The applicant, Larry Schafer, came forward to answer any questions. Whereupon Alderman Jantzer moved the public hearing be closed and the City Council approve the request. PERSONAL APPEARANCES Rick Rodman, of 433 21st St SW, came before the Council to discuss the current levy system and the new levy system. He said the condition of the current levies are very poor according to the Corps of Engineer’s checklist. He requested the Council pass an ordinance making the Corps of Engineer’s levy inspection checklist the sole authority for inspections for the levy systems, since they are the experts. He also requested there be a fine based process to add leverage for compliance. He stated the levy systems are dangerous due to neglect by owners. He gave examples of situations he witnessed including a time when the levy blew as a result of a tree’s root system growing within a three foot radius of the levy. The Corps of Engineers inspected the issue and determined the problem resulted from the tree’s roots. Mayor Barney suggested Alderman Hedberg and Alderman Shomento meet with the Public Works Director and Mr. Rodman to discuss the issue and bring a report back to the Council. Steve Hoffart, of 509 17th St SW, came forward to request an update on water levels in the surrounding areas. He said the latest level for Alameda is 562 meters which is the full supply level. Rafferty is at 550.5 meters which is also at full supply level. Lake Darling is listed at 1597.24 meters which is at 1000 cfs at the Boy Scout Bridge. He raised concerns that all locations are at their full supply level and wants to assure the City is doing their due diligence to prevent any flooding. Ryan Ackerman, Administrator for the Souris River Joint Board, gave some explanation for the levels Mr. Hoffart listed. He said, Alameda is currently at 561.8 meters and the full supply level is 562 meters, however, full supply levels refers to the top of the Canadians pool. The top of dam level is 567 meters, meaning there are 17 feet of empty storage right now. Likewise, in Rafferty, the full supply level is 550.5 meters, which is where they are today. The top of dam level is 554 meters which leaves 11.5 feet of empty storage. The reservoirs are at the level they should be for this time of year. Mr. Ackerman stated, the levels are monitored very closely and it can be confusing when the measurement says “full supply level” but there is plenty of storage available in the reservoirs. MAYOR’S REPORT The Mayor listed his recent events and meetings including the Military Ball on April 8th, a deposition for the Trinity v. ManorCare lawsuit on April 12th, the Pension Board meeting on April 25th. He met with Erling Dahl representing Friendly Consult, a Norwegian Company we work with on economic development. On April 28th, he represented the City at the Native American Pow-Wow at Minot State. He then introduced Karena Verbitsky, a student, job shadowing him for the day. CITY MANAGER’S REPORT The City Manager began his report by listing some important upcoming dates including, the City-wide clean up on May 5th and 6th, and Budget Workshops May 16th and 23rd. He mentioned the Build a Better World Community Fair, June 3rd and a City Council Orientation on June 22nd. He showed the Budget Schedule which was emailed to the members of City Council and will be approved later in the agenda. He then gave some more details about the budget workshop by stating, it will discuss budget background, current City financial position, revenue 101, expense 101 and City budget 101. He emphasized, the workshops are not intended to develop the upcoming budget but rather serve as an information session to educate on the basics behind the city budget. Mr. Barry then described the memo template which will be used to create agendas going forward. The Council agendas have been updated to utilize the CivicPlus software and streamline the agenda setting process. The template will provide more consistent information to elected officials and the public. He announced some communication updates and stated, a monthly Page | 6  May 1, 2017 Regular City Council Meeting newsletter will be provided every Thursday after City Council. It will be delivered electronically and readers can subscribe on the City website. He said there will also be a monthly NDR update which was distributed to the Council and highlights all major projects and activities. He said, the City is preparing for the upcoming change in governance by planning the Budget Workshops and a Council Orientation leading up to the first meeting of the new Council at the end of June. He explained, the orientation will review basic city governance, policies and procedures, roles and responsibilities, department overviews, boards and committees and the Council handbook. Mr. Barry said, Shane Goettle will present information on the Legislative Session later in the meeting but he briefly mentioned HB1020. He said, the bill was passed, which secures $193 Million in funding for the first four phases of flood control in Minot. It will help eliminate 60% of at-risk homes from potential flooding. With the new State appropriation, the total State funding is $213 million. The local share needed for phases 1-4 will be $112 million. The City Manager recognized Representatives Roscoe Streyle, and Jim Schmidt for all of their hard work in getting the bill passed. He also recognized Senators Krebsbach, Hogue and other area Legislators as well as Mayor Barney, the State Water Commission, SRJB, Dan Jonasson and other City staff, Ryan Ackerman, Shane Goettle, and the entire State Legislature. He briefly reviewed the flood control phases 1-4 by saying, the City is continuing to buyout properties, and will complete final touches to the Water Treatment Plant this spring. He said, phases 1-3 have been designed and will begin in 2017 and phase 4 will take about 18 months to design. He then gave some department updates including an announcement the street sweepers are out, automation is scheduled to roll out in July, the Puppy Dog Sewer project phase 