REGULAR MEETING
MINERAL WELLS CITY COUNCIL
CITY HALL ANNEX
October 17, 2017 - 6:00 pm
City Councilmembers present were Mayor Mike Allen, Mayor Pro-Tern
Tammy Underwood, Councilmembers Brian Shoemaker, Regan Johnson,
Jerrel Tomlin, John Upham, and Doyle Light. A quorum of City
Councilmembers was present.
Staff members present were City Manager Lance Howerton, Police
Chief Dean Sullivan, Public Works Director Kelly Jones, Fire
Chief Mike Pool, City Clerk Juanita Formby, and City Attorney
Mack Reinwand. Finance Director John Moran was absent.
Mayor Mike Allen called the meeting to order, Pastor Mark Alcorn
of Calvary Baptist Church of Mineral Wells gave the invocation,
and the Pledges of Allegiance to the U.S. and Texas were
recited.
CITIZEN COMMENT
[] Three people had signed to speak, and Mayor Allen recognized
each one in turn.
Leah Burns of 311 N.W. 4th Avenue said that she had sent an email
to Councilmember Regan Johnson, and was later accused of
attacking Ms. Johnson. She said that she certainly had not
meant to attack Ms. Johnson and hoped that Ms. Johnson did not
take it that way. She had simply intended to pose a question
and open a discussion. Ms. Burns did ask a question of the City
Council at large, but the City Attorney advised that since the
subject was not posted on the agenda, it would be best if the
Council did not respond. Councilmember Johnson told Ms . Burns
that she, Ms. Johnson, appreciated Ms. Burns' courage for
offering an apology in a public forum, that Ms. Johnson took no
offense at the email in question, and looked forward to having a
discussion with her.
Alonzo Washington of 203 S.E. Sth Street said that he has no job,
but his neighborhood looks bad, and he spends his time cleaning
up trash and debris and mowing grass when he can. However, he
has no good tools to work with, nor does he have a good lawn
mower, and he cannot afford to buy one. He asked those present
if they could help him out, perhaps give him a cast-off lawn

mower or any other tools that might help him in his neighborhood
cleanup.
Terri Blevins of 2807 N. Murco said that his citizen group, We
The People, now have 1100 Facebook followers, a majority of
which are against the bond proposals on the November 7th ballot.
He displayed a sign encouraging others to vote no on the City
bond propositions.
Following a motion made by Mr. Upham, seconded by Ms. Johnson,
the following CONSENT AGENDA was approved by a vote of 7-0:
1. Consider minutes of previous meeting held October 3, 2017.
2. Consider approval of budgeted expenditures over $500.
3. Consider approval of Financial Report for month ended
August 2017.
ITEMS FOR INDIVIDUAL CONSIDERATION
4. Mr. Howerton reminded the City Council that City Clerk
Juanita Formby would be retiring at the end of December. He
said that the City Clerk is appointed by, reports to, and
serves at the pleasure of the City Council, unlike the
majority of City employees who are hired by the City
Manager. Because of this, it would be the City Council who
actually selects and hires a new City Clerk. This item was
placed on the agenda so that the City Council could discuss
among themselves how they would like to handle the
interviews and selection. Mayor Allen said he would like to
appoint a committee to review the applications, said he
would want to serve on this committee, asked City Manager
Lance Howerton and City Clerk Juanita Formby to serve; and
invited one more City Councilmember to serve. Councilman
Light volunteered to complete the committee. The City
Attorney said it would be appropriate that much of the
process of interviewing could be done in a closed session.
5. Mr. Howerton said that the Airport Advisory Board had
discussed rental rates charged for housing aircraft in the
Airport's T-hangars, and a survey of T-hangar rates charged
at comparable airports in the area was conducted. The
Airport Board now recommends to the City Council that T-
hangar rates be increased, and Mr. Howerton presented a
proposed ordinance to set the new rates as recommended.
Following a brief discussion, Mr. Shoemaker moved and Mr.
Upham seconded to pass and approve an ordinance amending

Chapter 22 Aviation of the Code of Ordinances of the City of
n Mineral Wells, Texas by changing rental rates for T-hangars
at the Mineral Wells Municipal Airport; and providing for an
effective date. Motion carried 7-0.

8. Mr. Howerton reported to those present that the City and
the Area Growth Council have been in negotiations with
American Medical Response Ambulance Service, Inc. (AMR) to
locate their newest facility in Mineral Wells, at property
located at 525 Tradeway in the industrial facility most
recently occupied by Baker-Hughes. AMR is a manufacturing
concern specializing in building, rebuilding, and
refurbishing ambulances. The project is structured in that
the City of Mineral Wells would enter into a lease agreement
D with the owner of the property (landlord), LJDJH, LLC, and
the City of Mineral wells would then sublease the property
to AMR. AMR has executed a guaranty of performance for both
the lease and the sublease, so the City is held harmless in
all requirements of the lease and sublease documents. This
structure provides for a monetary incentive to induce AMR to
locate din Mineral Wells. This arrangement has been vetted
through the City Attorney, who is satisfied the agreement
provide the necessary protections for the City. Mr. Ken
Thom of AMR spoke briefly to the City Council, saying his
company was grateful to be part of the Mineral Wells
community and looked forward to many successes here.
Following the discussion, Mrs. Underwood moved and Mr. Upham
seconded to adopt a resolution authorizing execution of
lease and sublease agreements and other related documents
for lease of property located at 525 Tradeway Drive, Mineral
Wells, Texas. Motion carried 7-0.
