Planning Board Minutes
September 13th, 2021
Open Public Meetings Act Statement of Conformance:
Members of the Millville Planning Board met on the above date for their regularly scheduled
monthly meeting in the Richard C. McCarthy Chamber, on the 4th Floor of City Hall. The
Chairman called the meeting to order at 6:30 PM and announced that this meeting was being
conducted in accordance with the Open Public Meetings Act of 1975, was advertised, posted,
and made available to the public as required by Statute. In attendance were Chairman Gallaher,
Commissioner Udalovas, Mr. Ed Gallagher, Mr. Laubengeyer, Mayor Santiago, Mr. Malone,
Mrs. Arrigo, and Mr. Caregnato. Present were Board Solicitor
Mr. Van Embden, and City’s Planning Trainee Yazmin Moreno.
Chairman Gallaher gave the board so back round on Vice-Chairman Kasuba on the Planning
Board and the good he has done in the City of Millville. We had a moment of silent in his honor.
He will be missed, Thank you for your commit to the City of Millville Planning Board.
Chairman Gallaher made a nomination to have Jay Laubengeyer as Vice- Chairman and Mr.
Wayne Caregnato seconded the nominated. All present voted yes. Mayor Santiago was not
present.
Edward Gallagher made a motion to close the nomination and Commissioner Udalovas seconded
the motion.
Jay Laubengeyer accepts the position.
Nathan VanEmbden, City’s solicitor sworn in Jay Laubengeyer as Vice-Chairman of the City of
Millville Planning Board.
MINUTES:
Mr. Edward Gallagher made a motion to approve the July 12th, 2021, meeting minutes and
seconded by Mr. Wayne Caregnato. Mr. Gallagher, Mr. Laubengeyer, Mr. Caregnato,
Commissioner Udalovas, and Chairman Gallaher voted yes. Mr. Larry Malone and Mrs. Arrigo
abstain. Mayor Santiago was not present.
CORRESPONDENCE:
Wayne Caregnato, City’s Zoning officer has created a new zoning permit application fee
schedule that was presented to the Board. The slight adjustments and added more information.
Adding the solar panel section of fees. All board members are on board with the new and
updated fees for the Zoning permit applications.
Mayor Santiago has Joined the Planning Board Meeting at 6:45pm.
Planning Board and Zoning Board updated application fees and escrow fees will be presented to
commission for 1st reading on September 21st, 2021.
Chairman Gallaher note and file the Buckshutem Solar I, LLC submitting to the New Jersey
Department of Environmental Protection, Division of Land Use Resource Protection.
Nathan VanEmbden read a letter from Stephen Nemad Attorney dated August 16th, 2021, for
Applicant Nabb Solar, LLC asking for a 2-year expansion from February 8th, 2021, the date of
the adopted resolution or run concurrently with the period of zoning protection for preliminary
and final major site plan approval. The resolution requires the applicant to perfect the minor
subdivision by August 17th, 2021. reason set forth below, the COVID-19 pandemic, the
permitted extension act of 2020 was signed into law by Governor Murphy in July of 2020. The
permit extension I told all approvals in existence on March 9th, 2020, until the end of the
COVID-19 public health emergency. Find June 4th, 2021, Governor Murphy ended the COVID-
19 public health emergency, thereby ending the COVID-19 extension period. While the major
subdivision approval was not in existence as of March 8th, 2020, and therefore not entitled to an
extension under the permit extension act, the approval was obtained during the Covid- 19
extension period a strong justification exists but the period in which to perfect the minor
subdivision should not commence until the Covid -19 extension concluded.
City’s Solicitor Nathan VanEmbden will create an administrative resolution to give Nabb Solar a
2- year Extension from February 8th, 2021, and the Planning Board will Memorial on the Next
Planning Board meeting October 13th, 2021. Resolution will read the planning board will grant
an extension of two years from 2/8/2021 resolution next meeting.
No resolutions or Application for tonight’s meeting
OTHER BUSINESS:
Yazmin Moreno and Wayne Caregnato worked together to update the Fence and Sign Ordinance.