6 is underway and Public Works continues with water main replacements. The Engineering Department has begun several construction projects including the Broadway Bridge, Downtown Infrastructure, 83 Bypass, Burdick Expressway, 16th Street/31st Ave Intersection, and the HMGP Water Treatment Plant. The City Manager gave some information regarding the parking structures. He said, after a preliminary financial review, they discovered there has been overpayments of about $4.9 Million per structure between construction costs, unpaid rent, and excessive management fees. He said, there are also issues with the cleanliness of the buildings and gate operation. Mr. Barry will meet with Cypress Development on May 22nd to discuss the problems and the future of the structures. He mentioned, designs for both structures have past their deadlines but both were submitted incomplete. He also said, staff is working with the contractor completing the EIFS coating which is also late, but the City will not accept unfinished work. He moved on to the Airport which recently passed the Annual FAA Certification Inspection and is now preparing for the TSA Inspection. The Airport will conduct an 11 month warranty walk-through to take care of any unresolved issues in the new building and will begin beautification this spring with tree planting and landscaping. Mr. Barry stated, the Fire Department did an excellent job presenting Fire Station No. 5 during a public input meeting. Concerns from the public were met with exceptional communication and the project was well received for consideration by the end of the meeting. He expressed his enthusiasm for the Minot Public Library and said it is a wonderful community asset. The number of cardholders grew in 2016 and attendance in teen programs increased as well. He said the Library operates with a phenomenal return on investment. In 2016 they spent $1.4 Million but provided $12.6 Million in services. The Library’s 2016 Annual Report was distributed to the Council. He moved on to an update on the National Disaster Resilience Program by saying, the consultant contract was rebid. There were two proposals received and they will be evaluated by a panel for recommendation. The top candidate for the Program Manager position visited on April 24th and the City is waiting for a response to the formal offer. The Trinity Board of Directors will meet to discuss the proposal for the Downtown Gathering Space. The Affordable Housing and Family Homeless Shelter projects are developing and the Decision Support Tool is being revised. The City Manager concluded his report by describing his recent activities with the Minot Air Force. He said, he attended the Military Ball, met with Honorary Commander, Lt. Col. Shaine Thrower, Commander 741st MS and toured the Air Force Page | 7  May 1, 2017 Regular City Council Meeting Base. He was impressed by the people, equipment and capabilities and wants the City to participate in more partnering efforts by sharing facilities and programs. Alderman Straight commented, the public meeting for Fire Station No. 5 was the best public meeting he has witnessed and said he would like to see that more, specifically with projects for the NDR Program. He then asked if the City has the ability to sync meeting notices for the County and the Park Board on the City website. The Public Information Officer said, IT is looking at adding a module to the CivicPlus website that would accomplish that. Alderman Straight then asked the City Manager about the necessity of “No Trespassing” signs on properties the City purchased through the buyouts. Mr. Barry responded by saying, some properties are unsafe, therefore the signs are required. They are demolition sites which may contain gas lines and other hazards so people are kept out as a safety deterrent. Alderman Straight also asked about the City-owned property on Walders Street, used as housing for the Americorps Vistas. He wanted to know if there is a long term plan for that building since the idea was to make the location an entrance to the greenway. The Mayor requested the City Manager include that information in next month’s update. Alderman Podrygula stated, he appreciates the efforts taken regarding the parking ramps. He personally noticed many safety hazards including, water gushing from the ceilings and unlit doorways. He also calculated only 18% of the parking spaces were being used and asked for the City Manager’s thoughts on how to increase utilization of the structures. Mr. Barry said the most obvious detractor is that it is a paid facility and the free street parking has an unfair competitive advantage when attracting patrons. He said there is also a stigma around the parking garages and they still look unfinished. He assured, he will continue to discuss these issues which have been so frustrating for the entire community but the City does not have as much leverage as he would like. SUBDIVISION OF ST. JOHNS 2ND ADDITION, LOTS 1 & 2 – APPROVED Alderman Kossan moved the City Council subdivide St. Johns Addition, Lot 1 into 2 lots to be known as St. Johns 2nd Addition, Lots 1 & 2. The City of Minot has selected a portion of the existing parcel as the preferred location for a satellite fire station to serve western Minot. 3. A suitable sized lot must be subdivided from the remainder for the fire station location. 4. A two-lot subdivision is required. 5. All public improvements are available to the site. 6. A fire station is most properly located in the P, Public District. 7. The fire station lot will be rezoned to P, Public District while the remaining lot will retain the present zoning status of R1, Single-Family Residential allowing future development of single-family residential housing around the station. Conditions: 1. A thirty-foot (30’) wide drainage easement shall be dedicated with fifteen feet extending in each direction perpendicular to the centerline of the drainage ditch across proposed Lot 2. The surrounding zones are complimentary to the proposed zone change. 