MINUTES REGULAR MEETING MINERAL WELLS CITY COUNCIL CITY HALL ANNEX April 2, 2019 - 6:00 pm Audio recordings of the City Council meetings are available on the City's website at mineralwellstx.gov City Councilmembers present were Mayor Christopher M. Perricone, Mayor Pro-Tern Tammy Underwood, Councilmembers Brian Shoemaker, Regan Johnson, Jerrel Tomlin, Beth Watson and Doyle Light. A quorum of City Councilmembers was present. Staff members present were Interim City Manager Margie Rose, Finance Director John Moran, Police Chief Dean Sullivan, Fire Chief Mike Pool, Public Works Director Bob Neal, City Clerk Peggy Clifton, and City Attorney Andy Messer. Mayor Perricone called the meeting to order. Pastor Gary Word of Cityview Community Church of Mineral Wells led the invocation, and the Pledges of Allegiance to the U.S. and Texas flags were recited. PRESENTATION Mayor Perricone presented a proclamation to members of the Children's Alliance Center of Palo Pinto County proclaiming April as Child Abuse Awareness Month and April 5, 2019 as Go Blue Day. CITIZEN COMMENT Two people had signed to speak and Mayor Perricone recognized each in turn. Linda Porter Bradford of 1004 NW 11th Street spoke regarding Child Abuse Awareness Month. Beverly Gilbert of 602 NE 3rct Street spoke regarding the Animal Shelter budget, staffing at the shelter, an on-call veterinarian, and building maintenance. Following a motion made by Mr. Shoemaker, seconded by Mr. Light, the following CONSENT AGENDA (Items 1,3,4,5,6) was approved by a vote of 6-0-1 with Mayor Perricone abstaining: 1. Consider approval of minutes of meetings held March 5, 2019 and March 19, 2019. 3. Consider approval of Financial Report for the month ended December 2018. ll Page 4. Consider approval of the payment of invoices to O'Brien Engineering. 5. Consider approval of payment to Schrickel, Rollins and Associates in the amount of $20,750 for services performed on Pedestrian and ADA Improvements on U.S. 281 (Downtown Streetscape Project). 6. Consider and take action to approve reappointment to Airport Advisory Board. 2. Mayor Perricone questioned as to why the City paid Investor Dues to the Chamber of Commerce. He did not understand why if we paid Hotel Occupancy Tax funds to the Chamber, why we also paid dues. The benefits of the dues were explained and after much discussion, Ms. Johnson moved and Mrs. Watson seconded to approve the budgeted expenditures over $500. Motion carried 6- 1 with Mayor Perricone voting against. ITEMS FOR INDIVIDUAL CONSIDERATION 7. Danny Martinez of Carr, Riggs, & Ingram, the City's Independent Auditors, gave a presentation of the City's Fiscal Year 2017 /2018 audit. The full Audit Report can be found on the City's website at mineralwellstx.gov or available for review in the City Clerk's Off ice. Mrs. Watson moved and Mr. Tomlin seconded to approve the Independent Audi tors' Report of the fiscal year ended September 30, 2018. Motion carried 7-0. 8. Chief Sullivan stated that Chapter 823 of the Code sets forth definitions and standards for the operation of an animal shelter. This chapter further directs the appointment of an advisory committee by the governing body to assist in complying with the requirements of the chapter, where applicable. The City of Mineral Wells and Palo Pinto County are considered "exempt" to the requirements of Chapter 823 (due to populations of less than 75,000). Staff believes it prudent to consider implementation of the provisions outlined in Chapter 823, specifically in regards to the formation of an Animal Shelter Advisory Committee. An Animal Shelter Advisory Committee can be created to work with City Staff to ensure practices and procedures related to animal control are humane, consistent with industry standards, and in the best interest of the community. The committee further serves 21 Page  as a liaison between the conununity and the City Council or other governmental bodies involved. The statute outlines the composition of the advisory committee to be composed of: • One licensed veterinarian • One municipal or county official • One person whose duties include the operation of an animal shelter • One representative of an animal welfare organization Considering the extended conununity interest, financial contribution, and agreement with Palo Pinto County with regard to the Animal Shelter, staff proposes a five (5) member Animal Shelter Advisory Conunittee to include one Municipal official and one County official. Staff has reached out to qualifying individuals to form this advisory conunittee who have agreed to voluntarily serve. Members of this advisory conunittee will serve two (2) year terms and must meet at least three (3) times each year. The Humane Society and City employee terms are 1 Year. The Veterinarian, County Official, and Animal Control Officer terms are 2 years. The following individuals have indicated they are willing to serve on the Mineral Wells Animal Shelter Advisory Committee and are reconunended to be appointed to the conunittee: • Dr. Jacquelyn Talley, Pet Western Animal Hospital • Bob Neal, Mineral Wells Public Works Director • Conunissioner Jeff Fryer, Palo Pinto County Precinct 4 • Angel Linscott, Mineral Wells Animal Control Officer • Ms. Crystal Cameron, Palo Pinto County Humane Society Ms. Johnson moved and Mr. Shoemaker seconded to approve an Ordinance establishing the "Mineral Wells Animal Shelter Advisory Conunittee"; amending Article II, "Administration and Enforcement", Of Chapter 18, "Animals", of the Code of Ordinances of the City of Mineral Wells, Texas; providing a savings clause; providing a severability clause; and providing for an effective date. Motion carried 7-0. 3I Page  9. Mr. Moran stated that regarding the City's possible participation in the Texas Main Street Program, the written "Intent to Apply" to the Program is due to the Texas Historical Commission no later than April 30, 2019. The "Intent to Apply" does not obligate the City. Once submitted, it does trigger a site visit with officials from the Texas Main Street Program that, at the very least, should prove to be beneficial for our downtown efforts. Should we choose to proceed, formal applications to the Texas Main Street Program are due no later than July 31, 2019. Approved Texas Main Street cities are announced in October 2019. If the City is approved, a Main Street Manager should be employed by the City no later than January 2020. The Community Development Corporation has dedicated $30, 000 annually towards the Main Street Program for the next three years. This $30,000 represents interest only on the principle balance of the funds accumulated to date. Additionally, the Chamber of Commerce has committed to rebating approximately $30,000 to $35,000 per year of the Hotel Occupancy Tax back to the City in an effort to support the Main Street Program. Mr. Shoemaker moved and Mrs. Underwood seconded to submit an application for the Texas Main Street Program. Motion carried 7-0. 10. Mrs. Rose stated that we had a request for a taxi/limousine permit and have nothing in the Code of Ordinances regarding limousines. Staff would be reaching out to Council for feedback regarding this before bringing an ordinance before Council. She also reminded Council that there would be testing of the outdoor warning sirens on Friday, April 5 at 10:00 a.m. This system is tested the first Friday of each month to ensure the sirens are functioning properly.
