REGULAR MEETING
MINERAL WELLS CITY COUNCIL
CITY HALL ANNEX
March 1, 2016 – 6:00 pm
City Councilmembers present were Mayor Mike Allen, Mayor Pro-Tem John
Upham, Councilmembers Clif Wright, Brian Reagan, Thomas Lively, and
Wayne Johnson. Councilmember Underwood was absent. A quorum of City
Councilmembers was present.
Staff members present were City Manager Lance Howerton, Police Chief
Dean Sullivan, Fire Chief Mike Pool, Finance Director John Moran,
Public Works Director Kelly Jones, City Clerk Juanita Formby, and City
Attorney George Gault.
Mayor Allen called the meeting to order, Pastor Guy Weathers of Indian
Creek Baptist Church of Mineral Wells gave the invocation, and the
Pledges of Allegiance to the U.S. and Texas were recited.
CITIZEN COMMENT
No one was present to speak.
Mr. Reagan moved and Mr. Upham seconded to approve the following
Consent Agenda and the motion carried 6-0:
1. Consider minutes of previous meeting held February 16, 2016.
2. Consider approval of budgeted expenditures over $500.
ITEMS FOR INDIVIDUAL CONSIDERATION
3. Mr. Jones presented an ordinance which would amend the City’s
Water Conservation and Drought Contingency Plan. He talked about
the two significant droughts the area has suffered in the past six
years; the most recent one resulting in dangerously low lake
levels and prompting the City to seek alternate means of providing
water to her some 30,000 water customers. Fortunately, the
drought broke and Lake Palo Pinto filled, but it was considered
prudent to put conservations measures in place ahead of another
crises. Restrictions will be in place even when the lake is full,
a measure which has been taken by many Texas cities. Mr. Jones
discussed the triggers that would cause staff to implement the
five (5) progressively restrictive stages, and described the
restrictions which would be enforced in each stage. Following the
discussion, Mr. Reagan moved and Mr. Johnson seconded to pass and
approve an ordinance amending Division 3 Water Conservation and
Drought Plan of Chapter 90, Utilities, of the Code of Ordinances
of the City of Mineral Wells, Texas by adopting a revised Water
Mineral Wells City Council Minutes 03/01/2016 Page 1 of 2
Conservation and Drought Contingency Plan; and providing for an
effective date. Motion carried 6-0.
4. Fire Chief Pool told the City Council that the antenna used for
transmission of Fire/EMS radio traffic currently mounted on the
Welcome Mountain water storage tank will be disabled when the
City’s water tanks undergo refurbishment, to commence in the next
few days. In anticipation of this, Chief Pool contacted North
Rural Water Supply Corporation and negotiated an agreement to
install the antenna on their elevated water storage tank located
on Shattles Road in north Mineral Wells. This will actually
enhance the use of the frequency, as it will be at a higher
elevation and separated from the police frequency. The Agreement
anticipates a term of ten (10) years with an additional ten (10)
year renewal, at no cost to the City. Following a brief
discussion, Mr. Upham moved and Mr. Reagan seconded to adopt an
ordinance authorizing execution of the subject agreement, and the
motion carried 6-0.
5. There was no further business to come before the City Council, so
the meeting was adjourned at 6:16 p.m.

The Mineral Wells City Council will hold a regular meeting at 6:00 p.m. on Tuesday, March 1, 2016 in
the City Council Chambers at the City Hall Annex, 115 S.W. 1st Street, Mineral Wells, Texas to consider
the following agenda:
Call to Order
Invocation – Pastor Randy Anderson of First Church of the Nazarene of Mineral Wells
Pledges of Allegiance to the U.S. and Texas flags
CITIZEN COMMENT
Citizens must provide information required on Speaker Card. The Speaker Card must be given to the
City Clerk before the meeting starts. The Council requests that comments be limited to three (3)
minutes. The Texas Open Meetings Act provides the following:
(a) If, at a meeting of a governmental body, a member of the public or of the governmental body
inquiries about a subject for which notice has not been given as required by this subchapter, the
notice provisions of this subchapter do not apply to:
(1) a statement of specific factual information given in response to the inquiry; or
(2) a recitation of existing policy in response to the inquiry.
(b) Any deliberation of or decision about the subject of the inquiry shall be limited to a proposal
to place the subject on the agenda for a subsequent meeting.
CONSENT AGENDA

4. Consider resolution authorizing execution of an agreement between the City of Mineral Wells
and North Rural Water Supply Corporation for the use of an elevated storage tank to mount a
radio antenna and related communication equipment.
