owed for sewer charges on Block 42, Lot 8, 1701 West Main Street was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. The motion passed with the following vote: Yeas: Commisssoner Enms, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy, and Mayor Santiago. Commissioner Porreca Compari stated that the Tax Office is looking to remedy any of these overlooked connections that require payment and have been working ro improve the communication between departments so this is not an issue in the future. Resolution No. 250-2017 authorizing cancellation of special assessment in the amount of $300.00 and a $250.00 adniniistrative fee approved by Resolution No. 233-20l7adopted on August 1, 2017 for Block 454, Lot 3 due to property owner abated the violation dated June 13, 2017 within the specific time period was adopted on a motion by Commissioner Brims and seconded by Commissioner Davis. The motion was earned by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compan, Commissioner Sooy and Mayor Santiago. Resolution No. 251-2017 approving mthtary leave of absence and payment of pay differential due to a call up of active nushtary duty in the Air Force for Brian Day for the penod covering August 1, 2017 through September 23, 2017 was adopted on a motion by Commissioner Sooy and second by Commissioner Enms. The motion was earned by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compars, Commissioner Soov, and Mayor Santiago. Resolution No. 252-2017 authorizing award of a professional service contract with PT Consultants Inc. of Bellmawr, NJ to provide Environmental Consulting Services for the purpose of groundwater sampling and analysis of an area of the airport known as “the pump station” in an amount not to exceed $14,475.00 for the term of September 1, 2017 to August 1, 2018 was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari which was earned by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy, and Mayor Santiago. Commissioner Sooy stated he is in receipt of the necessary certification of funds. Commissioner Porreca Compari stated that the City is on the hook to clean-up the airport and this is part of that project. Resolution No. 253-2017 authorizing Special Assessment of Municipal Liens for certain properties due to expenses incurred by the City of Millville relating to clean-up and trash removal plus administrative fees in accordance with Chapter 11, Article VI of the Municipal Code was approved on a motion by Commissioner Porreca Compan and second by Commissioner Davis. The motion was earned by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compan, Commissioner Sooy, and Mayor Santiago. City Clerk read proposed Resolution authorizing a Memorandum of Understanding between the City of Millvslle and Inspira Health Network setting forth terms and conditions of each parties’ obhgation with respect to the provision of emergency medial services inthe City of Mdlville was TABLED on a motion by Commissioner Davis and seconded by Commissioner Porreca Compan. The motion to table said resolution was carried by the following vote: Yeas: Commissioner Enms, Commissioner Davis, Commissioner Porreca Compars, Commissioner Sooy, and Mayor Santiago. Resolution No. 254-2017 appointing Mayor Michael Santiago as Director of Public Works and appointing Commissioner Davis Ennis as Director of Public Safety and amending Resolution No. 356-2016 to reassign the backup Commissioners effective August 15, 201’ on a motion by Commissioner Sooy and seconded by Commissioner Davis. Commissioner Sooy read the City ordsanance pertaining to nepotism and the definition of a direct conffict of interest versus an indirect conflict of mterest. He also comphmented Mayor Santiago on running the Department of Pubhc Safety and told his son he has big shoes to fill. Commissioner Porreca Compan stated that three attorneys weighed in on this matter and all agree that it violates the City ordinance and she also agreed that Mayor Santiago did a great job running the Public Safety Department. Mayor Santiago thanked the Commissioners for their comments and told his son Dominick Santiago to stand up to applaud him. He stated he has been a lifelong public servant. He stated that he feels his integrity was attacked with all this. He stated that his son wanted to be a Msllville police officer so bad that he took a $14,000.00 cut to hold the position. Commissioner Ennms honored Dominick Santiago for following in his father’s footsteps. Pnor to voting, Commissioner Ennis took a short recess with City Attorney, Brock Russell. Upon their return, the motion was earned by the following vote: Yeas: Commissioner Ennms, Commissioner Davis, Commissioner Porreca Compan, Commissioner Sooy, and Mayor Santiago. Resolution No. 255-2017 appointing Dominick Santiago as a Millville Police Officer Recruit was adopted on a motion by Commissioner Davis and second by Commissioner Sooy. The motion was earned by the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, and Commissioner Sooy. Nays: None. Recused: Mayor Santiago. Mr. Russell announced that this simpLy ratifies the appointment of Dominick Santiago and was brought before the Commissioners in the form of a resolution on the advice of our labor attorney so it is clear that all Commissioners agree with the appointment.  