CITY MANAGER REPORT City Manager Lee Staab reviewed the City’s current priorities, with a focus on City workforce and issues with turnover. He stressed the importance of public communication, relationship building, process development and refinement and enforcement in the Engineering and Public Works Departments. He also addressed the increased caseload for Police Department detectives, which has increased 25% in the last year. Mr. Staab gave an update on the current status of Airport projects, noting the Apron project is closed for the winter, Phase 1 of the parking lot project is 75% completed and has opened up over 500 parking spaces over the Thanksgiving holiday. During his conclusion of Airport updates, he stated the terminal project is 35% complete. He recognized Bonnie Ripplinger, who retired as Cemetery Superintendent and has worked for the City for 38 years. The City Manager mentioned the Public Works 2015 infrastructure rehab design process has begun. Mr. Staab also gave an overview of the HUD Resiliency Competition where entities are competing for $1 Billion in CDBG funding. Minot is 1 of 67 eligible applicants and the competition is broken up into 2 phases, with the intent of the competition being the ability to show innovative and resilient revitalization projects that address unmet recovery needs. The City Manager mentioned the upcoming public meetings and attendance at the Resiliency Academy training in Kansas City on January 13-January 15th. Chief Olson was questioned by Alderman Miller about the types of crimes that have increased the detective’s caseloads. Chief Olson responded by saying the increase is mostly due to property crimes such as theft, burglary and vehicle theft. He stated each of the detectives averages an additional 30 cases each month. FINDING OF FACT:  The subject property is guided Commercial.  The C-2 rezoning will be consistent with existing and proposed commercial use and land use guidance.  The installation of propane tanks will protect neighboring properties. Robert Nelman Behm of Minot appeared before the Council to express his opposition to the propane tank being placed in the proposed location due to safety concens and potential accidents. He stated the area will be seeing further development, and this type of storage should not be in the area. Steve Blenker, representing AmeriGas/Flying J appeared before the Council to state they are only looking to replace a propane tank that already exists and they would not be filling over the road bulk trucks. He stated if the purchase is not approved, the department will just use existing folding tables and chairs. SPECIALTY BEER AND WINE LICENSE – GOURMET CHEF – GOURMET CHEF, INC. – APPROVED Alderman Connole moved the City Council approve the request by Gourmet Chef, Inc., dba Gourmet Chef (122 South Main) for an alcohol license revision to include Specialty Restaurant Beer with the already approved Specialty Restaurant Wine License, subject to receipt of the necessary documentation. Motion seconded by Alderman Berg and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hedberg, Jantzer, Lehner, Miller, Olson, Pankow, Schuler, Shomento. nays: none.  December 1, 2014 ADMINISTRATIVE APPROVALS – RATIFICATION Alderman Connole moved the City Council ratify the following administratively approved requests for November 2014: a. Judy Luther Benefit for a local permit to conduct raffle on November 1, 2014 at the Planet Pizza (220 S Broadway). b. Fil-Am Association of North Dakota for a local permit to conduct raffle on December 13, 2014 at Minot Moose Lodge (400 9th St SW). c. Minot Y’s Men Club for a local permit to conduct calendar raffle from January 1, 2015 to December 31, 2015 at Minot Family YMCA (3515 16th St SW). d. Hess Souris Valley United Way Committee for a local permit to conduct raffle on December 12, 2014. e. Off the Vine for a special event permit on November 13, 2014 at Lillian’s (16 South Main). f. Magic City Youth Baseball for a local permit to conduct raffle on November 13, 2014 at the Grand Hotel (1505 N Broadway). g. GAMING SITE AUTHORIZATION – GRAND INTERNATIONAL INN, CONVENTION CENTER – ND CHAPTER OF DELTA WATERFOWL, INC. - APPROVED Alderman Connole moved the City Council approve a gaming site authorization for ND Chapter of Delta Waterfowl at the Grand Hotel, Convention Center (1505 N Broadway) effective February 20, 2015 to February 21, 2015. Motion seconded by Alderman Berg and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hedberg, Jantzer, Lehner, Miller, Olson, Pankow, Schuler, Shomento. nays: none. SUPPER CLUB LICENSE – DAKOTA DAVE’S STEAKHOUSE AND SALOON – LONE RANGER, LLC . - APPROVED Alderman Connole moved the City Council approve the request Lone Ranger, LLC, dba Dakota Dave’s Steakhouse and Saloon (515 20 th Ave SE Suite 9) for a Supper Club License, effective December 1, 2014, subject to receipt of all documentation and approval by the Police Chief and Building Official. Motion seconded by Alderman Jantzer. Alderman Connole stated the initial Supper Club License was created to address Fraternal Organizations. Scott Knudsvig, of Pringle Herigstad Law Firm and representing Dakota Dave’s Steakhouse, appeared before the Council to state the business will be a Supper Club and qualifies under the ordinance. He stated the Council should not consider the misinformation previously provided by a competitor. He continued by saying the business will be a full restaurant with a menu that includes a children’s menu, and the business will be open from 4:00pm – close and serve food during those hours. Alderman Lehner stated the business would be in compliance with the Supper Club ordinance as long as they serve more food than liquor. Assistant City Attorney, Kelly Hendershot stated the definition of the Supper Club license stated the business must be open primarily as a restaurant with over 50% of business being food service. Alderman Pankow asked if there are any checks and balances on this item. The Assistant City Attorney responded by saying there is nothing in the ordinance at this time, but she is working to revise the ordinance to add this requirement. She stated liquor licenses must go through annual renewal and will need to provide documentation of food at that time.  December 1, 2014 Mayor Barney stated he did not want to change the ordinance to have businesses lose their licenses. Whereupon a vote was taken on the above motion by Alderman Connole, seconded by Alderman Janzter and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hedberg, Jantzer, Lehner, Miller, Olson, Pankow, Schuler, Shomento. nays: none. OTHER BUSINESS Alderman Jantzer moved the City Council close the City offices, with the exception of essential services on December 26, 2014. Motion seconded by Alderman Olson and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hedberg, Jantzer, Lehner, Miller, Olson, Pankow, Schuler, Shomento. nays: none.
