PERSONAL APPEARANCES Former Mayor Orlin Backes of 910 Village Ave SE appeared before the Council to present his proposal for reducing the size of City Council. He stated there has been a lot of discussion by citizens in the past year on this topic, but he believes it is important the City retain the voting structure for its citizens. He continued by saying local issues are generally resolved through contact with the Aldermen of the ward. He gave examples of issues addressed by Aldermen as speeding issues, signage, storm sewer backup and planning, zoning and building issues. He said only unresolved issues come to the City Council for consideration. He believes wards could be well served by only one Alderman rather than two. Mr. Backes also believes it would be well served to have one additional Alderman elected at large to assist the Mayor and City Manager on projects. The former Mayor stated, with his proposed structure the acting Mayor would still have a vote on those important issues that divide the Council vote. It is important for the Mayor to weigh in on these types of issues. He continued by saying the petition currently circling for the proposal by Make Minot would not allow the Mayor to vote on important issues and would allow decisions in Minot to be made by as few as three people, which he believes is too few. Also, the time component dedicated to City Council for such few people would deter people from seeking office. He is asking Council to consider his proposed ordinance and take it to a vote of the citizens of Minot. CITY MANAGER REPORT The City Manager stated public communication and transparency continue to be priorities for the City. He said a film crew from the Rockefeller Foundation had been in Minot for two days in September to film a documentary focusing on Minot’s Resiliency efforts. He also reminded those in attendance of the final public meetings for the HUD Resiliency Competition on October 6th and 8th. He said the Chief Resiliency Officer and Finance Director would be attending a Funders Summit in Washington DC on October 6th where they will present a summary of the application. He continued with updates from the various City departments including the airport which is 89% finished with the new terminal construction, the fire department which purchased a 2015 95’ Emergency One Platform Ladder. He continued by saying the Public Works expansion is progressing as well as the downtown infrastructure project, the 6th St underpass, and the downtown parking ramps. Currently licensed Taxi Companies would be given a 6 month grace period from the date of annual renewal to be compliant; the grace period would only apply to the upcoming renewal period. Brandon Rowenhorst appeared before the Council to thank the ad hoc committee for their work and believes the committee has come up with a commendable proposal. This proposed ordinance gives possibility of freedom and fills in gaps on transportation for the disabled.  October 5, 2015 Upon questioning by Alderman Lehner, Alderman Schuler indicated there are currently two cab companies with five or more vehicles in fleet. She stated this proposal would provide the best coverage for all and she does not believe it will force the smaller companies out of business. She stated the smaller companies would need to provide a vehicle that can accommodate a wheelchair and that these vehicles can be purchased used at prices from $3,000 to $4,000. Alderman Connole commended the committee on their work which included long discussions and debate. Dave Hose representing Taxi 9000 stated the smaller one cab companies actually started out under one large company but split into separate cabs when the airport limited the number of cabs per company to one on site at any given time. He stated the road is raised 3 feet and is causing water issues to the property in question. He asks the Council to consider holding back on requiring payment until the issues are resolved. The City Engineer stated he is aware of the problem which resulted from an issued building permit for a hotel which was not built. The City is in discussions on resolving the problem and will be prepared to perform the work needed to fix the issue. Angie Ward representing Ward Business Park stated the project was initiated in 2013 and her company was not made aware of the project. The company has been assessed for a road they have no access to or benefit from. She asked the Council for this assessment to be eliminated. Motion seconded by Alderman Jantzer. Kevin Connole of 1103 33rd Ave SE addressed the Council as a citizen and owner of 40% of the property in the assessment district. He stated he believes the quality of work done in this district were substandard and is disappointed in the overall outcome of this district. AIRPORT PHASE 2 CONSTRUCTION SIGNAGE – APPROVED Alderman Hatlelid moved the City Council accept the sign proposal and for the Mayor to sign a contract with 3-D Specialties, a local company, for fabrication and installation of signage for the Airport. EXECUTIVE SESSION Mayor Barney stated the next item on the agenda would be an executive session. This item may be discussed in an executive session. The legal authority for closing this portion of the meeting is N.D.C.C 44-04-17.1, 19.1, and 19.2. The topic of this executive session is Robert W Irwin et al v. City of Minot – Attorney Consultation and Discussion of Potential Litigation Strategy and/or Negotiation Strategy/Instructions. The Mayor stated, at this time, a motion would be needed in order to discuss the next topic in executive session rather than in an open meeting. Whereupon, Alderman Miller moved that the City Council move to an executive session. Motion seconded by Alderman Hatlelid, and carried by the following roll call vote: ayes: Berg, Connole, Frantsvog, Frey, Hatlelid, Hedberg, Jantzer, Lehner, Miller, Olson, Pankow, Schuler, Seymour. nays: none. The Mayor then stated the executive session will be recorded and all members of the governing body are reminded to limit their discussion during the executive session to the announced topic. Any collective decision, collective commitment, or other final action by the governing body must occur after it reconvenes in an open meeting, unless final action is specifically required by law to be taken during the executive session. The prohibition on taking final action during the executive session did not apply to providing guidance or instructions to our attorney or counsel. Mayor Barney asked the members of the public attending the meeting to leave the room. He stated the Council anticipated adjourning the executive session, and reconvening the open portion of the meeting in approximately 20 minutes.  October 5, 2015 The executive session began at 7:30 pm and was attended by all members of the City Council with the exception of Shomento, who was absent, as well as the Mayor, Rick McGee, Jon Backes, City Manager, City Clerk, City Attorney, Public Works Director and Clerk Admin. The executive session adjourned at 7:46 pm and the public was invited to return to the meeting room with the City Council meeting back in session. The Mayor indicated the executive session had discussed the litigation strategy and negotiation/instructions with legal counsel, and that instructions had been given to counsel on how to proceed. ADJOURNMENT There being no further business, Alderman Miller moved the City Council meeting be adjourned. Motion seconded by Alderman Lehner and carried unanimously.