149 Resolution No. 256-2017 authorizing Professional Service Contract with Inspira Health Network to perform professional occupational health services for the purpose of providing medical services as required to comply with various regulatory agencies and policies and procedures of the Municipality was approved on a motion by Commissioner Sooy and seconded by Commissioner Davis. The motion passed with the following vote: Yeas: Commissioner Ennis, Commissioner Davis, Commissioner Porreca Compan, Commissioner Sooy, and Mayor Santiago. Commissioner Sooy stated he was in receipt of the necessary certification of funds. Resolution No. 257-2017 authonzmg award of for the pnojeet known as “City of M.illville Work Uniforms” to Landsmen Uniforms of Mays Landing for Items 1-35, 54-56 and to Specialty Graphics of Mt. Laurel for Items 36-53 at the prices listed on the attached Schedule A was approved on motion by Commissioner Porreca Compari and second by Commissioner Davis. The motion was carried by the following vote: Yeas: Comissioner Ennis, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy, and Mayor Santiago. Commissioner Porreca compan stated she is receipt of the required certification of funds. New Business Commissioner Sooy moved, seconded by Commissioner Davis to approve the following Cumberland County Fair — Other Events Application and Special Events on Public Lands Application: a) International Overdose Awareness Candlelight Vigil sponsored by Cumberland County Department of Human Services on August 31, 2017 4:30 p.m. 9:00 p.m. at the Cumberland County Fairgrounds — b) Walk with a Doc Community Walk with Medical Professionals sponsored by the Holly City — Development Corporation on August 31, 2017 6:00 p.m. 7:30 p.m. located at Captain Joseph Buck Park — The motion was earned by the following vote: Yeas: Commissioner Enms, Commissioner Davis, Commissioner Porreca Compari, Commissioner Sooy, and Mayor Santiago. Commissioner Porreca Compari moved, seconded by Commissioner Sooy to authorize the City Clerk to advertise for Request for Proposals for “Broker of Record for Employee Benefit Program” with said proposals to be returned to the Purchasing Board on August 29, 2017 at 10:00 am., Richard C. Public Comment There being no further business, Mayor Santiago stated we have now reached the public comment portion of our meeting. Anyone who would like to address the Commission, please go to the podium, state your name, and address your concerns. Please limit your comments to approximately 5 minutes. Phil VanEmbden of Vineland addressed the Commissioners stating that he has operated business in Millville for 30 years. He explained the Levoy Theatre’s relationship with the City as it was intended when they first established a partnership when the economy was stable. He explained that there were many studies done and the tax credit component is what made Millville qualify as a low income community for the theater’s location. He stated that the City used UEZ money in the amount of 4 million dollars and 1 million dollars came from the CCIA. He stated the City loaned the Levoy $165,000.00 to be paid back over a ten year timeframe. He stated half of the money was paid back. He also stated that the UEZ grant stopped the year after the Levoy was built and any remaining UEZ money was seized from Trenton. He stated that the City has not given any new money to the Levoy since 2012. He emphasized that nobody is aslung the City for any money and feels the City should forgive the interest on the loan. He stated that the Levoy creates 10 jobs and provides cutlural diversity to the City. He also stated that the Levoy files all it’s taxes and complies with all tax laws. He announced that the revenue of the theater is getting better yearly. He stated that Board Members are unpaid. He also stated that it easy to criticize the efforts of others. Jennifer Finch of Miliville stated that she went out for a walk around town with her husband and two children searching for rocks from “Millville Rocks” and was just enjoying their time off together as a family, but she stated it went all wrong. She explained that she witnessed 5 people passed out along the walk due to ether being high or drunk and felt it was unsafe to continue. She stated she was even approached and being harassed as she tried to get her children into her car and it was a dreadful expenence that prompted her to pre-maturely discuss the use of drugs and alcohol with her two small children. She asked the City to provide additional police throughput the City so families can actually utilize the community the way it is intended. Lois Anne Wiener a advocate of the Levoy Theatre stated that she wants to emphasize that there is plenty of children’s events that take place at the Levoy Theatre such as Aladin Jr., the Utile Mermaid, Pocohontas, etc., She also provided statistics of the number of children who attended the shows and camps at the theater. Naomi Jones of Newfield, NJ stated that she is a professional actress and has worked with the Off Broad Street Players and has had a great expenence with the Levoy Theatre. She stated that she is more confident and has even started her own acting camp from all of the expenence she has gained from working with OBSP at the Levoy. She stated that aemig teaches about history, diversity, etc. and feels there is nothing else around even close to our theater. Mayor Santiago asked how old Miss. Jones was and she stated eleven years old. Mayor Santiago complimented her for having the courage to come before the Commissioners and express her views. Richard Curcio an advocate of the Levoy Theatre stated he has worked with the Off Broad Street players for over 15 years and feels the Levoy brings the 3 E’s to Millville which are Economic benefits, Educational benefits and Entertainment benefits. He pointed out the Levoy was honored with 17 awards from the Association of Theater Arts, which he feels is a very big deal. He stated that the theater helps educate and develop our youth by implementing skills  150 such as public speaking, mote confidence, team building, ctc. He stated that the theater is a treasure and is inspirational to our youth. He also stated that we are not asking you to save our theater, but we are asking for your support. Cindy Cook, a volunteer of the Levoy Theatre stated that she is standing up for the Levoy. She stated you don’t have to travel because the shows are all right here. She stated that kids can volunteer at the Levoy like her