6. The proposed use meets the requirements of the proposed zone. 7. The conditioned project details will provide a public benefit in that they are of improved site and architectural design and have shown preserved open space. Conditions: 1. The developer must provide an explanation of the character of the planned development and the manner in which it has been planned to take advantage of the planned development regulations including public benefits it is providing. 2. A general indication of the expected schedule of development including progressive phasing and time schedule. 3. That the building plans be modified to the extent that garage doors are not the dominant feature of the front façade. Revised elevation renderings have been provided to the Planning Department for review and approval. The side facade should provide windows and or dormers in a style consistent with what is found on the residential units. 4. Primary roofs shall be articulated by at least one of the following: changes in place and elevations combining low and high, dormers, gables. 5. Exterior building finishes and colors to include a variety of building materials, distributed through the facades and coordinated to create an architecturally balanced appearance. Facades of each attached unit shall be finished with a variety of colors to be less repetitive and more exciting. 6. Rear decks and porches should be provided as part of the dwelling unit building plans. 7. That the petitioner submit a Detailed Development Plan describing: a. Uses permitted b. The Public Works Director came forward to state, there are two different projects being recommended in this item and he requested the City Council award the low bid for the Sundre Pipeline (4195.0) to Wagner Construction in the amount of $6,992,686 and authorize the Mayor to sign the bid document. He continued by saying, the second project, for construction of the Sundre Raw Water Supply Reservoir and Pump Station (4195.1), was issued an addendum the night before the bid opening. It was discovered that Well Work D included 14” casing rather than 16” casing and the equipment would not work on that section. The engineers did not have time to create new specifications for Well Work D so the addendum was sent to delete that section of work. The situation created some confusion so staff is recommending the City Council reject the bids for the Sundre Reservoir and Pump Station and rebid the project. Whereupon Alderman Jantzer withdrew his motion to reject the bids and Alderman Podrygula withdrew his second. ASSET ALLOCATION LETTERS – APPROVED Alderman Lehner moved the City Council approve the Asset Allocation Letters for the City of Minot Employee Pension and authorize the Mayor to sign the letters. Alderman Podrygula said he was impressed by the focus of the questions during the Pension Board meeting and asked if the City should continue reaching for a 7.5% return on investment when the average rate of return is only 5.6%. The Mayor said, the discussion came to the conclusion that 7.5% is ambitious and perhaps the City needs to revise the budget and continue to monitor on an annual basis. He added, no one wants a higher unfunded liability and it will be assessed annually. Whereupon a vote was taken on the above motion by Alderman Lehner, seconded by Alderman Podrygula and carried by the following roll call vote: ayes: Berg, Frantsvog, Hedberg, Jantzer, Kossan, Lehner, Olson, Pankow, Podrygula, Shomento, Sipma, Straight; nays: none. 2018 BUDGET SCHEDULE – APPROVED Alderman Hedberg moved the City Council accept the proposed 2018 Budget Schedule. Motion seconded by Alderman Berg. Alderman Podrygula said he was impressed with the schedule and was glad to see the Council will be given adequate time to look at the President’s message, hold an informational meeting, and then have a week to analyze before the next meeting. UPDATE ON 2017 LEGISLATIVE SESSION – SHANE GOETTLE AND LACEY ANDERSON Special Assistant City Attorney, Shane Goettle and Lacey Anderson highlighted key bills from the 2017 North Dakota Legislature that will have positive impacts on Minot. Under SB2013, Minot would receive an estimated $5.9 million over the next biennium through the state’s funding for oil and gas hub cities. The estimates are based on a variety of factors, including a projected oil production level of 925,000 barrels per day in fiscal year 2018, and 950,000 barrels per day in fiscal year 2019. The estimated price is projected at $47 per barrel. Goettle also reported that there will be an interim legislative study of hub city funding. SB 2013 also provided up to $1.325 million to the City of Minot for a landfill expansion project. Senate Bill 2166 includes language that before any property incentive can be granted by a city for longer than 5 years, the city must send notices of terms to the county and school districts affected to allow those districts the choice to participate or not in the incentives. Senate Bill 2288 reformed municipal budgeting, stating that after the governing body has prepared the preliminary budget statement, on or before Aug. 10, the auditor of the municipality shall provide the county auditor with a copy of the preliminary budget statement, set a public budget hearing date between Sept. 7 and Oct. 7, and provide notice of the public budget hearing date to the county auditor. House Bill 1020 includes $193 million to cover the state’s funding portion of the first four phases of the Mouse River Enhanced Flood Protection plan within the city of Minot for the eight-year period between July 1, 2017, and June 30, 2025. Page | 19  May 1, 2017 Regular City Council Meeting Mr. Goettle gave credit to Dan Jonasson and Ryan Ackerman for all of the great work they put in during the session. The Mayor asked about a schedule for the interim study, to which Mr. Goettle stated, the Chair will be picking the committees. This particular study will include proportional representation from across the state and will be selected in June. The Mayor then directed the City Manager to send the spreadsheet of Legislative Bills to the members of Council.
