Box 387 Mineral Wells, TX 76068-0387 (940) 328-7712 ppcmwd@gmail.com NOTICE OF MEETING The Palo Pinto County Municipal Water DISTRICT No. 1 Board of Directors (DISTRICT) will hold a regular meeting at 12:00 P.M., on Friday, April 21st, 2023, at Palo Pinto General Hospital, 400 SW 25th Ave., Mineral Wells, Texas, to consider the following agenda: To address the DISTRICT, each speaker who is present at the meeting must advise a DISTRICT board member or employee, of their desire to address the DISTRICT prior to the meeting being called to order. Each speaker shall state his/her name, city of residence, and reason for addressing the DISTRICT. Speakers shall address the DISTRICT with civility that is conducive to appropriate public discussion. Speakers shall address only the DISTRICT and not individual DISTRICT employees, or other persons present or not present at the meeting. Any member of the general public requesting to address the DISTRICT that makes their desire known after the meeting has been called to order will be placed on the next scheduled meeting’s Public Comment list. 1) Call to Order. 2) Public Comment: This is an opportunity for the general public to address the DISTRICT regarding an item(s) on the agenda. Public comments are limited to three (3) minutes per speaker, unless the speaker requires the assistance of a translator, in which case the speaker is limited to six (6) minutes, in accordance with applicable law. 3) Discuss/Consider/Take appropriate action to approve the minutes of the March 17th, 2023 regular meeting of the DISTRICT. 4) Discuss/Consider/Take appropriate action on the DISTRICT’s Financial Statements for the fiscal year to date ending March 31st, 2023, and the Investment Report for the period ending March 31st, 2023. 5) City of Mineral Wells Staff Report(s). 6) Discuss/Consider/Take appropriate action on the appointment of Rhett Warren with Warren Fonville PLLC to serve as co-general counsel. 7) Discuss/Consider an update from the DISTRICT Water Sub-committee members. 8) Discuss/Consider/Take appropriate action on Resolution in Support of the Cross Timbers Regional Utility Authority. 9) DISTRICT Staff Report(s). 10) Future agenda items/requests by DISTRICT Board Members to be on future agenda(s). Board Members shall not discuss or take action on any item that is not on the agenda. A Board Member may request that an issue be placed on a future agenda and, if a second Board Member supports the request, the item shall be placed on a DISTRICT agenda within two regularly scheduled meetings. 11) EXECUTIVE SESSION: In accordance with Texas Government Code, Section 551.001, et seq., the DISTRICT will recess into Executive Session (closed meeting) to discuss the following: a) § 551.071(1): Consultation with the DISTRICT’s attorney(s) regarding pending or contemplated litigation and/or other matters under that Section.  b) § 551.072: Consultation with the DISTRICT’s attorney(s) regarding the purchase, exchange, lease, or value of real property. 12) RECONVENE INTO OPEN SESSION: In accordance with Texas Government Code, Chapter 551, the DISTRICT will reconvene into Regular Session to consider action, if any, on matters discussed in Executive Session. 13) Adjourn The DISTRICT reserves the right to meet in Executive Session closed to the public at any time in the course of this meeting to discuss matters listed on the agenda, as authorized by the Texas Open Meetings Act, Texas Government Code Chapter 551, including §551.071, (private consultation with the attorney for the DISTRICT); §551.072 (purchase, exchange, lease or value of real property); §551.074 (personnel or to hear complaints against personnel); §551.076 (deployment, or specific occasions for implementation of security personnel or devices); and §551.087 (economic development negotiations).