Yazmin stated the city has got a lot of comments and questions about sign and fence
applications, so we started with those two being updated. To make the ordinance more user
friendly and mainstream. With the signs, we added a couple definitions to Sally's original write
up and made a couple of exceptions about illuminated signs. The biggest thing was the digital
sign and trying to find a way that the applicant doesn’t have to come to the board for every time.
I added that any digital sign can replace any compliant sign for new sign that is compliant with
the regulations that exists. For a bigger sign then what is allowed in that zone, they would need
to come before the zoning board. Operating the digital sign cannot depict action, motion, or light
or color changes. A flashing sign per the State of New Jersey can not change message more than
every 8 sec. If the board would like to up it to every 10 sec that will be ok as well.? The board
agrees 10 sec will be permitted. For internal illuminating tubing for outlining the sign, solid on
it's OK, but you cannot run or have flashing lights. The applicants will be sending the Zoning
officer a video of how their sign will be displayed and the Zoning officer will keep a record. The
applicant will be sent a letter of violation, addressing the running of their sign and how it was
originally presented to the board, if not they will be fined up to $1,000 and will have to appear in
court.
Fence ordinance will be permitting electric fences in the industrial zones to protect the property.
The barb wire on top of a fence would be limited to 6ft and 8ft fence with barbwire on top.
Change the language in the section of the see-through fence “cops” to Police.
Center City Redevelopment Plan will be attached to the September 21st commission meeting. We
will have a public portion comment where the public will be able to weight in with feed back
with suggestions they may have. Commissioner Udalovas thinks public comment to not will be
helpful.
Chairman Gallaher touch on not targeting in the ordinance regarding the marijuana facilities in
the redevelopment plan. We want to discourage them from being in Center City area. Yazmin
notes that the ordinance was drafted and has been in the same state since May or June. Which is
why we would like to hear more public comment thoughts before moving forward with
redefining the ordinance. We did not permit it to outstand of an I-1 or I-3 Zone. The
redevelopment plan is an overlay for that is already in the ordinance.
Pharmaceutical or retail is off the table for redevelopment in center city. Why are we not
encouraging bike paths for redevelopment in Center City, States have sent out an correspondence
regarding a bike path, have not heard any more.
Charter School are they allowed in the redevelopment area? Charter Schools are Non-profit and
Non-Taxable. Are Charter Schools permitted or not permitted in the redevelopment area? On
page 31 of the redevelopment plans that’s where the residential district is outlined and under the
permitted uses is principle use it does mention public and private schools. A Charter School is a
public school that may provide instruction and combination of grades.
Churches can go anywhere and cannot be limited to the number of Churches added.
Look into added comment to parking to help promote additional parking with new businesses.
Parking Garages or lots.
Page 40 is where the landscaping section is, give same comment on what type of trees can be
used or scrubs. Change the verbiage (Should) (Shall) or (Must).
CPETD section included Crime Prevention through Environmental Design. That is a useful
section to insert, it talks about opening of building, door entrances facing, and lightening
standards.
Vacant lots, there is a good amount of information in the residential area. By improving the
improving housing conditions in those areas will help with the vacant lots and not feel so unsafe.
Having guidance on trash disposal. To help with the appearance of the city.
Traffic pattern, High Street, 47 and 49 being changed around?

Signs -abandoned signs why are we waiting 180 days (six months) to remove a business
sign after they have been out of business?
Chairman Gallaher answers by saying the city needs to know first that the business is done. A lot
of time business owner do not notify the city after they have gone out of business. Once the city
does find out they have to send a letter and give the owner time to take their sign down.
Redevelopment plan: On the redevelopment plan, maps page 20 can they give a better
address of the zones? For an example, gateway and Center City are both in red, where does it
start where does it end can we spell this out for people, who are not normally are not from the
area. Permitted use can we spell this out better for center commercial properties? parking garage
at what point do you allow this zone to be a parking garage? why does gateway prohibit
commercial districts, why can't we have a mall there? I like the Bike trail idea and adding a
connection down to Laura Lake.
With no other further business, Mr. Caregnato made a motion to adjourn and was seconded
by Commissioner Udalovas
