188 Richard C. McCarthy Commission Chamber Millville City Hall November 8, 2017, 6:30 p.m. The Board of Commissioners met in a Regular Session with Mayor Santiago presiding. Members present: Commissioner Porreca Compari and Commissioner Sooy. City Attorney, Brock Russell and Admimstrator Regina Burke were also present. Commissioner Ennis arrived late at 6:44 p.m. Absent: Commissioner Davis. A moment of silent prayer was observed followed by the salute to the flag. Mayor Santiago made the statement required by the Open Public Meeting Act of 1975. “This meeting is being conducted in accordance with the Open Public Meetings Act of 1975, was advertised, posted and made available to the pubhc as required by Statute. The Municipal Clerk is directed to include a statement in the minutes of this meeting.” City Clerk to Review Changes to the Agenda Mayor Santiago asked if there were any changes to the agenda. Ms. Hitchner stated that there was a Fire Report added for the month of October. She also stated that Resolution Item 20 was added to reaffirm support of the NJ DOT project entitled “Route 55 Bridge Replacement over Route 47.” Minutes A motion made by Commissioner Sooy was passed to approve to dispense with the reading of the minutes for the October 17, 2017 Work Session Meeting and Regular Session Meeting. Commissioner Porreca Compari seconded the motion which was carried by the following vote. Yeas: Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. City Clerk stated that the following transfer resolution needed to be authorized prior to paving the bills. Resolution No. 316-2017 Resolution authorizing transfers in the CY2017 budget appropriations was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. City Clerk stated there is not. Petitions & Letters Correspondence received from Mayor Michael Santiago reappointing Lawrence Malone and Edward Kasuba as members of the Millville Planning Board. Reports of Commissioners Commissioner Sooy Commissioner Sooy asked Recreation Supervisor, Samantha Cruz to present the 2017 Scarecrow Contest Awards to the winners. She stated the following: Best Business went to IVIillville Chiropractic People’s Choice went to Holly Heights Funniest went to The Wine Shed  189 Best in Show went to Colonial Flowers Ms. Cruz stated this is a great event that grows each year. She announced that the awards that were given out were donated to the City by Action Signs and Awards. Everyone gave a round of applause. She also stated that the winners donated their monetar prizes back to the Millville Municipal Affiance which generated over $500.00 in total. Ms. Cruz also announced the Holly City Walking Club is on Tuesdays and Wednesdays at Lakeside. She also invited everyone to participate in the “Remember Me” ceremony which is coming up. Commissioner Ennis Commissioner Porreca Compari moved, seconded by Commissioner Sooy to receive and file the Fire Report for the month of October 2017. Commissioner Porreca Compari Commissioner Porreca Compari stated the preliminary budget figures representing the City’s portion of the taxes are zero for the fourth year. Mayor Santiago Mayor Santiago read the Water Utility Report. Ordinances on 2rn Reading The following proposed ordinance was read on second and final reading: Ordinance No. 37-2017 Ordinance amending the Municipal Code of the City of Miliville Chapter 39, Motor Vehicles and Traffic Regulations to add Parking Reserved for Handicapped Persons located at 322 South 5th Street, Placard Number P1827889 Commissioner Sooy moved, seconded by Commissioner Porreca Compari for the adoption of said ordianance. Mayor Santiago declared a public hearing open and asked if any person present wished to be heard. There being no response Mayor Santiago declared the public hearing closed and asked for a roll call on the motion. Ordinances on 1 Reading The following proposed ordinance was read on first reading: An Ordinance amending Chapter 61, Article TV, Collection and Disposal of Solid Waste, Section 25, Residential Dwelling Compliance Requirements, so as to require proof of contract with a solid waste hauler in the case of multi-family dwellings Commissioner Porreca Compari moved, seconded by Commissioner Sooy for first approval of said ordinance with final consideration scheduled for November 21, 2017. The following proposed ordinance was read on first reading An Ordinance amending the Municipal Code of the City of Miliville, Chapter 11, Bureau of Permits and Inspections, Section 73, Registration Permit and Fee to require proof of contract with a private waste hauler (Multi-Family Dwellings) Commissioner Sooy moved, seconded by Commissioner Porreca Compari for first approval of said ordinance with final consideration scheduled for November 21, 2017. Commissioner Enms arrived at 6:44 