grandkids who are 7 and 10, which is better than them watching tv or playing video games. She stated that the Levoy has diverse shows for school age kids and they get excited to attend. She stated they get all dressed up and point at everything, they really get a kick out of it and it is very ennching. She stated that the Levoy is a big part of the metnoñes in her family. The Levoy shows an appreciation for the arts, it benefits the heart of the City, and she sees the surrounding businesses profitting from it’s existence. She stated that she even shot pool with one of the Alman Brother’s at Sidelines after a show which she stated was very cool. She asked for support and also that the City think positive thoughts. Sam Brooks, a music educator and musician who lives in Deptford, NJ stated he is very impressed with the Levoy Theatre. He stated that he turns down work from other venues to play at the Levoy. He described the theater as a hidden gem. He also stated that the theater is growing and his family has date night there, even if he can’t attend. He also pointed out that Glen Landing Middle School brought all 275 of their students to attend a show. He stated it is second to none with the friendliness of the staff, cleanliness and can handle the performaces it offers. Kim Carry of I\lillville stated that she appreciates the outcry from everyone tomght. She also stated that she wants to point out that she has never heard the Commission state that the Levoy Theatre needs to be shut down and wanted to make sure everyone realized this. Bob Conner of Vmeland stated that he is a Board member at the Levoy Theatre and stated that it was a project done to benefit the City. He stated that he wants to continue the positive energy and is amazed by how well the theater has blossomed. Brian McGahey of Millville stated that he has complained in the past about the 5 minute time limit to speak. He stressed that after hearmg everyone tonight able to go on, he feels the Commission needs to get nd of the mle for good. Angeline Broomhall of Millville stated that she just wanted to echo Kim Carry’s comment about the Commissioners stating they have never stated they want the Levoy Theatre to shut down. She stated she has all of their personal cell phone numbers and it has never been discussed. She stated that she is a homeowner, a taxpayer, and a single mom. She feels that her tax dollars should not be taking food off her kid’s table or clothes off her daughter’s back to fund a non-profit. Kirk Hewitt of 1\lillville stated that he has not heard any Commissioners say they want the Levoy to fail. He read his response from the Daily Journal on an editorial that was just recently written about the Levoy Theatre and wanted everyone to be clear that he has never heard anything about wandng the Levoy Theatre to go away. He pointed out that the Commissioners have not taken any formal action. He also pointed out that the majority of the individuals who spoke out for the Levoy this evening don’t live in M.illville. Mary Messeck of M.illville stated that she agrees with a lot of what was said this evening. She stated that financials have been requested multiple times from the Levoy Theatre and have not been provided. She stated that if she was part of a contract and was required to meet her obligations, she would do so because that is her responsibthry. She aiked what we can do to be more proactive. Seeing nobody else come forth, Mayor Santiago deemed the public portion closed. Comments by Commissioners Commissioner Davis Commissioner Davis did not have any closing remarks. Commissioner Sooy Commissioner Sooy stated that in response to Ms. Finch’s comments, more police officers have been hired and are in training. He stated he is looking forward to receiving the 2015-2016 financials from the Levoy Theatre. He also said God Bless attorneys with the way they can manipulate words. He stated that he expects agreements to be followed and nobody wants to see the Levoy Theatre close. He also thanked the young lady, Miss. Jones for her courage to speak. Commissioner Ennis Commissioner Ennis thanked Mr. Phil VanEmbden for coming out and presenting this information to the Commissioners. He stated that other work needs to happen on High Street and throughout the City in order to flourish. He stated that people are willing to come to Millvdle in spite of the negative tone over the City. He stated that from the business dictionary, the term “World Class City” means it offers the best of the best goods and services where the standard is excellence. It is maximizing your potential. He stated that he believes that everything is here to be world class. He stated we have the potential as a community. He also applauded Miss. Jones for her speaking up about the Levoy and being inspired. He stated she is inspiring also. Commissioner Porreca Compari  151 Commissioner Porreca Compari stated that she takes safety very seriously in the City and announced that we recently hired 12 new officers. She explamed that she, like Ms. Finch, used to walk the streets with her kids to the bakery and the library and is sad that young families cannot do that anymore. She also stated that nobody wants to see the Levoy fail or close. She stated that she will never agree with Mr. VanEmbden’s numbers when it comes to the Levoy Theatre. She feels the City has been very generous to the Levoy Theatre. She stressed that the City of I\fillville really needs jobs. Mayor Santiago Mayor Santiago stated that he appreciates what Mr. VanEmbden has done in the City. He also wanted to applaud the Chief of Police and Chief of Fire, stating we have a great administration. He also stated that we will solve our problems when we change the way we think. He encouraged everyone to start thinking positive. He stated we need to be more respectful toward one another. He also stated that Miss. Jones needs to move to Millville.