p.m. Resolutions  190 Resolution No. 317-2017 authorizing Water/Sewer Termination on November 27, 2017 due to failure to comply with the utility ordinance pursuant to Section 56-18 of the Municipal Code was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 318-2017 authorizing the Tax Collector to complete an application to participate in the Electronic Tax Sale Program and submit same to the Director of the Division of Local Government Services was adopted on a motion by Commissioner Soov and seconded by Commissioner Porreca Compari. Resolution No. 319-2017 authorizing cancelling various amounts from the Municipal Liens and Tax Records due to Final judgement F-013045-16 was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. Resolution No. 320-2017 authorizing the Tax Collector to charge $25.00 Tax Sale Fee per notice mailed in accordance with the rules and regulations of NJSA 54:5-19.1 was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. Resolution No. 321-2017 authorizing Water/Sewer Termination on November 27, 2017 due to payment default pursuant to Section 56-18 of the Municipal Code was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 322-2017 authorizing the Tax Collector to enter into an Installment Plan, pursuant to NJSA 54:5-19, with the property owner of Block 236, Lot 1, 55 Deerpath Rd, to pay the delinquent sewer charges in the amount of $4,919.08 in 6 equal installments of $819.85 each beginning November 25, 2017 with the last installment made by May 25, 2018 was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. Resolution No. 323-2017 authorizing adjustments in the Tax and Utility Records was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. Resolution No. 324-2017 authorizing Permissive Use Agreement between City of Miliville and Karen Cugino to allow the City to access certain parts of her property to construct storm water drainage improvements was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 325-2017 approving Stipulation of Settlement Agreement between the City of Millville and Elizabeth Nicklus, who shall pay the sum of $7,500.00 on or before January 22, 2018 regarding repayment of Rehabilitation Loan or a Judgement shall be entered against her in the amount of S10,000.00 was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. Commissioner Porreca Compari stated that this is a result of looking into the CDBG loans and collecting the balance when appropriate. The motion was carried by the following vote. Resolution No. 326-2017 authorizing cancellation of mortgage for property located at 319 N. 3rd Street, Block 377, Lot 8, requested by Darvl Stafford, owner of said property, as mortgage has been paid in full was adopted on a motion by Commissioner Porreca Compari and seconded by Commissioner Sooy. The motion was carried by the following vote. Yeas: Commissioner Enms, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 327-2017 authorizing Special Assessment of Municipal Liens for certain properties due to expenses incurred by the City of Miliville relating to Board and Secure plus administrative fees in accordance with Chapter 11, Article VI of the Municipal Code was adopted on a motion by Commissioner Soov and seconded by Commissioner Porreca Compan. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Soov and Mayor Santiago. Resolution No. 328-2017 authorizing the insertion of an additional item of revenue in the budget of the Calendar Year 2017 which is now available as revenue from the Highway Safety Fund Program- Safe Corridors Grant in the amount of $22,916.66 was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 329-2017 authorizing the insertion of an additional item of revenue in the budget of the Calendar Year 2017 which is now available as revenue from the Federal- Bulletproof Vest Partnership Grant in the  191 amount of $10,815.92 was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 330-2017 authorizing cancellation of mortgage for property located at 123-127 High Street, Block 415, Lot 25, executed by Flying Tomato, Inc. was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. The motion was carried by the following vote. Yeas: Commissioner Enms, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 331-2017 authorizing cancellation of mortgage for property located at 310 E. Oak Street, Block 370, Lot 8, requested by owner, by Eloise Williams, as said mortgage has been paid in full was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compan. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 332-2017 authorizing award of professional service contract to Sarah E. Birdsall, PP, AICP, for Planning Consultant Services for assistance in the preparation of revisions to the City of Millville’s Zoning Ordinance in an amount not to exceed $25,000.00 for a term beginmng October 1, 2017 and ending September 30, 2018 was adopted on a motion by Commissioner Porreca Compan and seconded by Commissioner Sooy. Commissioner Porreca Compari informed that she is in receipt of the appropriate certification of funds. The motion was carned by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. iproposed resolution was read authonzing the purchase of one (1)- 2018 Ford F450 Cab & Chassis Crew Cab 4x4 from Winner Ford of Cherry Hill through State Contract in the amount of $54,633.00. Commissioner Sooy moved, seconded by Commissioner Commissioner Porreca Compan. Commissioner Sooy stated that he was not sure the Water Department needs the truck, so will allow the next Commission coming in to make that decision. Commissioner Porreca Compari stated that the Water Department was looking at new equipment that was the cost of the truck so it was discussed that they would get the equipment and next year put the truck in their capital budget. The motion failed by the following vote. Nays: Commissioner Ennis, Commissioner Porreca Compan, Commissioner Sooy. Yeas: Mayor Santiago. Resolution No. 333-2017 approving Fireworks Display by Pyrotecmco of Vineland sponsored by the Miliville Board of Education, Miliville Senior High School to beheld on Wednesday, November 22, 2017 on the Miliville Senior High School grounds subject to any conditions as set forth by the Fire Official. The resolution was adopted on a motion by Commissioner Potreca Compari and seconded by Commissioner Sooy. The motion was carried by the following vote. Yeas: Commissioner Ennis, Commissioner Porreca Compari, Commissioner Sooy and Mayor Santiago. Resolution No. 334-2017 reaffirming support for the New Jersey Department of Transportation’s proposed project entitled “Route 55 Bridge Replacement over Route 47” in the City of Millville was adopted on a motion by Commissioner Sooy and seconded by Commissioner Porreca Compari. New Business Commissioner Sooy moved, seconded by Commissioner Porreca Compari to authorize the following Special Event on Public Lands Applications: a) Jolly Holly 5k Run on November 24, 2017 5:00 pm 7:00 pm located on High Street to Harnson Ave. - b) Annual Christmas Parade on November 24, 2017, 7:00 pm 10:00 pm located on High Street. Public Comment There being no further business, Mayor Santiago stated we have now reached the pubhc comment portion of our meeting. Anyone who would hke to address the commission, please go to the podium, state your name, and address your concerns. Please hmit your comments to approximately 5 minutes. Pastor Steve Harris of the Restoration House stated that he came this evening to pray, but was missed by Mayor Santiago who had a moment of silence instead. Mayor Santiago apologized for missing this on the agenda. Pastor Harris continued that Code Blue has started up again to help those in need of shelter during the cold winter months. Pastor Harris also stressed that Public Safety is desperately needed at all City Meetings in light of all of the hornfic incidents that have been taking place throughout the country. Mary Messick of Miliville stated that she appreciates the time with this Commission. She asked the new Commissioners coming in to walk the same streets as their residents to get a real idea of what it’s like to hve on those streets. She also stated that she is highly upset that she was targeted for speaking up to City Officials and stated she will not stop speaking out. She stressed if anything she will voice herself even more.  192 Angeline Broomhall of Sharp Street thanked everyone for their support of the Phenom Factory Holiday Party. She shared that this will be the second year of having the event and hopes it will be a big success like last year. She offered anyone interested in participating to reach out to her on Facebook. She also stated that everyone’s voice matters and encouraged everyone to continue to come to the meetings and speak out. Dairen Velazquez of Miliville stated that she had a bad experience dealing with the Department of Inspections with regard to a problem with the inspection of her rental and she did not know who to reach out to about her problem. Mr. Russell stated that he would look into the matter for her and asked that she provide him with her contact information after the meeting. There being no further comments, Mayor Santiago deemed the public comments portion closed. Comments by Commissioners Commissioner Sooy did not have any comments at this time. Commissioner Ennis congratulated the successful candidates in the election. He stated he is grateful he was able to hear the voice of this community. He stated there is joy in his heart tonight and wants to see the City move forward. He stated he is very happy and knows the City is being led by a man of integrity.
